HomeMy WebLinkAboutItem No. 2 (2)5/10/2021 1 WWW.TOWNSENDPA.COM SACRAMENTO • WASHINGTON, DC NORTHERN CALIFORNIA • CENTRAL CALIFORNIA • SOUTHERN CALIFORNIA TPA Presentation to: Orange County Sanitation District May 10, 2021 Slide 2 Agenda Legislative Calendar Specific Legislation Sacramento Advocacy Days Update 1 2 5/10/2021 2 Slide 3 Legislative Calendar • Policy Committee deadline for fiscal bills was April 30 • Policy Committee deadline for non-fiscal bills was May 7 • Most bills that have a considerable State fiscal impact will be referred to the Appropriations Committees’ Suspense File. • Senate and Assembly Appropriations Committees will consider their Suspense File on May 20 • May revise expected in mid-May Slide 4 AB 59 (Gabriel) •Details: o Changes the statute of limitations for legal challenges for new or increased connection or capacity fees o Could result in legal challenges years after fees schedules are implemented o Would require that fees collected in excess of the amount needed to provide the service be refunded back to the ratepayers o Establishes that data cannot be used to defend the protest that was not made available to the public •Status o Two-year bill o OC San position: Oppose 3 4 5/10/2021 3 Slide 5 AB 339 (Lee) •Details: o Significantly amended. Additional amendments expected soon o New language expected to only be applicable to cities and counties over 250,000 population o Will require public access via telephone OR internet (not “and”) giving local agencies flexibility in implementation o Remove all language requirements, including translation and interpretations provisions o Remove language allowing local agencies to require members of the public to register in order to provide public comment o Sunsets on December 31, 2023 •Status o Currently in the Assembly Appropriations Committee o OC San position: Oppose Unless Amended Slide 6 AB 622 (Friedman) •Details: o Would require, on or before January 1, 2024, that all washing machines sold as new in California contain a microfiber filtration system with a mesh size of 100 microns or smaller. •Status o Two-year bill o OC San position: Support 5 6 5/10/2021 4 Slide 7 AB 802 (Bloom) •Details: o Would require the State Water Resources Control Board to identify the best available control technology for filtering microfibers from an industrial, institutional, or commercial laundry facility o Require, on or before an unspecified date, any entity that operates an industrial, institutional, or commercial laundry facility to adopt the use of the best available control technology to capture microfibers that are shed during washing •Status o Two-year bill o OC San position: Watch Slide 8 AB 1434 (Friedman) •Details: o In 2018, the State passed legislation for the creation of new urban water use efficiency standards for indoor use, outdoor use, water loss, and variances for unique conditions o AB 1434 would establish the following indoor residential water use targets, which are all lower than those previously enacted: o Beginning January 1, 2023 and until January 1, 2025, a new standard for indoor residential water use of 48 GPCD o Beginning January 1, 2025, the standard would be lowered to 44 GPCD o Beginning January 1, 2030, it would be further reduced to 40 GPCD •Status o Passed the Assembly Water, Parks, and Wildlife Committee o Currently in the Assembly Appropriations Committee o OC San staff recommended position: Oppose 7 8 5/10/2021 5 Slide 9 OC San Advocacy Days - Sacramento • TPA and staff are working to schedule virtual advocacy days for OC San in Sacramento in April and May • Meetings that have taken place include: o Senator Newman o Assembly Member Rivas – AB 377 o Senator Laird – SB 619 o PFAS regulators – Source identification and biosolids • Meetings still to be scheduled: o Senator Min Slide 10 Thank You Cori Takkinen Eric O’Donnell Southern California Senior Director Senior Associate CTakkinen@townsendpa.com EODonnell@townsendpa.com www.townsendpa.com www.townsendpa.com 9 10
