Legislative Concept 1
•Concept:
–Amend Public Contracting Code for Sanitation Districtstoincreasethethresholdforcontracting
•Background:
–According to the California public contracting codesection20783,when Sanitation Districts do workthemselvesbyforceaccount,the amount shall notexceedfivethousanddollars($5,000)
•Sanitation Districts are required to contract anyworkbetween$5,000 and $35,000
•Sanitation Districts are required to bid out any workovera$35,000 amount

Section 20783 to raise the thresholds for contracting
and/or bidding.
•Potential Hurdles:

•Concept:
–Amend Public Contracting Code for Sanitation Districtstomodifythebidadvertisingrequirement
•Background:
–California Public Contracts Code 20783 also requiresSanitationDistrictstoadvertiseitsconstructionbidsinaprintnewspaper
•The first publication or posting of the notice shall be at least 10 daysbeforethedateofopeningthebids.Notice shall be published at leasttwice,not less than five days apart,in a newspaper of generalcirculation,printed and published in the district,or if there is none,itshallbepostedinatleastthreepublicplacesinthedistrictthathavebeendesignatedbythedistrictboardastheplacesforpostingthisnotice.The notice shall distinctly state the work to be done.

–Introduce legislation to amend Public ContractsCodeSection20783to:
•Modify the requirement to post in a print newspaper to
give OCSD flexibility and save money.
•Another modification to the advertising requirementcouldbereducingtheamountofinformationyoumustdisclose
•Potential Hurdles:
–Statewide impact
–Anticipated opposition from newspaper industry

•Concept:
–Design Build Authorization for Future OCSD AdministrationBuildings
•Background:
–In 2014,the Legislature passed SB 785 (Wolk),a landmark design buildbill.This bill gave local authorities more autonomy to enter into designbuildcontracts
–Specific to Special Districts,SB 785 allows design build for:
•regional and local wastewater treatment facilities
•regional and local solid waste facilities
•regional and local water recycling facilities
•fire protection facilities
–SB 785 does not allow for using design build on Administration typebuildings

•Background Continued:
–OCSD has been looking into sponsoring legislation
that would authorize the headquarters project to
be built using design-build.
•Due to the timing of the Headquarters project,this
option is no longer viable.
–Design-Build could still be utilized for future
Administration type buildings at both Plant No.1
and Plant No.2.

•Proposed Legislative Concept:
–Introduce legislation that grants OCSD the explicit
authority to use the design-build process onAdministrationbuildings.
–OCSD currently has design build language in section20785ofthePublicContractsCode
•This language allowed the use of design build forconstructionprojectsover$6 million.This language
expired January 1,2013.
•Potential Hurdles:
–Potential opposition from labor

•Concept:
–Inspection of sewer laterals at the time of a parcel sale
•Background:
–The Little Hoover Commission released a report to the
Legislature on special districts in August 2017.
•Within the report,they recommend that the Legislature fund
a study that would determine the feasibility of requiring the
inspection and repair of sewer lines on properties at the time
of sale

•Proposed Position:
–Support industry associations in the initiative to
implement the study recommended by the Little
Hoover Commission.
–The study could be done in partnership with a
university or an appropriate State Department.

•General Manager Recommendation
–Provide direction to staff on the legislative concepts
illustrated in the Agenda Report.
