Link Director of Government Affairs November 13, 2017 2017 Legislative Year in Review: Successes AB 1129 (Stone): Died on Assembly Floor (CASA Opposed) •Would have changed how the Coastal Commission issues permits for ”coastal armaments” and related structures. •Possible negative implications for all agencies with ocean outfalls, including impacts to infrastructure planning and proper protection and maintenance of coastal assets. AB 574 (Quirk): Signed by Governor (CASA Support) •Sponsored by WateReuse CA and the CA Coastkeeper Alliance. •Directs State Water Board to adopt statewide regulations for raw water augmentation by December 2023. •Supported by CASA and several local member agencies. 2017 Legislative Year in Review AB 967 (Gloria): Signed by Governor (CASA Approve) •Legalizes “biocremation” in California, and allows for disposal of hydrolysate through sewer disposal under certain conditions. •CASA secured amendments that allow for complete local control over accepting this type of waste, with language that allows an agency to prohibit these discharges “for any reason” including for purposes of promoting advanced water recycling projects. SB 229 (Wiekowski): Signed by the Governor (CASA Neutral) •Expands last year’s SB 1069, which changes how agencies can assess connection fees for accessory dwelling units, to apply to all special districts. Note: CASA developed and distributed FAQs for member agencies on SB 229 and AB 967. 2017 Legislative Year in Review SB 231 (Hertzberg): Signed by Governor (CASA Support) •Changes the definition of “sewer” in Proposition 218 Omnibus Implementation Act to include “stormwater” for purposes of levying property related fees, potentially impacting agencies servicing cities that want to implement fees for stormwater management. •This is very likely to be challenged by taxpayer groups, resulting in a “test case” to determine the legality and scope of this approach. SB 5 (De Leon): Signed by Governor (CASA Support) •$4 billion Parks and Water Bond that includes $100 million+ for water recycling (same water recycling account established in Prop 1) •Goes before the voters on November 2018 General Election ballot CASA Flushable Wipes Campaign •Major CASA business plan priority. •Confluence of recent developments such as Washington D.C. flushable wipes legislation (and subsequent litigation), potential model language being developed by NACWA, and breakdown of industry related solution. •Flushables campaign will be featured at CASA January Conference and several communications, outreach and advocacy pieces throughout 2018. Looking Forward to 2018 Microplastics •Emerging issue that could result in state legislation. •CASA recently weighed in with the Ocean Protection Council on approaches to address plastic pollution. •BACWA and the San Francisco Estuary Institute (SFEI) are developing microplastics research. Looking Forward to 2018: State Legislation Possible Action on Little Hoover Commission Recommendation #17: Private Sewer Lateral Point of Sale Study •“The state should conduct a study –by either a university or an appropriate state department –to assess the effect of requiring real estate transactions to trigger an inspection of sewer lines on the property and require repairs if broken.” Possible CalPERS JPA Legislation •CalPERS may sponsor legislation that would attach joint and several liability to new and current Joint Powers Authorities (JPAs) for all unfunded pension liabilities for any public retirement system and make related changes. •CSDA has already expressed serious concerns with this potential legislation, which would change contract agreements already in place and would require public agencies to report public retirement system liabilities of each JPA they participate in as their own liabilities on their agency’s balance sheets. •CASA will monitor this issue closely in 2018. Possible AB 967 (Biocremation) Cleanup Legislation Looking Forward to 2018: Federal Outlook Tax Reform •State and Local Tax (SALT) exemption; •Status of tax exempt municipal bonds; Ten Year NPDES Permit Terms •Recent Congressional testimony •Outreach to key members Infrastructure Financing •WIFIA Program expansion •Continued Clean Water SRF Funding Citizen Suit Legislation Regulatory Reform and Streamlining Upcoming Meetings and Events CASA Federal Legislative Committee Strategic Planning Session: December 1, 2017 at OCSD. CASA State Legislative Committee Strategic Planning Session: December 8, 2017 in Sacramento. CASA Winter Conference: January 24-26, 2018 in Palm Springs, CA. CASA Washington D.C.
