PUBLIC COMMENTS: If you wish to speak, please complete a Speaker’s Form and give it to the Clerk
of the Board. Speakers are requested to limit comments to three minutes.
NON-CONSENT ITEMS:
1.KLEAN WATERS APPEAL HEARING
Steering Committee to continue deliberations on the appeal of the December 11,
2014 decision of the Sanitation District’s General Manager James D. Herberg,imposing: 1) a revocation of Industrial Wastewater Discharge Permit No. 52-1-841,and 2) an administrative civil penalty in the amount of $1,190,000.
ADJOURNMENT:
The next regular Steering Committee meeting, Wednesday, April 22, 2015, at 5:00 p.m.

SUBJECT: KLEAN WATERS APPEAL HEARING
ASSISTANT GENERAL MANAGER'S RECOMMENDATION
Steering Committee to continue deliberations on the appeal of the December 11, 2014 decision of the Sanitation District’s General Manager James D. Herberg, imposing: 1) a
revocation of Industrial Wastewater Discharge Permit No. 52-1-841, and 2) an administrative civil penalty in the amount of $1,190,000.
SUMMARY
The appeal hearing on the above appeal was held on March 27th.
Katherine Jenson of Rutan & Tucker, LLP, served as an independent legal advisor to the
Steering Committee for purposes of the hearing.
Melissa Thorme, of Downey Brand, served as prosecutor representing the District for purposes of the hearing. Ms. Thorme presented the prosec
Matthew Kaplan of Tucker Ellis LLP represented Klean Waters.
At the conclusion of the presentations, the Committee commenced deliberation of the
matter but did not conclude the deliberations. The purpose of this next session is to provide an opportunity for the Committee to complete its deliberations. Because Director Withers was not in attendance for the March 27th hearing, he is excused from attending this session. It is anticipated that once the deliberations are completed, the Committee will give Ms. Jenson directions regarding the preparation of a formal written decision.
That decision will be acted on a future meeting of the Committee. The formal written opinion must be adopted within 65 days of the completion of the hearing.
The transcript from the March 27th hearing was distributed to the Committee members under separate cover.
Ms. Jenson will be distributing a worksheet to assist in the Committee in structuring the
remaining deliberations. Once completed, it will be distributed to the parties and the Committee.
