Three basic types :

■ Public Works - Professional Design Services
■ Goods and Services
Each is governed by State Law and District policy
PUBLIC WORKS
CONSTRUCTION
■ Follows California Public Contract Code
■ Invitation for Bids ( IFB) are advertised (twice)
■ Awarded to lowest Responsive & Responsible
bidder
PUBLIC WORKS
PROFESSIONAL DESIGN SERVICES
■ Follows California Government Code
■ Selection is based on qualifications only — cost not
a factor ( Mini-Brooks Act)
■ Request for Proposals ( RFP) are advertised (twice)
■ Evaluate & Rank Proposals
■ Negotiate "fair and reasonable fee" with top
ranked firm
GOODS AND SERVICES
■ Follows California Government Code 54202
■ Goods and services range from chemicals, information
technology, labor, operational and environmental
services, vehicles, maintenance equipment, and
consumables. Over 800 different classifications of
goods and services.
■ Bidding required for purchases > $5,000
• Award to lowest Responsive & Responsible bidder

THE METHODS
a Notice Inviting Bids (NIB)
■ The NIB is the procurement process for the purchase of
goods, services, and equipment.
■ Award is made solely on basis of the lowest Responsive
& Responsible bidder.
■ Negotiations are not permitted.

a Sole Source
■ Non-preferred option
■ Used when :
• Only one known source is available
• Matching existing system or architecture
• Unique product or service
• Emergencies

a Request for Proposals (RFP)
■ Used for sophisticated or complex, non-standard goods and
services.
■ Award is based on Best Value (experience, financial
standing, delivery, approach, cost).
■ Negotiations may be necessary.
APPROVAL THRESHOLDS
Per Ordinance No. OCSD-47 Article 7, the following
delegations of authority to award purchases apply
to the following:
■ Sufficient Budget Available and Authorized
■ GM up to $ 100K
■ Board Committee over $100K up to $200K
■ Board Approval if over $200K
