Silva on Monday, November 14, 2022 at 4:30 p.m. in the Administration Building of the Orange County Sanitation District. Chair Silva stated that the meeting was being held telephonically and via Internet accessibility. Board Vice-Chair Gallagher led the flag salute. ROLL CALL AND DECLARATION OF QUORUM: The Clerk of the Board declared a quorum present as follows: PRESENT:Jesus Silva, Kim Carr, Ryan Gallagher, Anthony Kuo, Chad Wanke and John Withers ABSENT:Andrew Nguyen STAFF PRESENT: Brian Engeln was present in the Board Room. Jim Herberg, General Manager; Rob Thompson, Assistant General Manager; Lorenzo Tyner, Assistant General Manager; Celia Chandler, Director of Human Resources; Kathy Millea, Director of Engineering; Riaz Moinuddin, Director of Operations and Maintenance; Lan Wiborg, Director of Environmental Services; Kelly Lore, Clerk of the Board; Jennifer Cabral; Belen Carrillo; Tanya Chong; Daisy Covarrubias; Tina Knapp; Rebecca Long; Kelly Newell; Wally Ritchie; Thomas Vu; and Ruth Zintzun were in attendance telephonically. OTHERS PRESENT: Brad Hogin, General Counsel; Cori Takkinen, Townsend Public Affairs (TPA); Eric O’Donnell, TPA; and Eric Sapirstein, ENS Resources were in attendance telephonically. PUBLIC COMMENTS: None. REPORTS: Chair Silva did not provide a report. General Manager Jim Herberg reminded the Committee of the Special Board Meeting - State of OC San on November 15, 2022 at 9:00 a.m.; Regular meeting of the Steering and Board on November 16, 2022; and the upcoming holiday closures of the OC San Administrative offices on November 24 and 25; and December 23 and 26. AYES:Jesus Silva, Kim Carr, Ryan Gallagher, Anthony Kuo, Chad Wanke and John Withers NOES:None ABSENT:Andrew Nguyen ABSTENTIONS:None NON-CONSENT: 2.PUBLIC AFFAIRS UPDATE FOR THE MONTHS OF SEPTEMBER AND OCTOBER 2022 2022-2605 Originator: Jim Herberg Principal Public Affairs Specialist Daisy Covarrubias provided a PowerPoint presentation that included a recap of the events, tours, and social media posts for the months of September and October; and an overview of upcoming events. MOVED, SECONDED, AND DULY CARRIED TO: Recommend to the Board of Directors to: Receive and File the Public Affairs Update for the months of September and October 2022. AYES:Jesus Silva, Kim Carr, Ryan Gallagher, Anthony Kuo, Chad Wanke and John Withers NOES:None ABSENT:Andrew Nguyen ABSTENTIONS:None 3.DRAFT 2023 LEGISLATIVE AND REGULATORY PLAN 2022-2601 Originator: Jim Herberg Administration Manager Jennifer Cabral briefly introduced the item and introduced Senior Public Affairs Specialist Rebecca Long who provided a PowerPoint presentation which included an overview of the draft plan including the guiding priorities, the Page 2 of 4 LEGISLATIVE AND PUBLIC AFFAIRS COMMITTEE Minutes November 14, 2022 legislative-regulatory team, procedure for taking a position, and how the plan is developed. MOVED, SECONDED, AND DULY CARRIED TO: Recommend to the Board of Directors to: Approve the Orange County Sanitation District 2023 Legislative and Regulatory Plan. AYES:Jesus Silva, Kim Carr, Ryan Gallagher, Anthony Kuo, Chad Wanke and John Withers NOES:None ABSENT:Andrew Nguyen ABSTENTIONS:None Director John Withers departed the meeting at 4:57 p.m. 4.LEGISLATIVE AFFAIRS UPDATE FOR THE MONTHS OF SEPTEMBER AND OCTOBER 2022 2022-2602 Originator: Jim Herberg Ms. Long introduced Eric Sapirstein, ENS, who provided a PowerPoint presentation regarding current issues including community project requests, PFAS/PFOA rule making, Inflation Reduction Act implementation, and the Lame Duck session. Eric O'Donnell, TPA, provided a PowerPoint presentation which included the a general overview of the legislative session in Sacramento, the ending of the declared COVID-19 State of Emergency, AB 2449 (Rubio) - Brown Act Modifications pertaining to remote public meeting participation, and a look ahead at 2023. MOVED, SECONDED, AND DULY CARRIED TO: Recommend to the Board of Directors to: Receive and file the Legislative Affairs Update for the months of September and October 2022. BOARD OF DIRECTORS INITIATED ITEMS FOR A FUTURE MEETING: Board Chair Chad Wanke announced that this may be the last Legislative and Public Affairs Committee as the business currently addressed at these meetings will potentially be transferred back to the Steering Committee. Chair Wanke thanked Committee Chair Silva, Committee Vice-Chair Carr, and the serving members for their dedication and support. Committee Chair Silva announced that this will be his last Legislative and Public Affairs Committee meeting due to the redistricting of his City and the loss of his Council seat. He thanked former Board Chair Withers and Chair Wanke for their confidence and support, and thanked staff for their dedication.
