Contracts, Purchasing & Materials Management ORANGE COUNTY SANITATION DISTRICT’S PROCUREMENT PROCESS PROCUREMENT OVERVIEW Three basic types: Public Works -Construction Public Works -Professional Design Services Goods and Services Each is governed by State Law and District policy PUBLIC WORKS Follows California Public Contract Code Invitation for Bids (IFB) are advertised (twice) Awarded to lowest Responsive & Responsible bidder CONSTRUCTION PUBLIC WORKS Follows California Government Code Selection is based on qualifications only –cost not a factor (Mini-Brooks Act) Request for Proposals (RFP) are advertised (twice) Evaluate & Rank Proposals Negotiate “fair and reasonable fee” with top ranked firm PROFESSIONAL DESIGN SERVICES GOODS AND SERVICES Follows California Government Code 54202 Goods and services range from chemicals, information technology, labor, operational and environmental services, vehicles, maintenance equipment, and consumables. Over 800 different classifications of goods and services. Bidding required for purchases > $5,000 •Award to lowest Responsive & Responsible bidder GOODS AND SERVICES Notice Inviting Bids (NIB) The NIB is the procurement process for the purchase of goods, services, and equipment. Award is made solely on basis of the lowest Responsive & Responsible bidder. Negotiations are not permitted. THE METHODS Sole Source Non-preferred option Used when: •Only one known source is available •Matching existing system or architecture •Unique product or service •Emergencies GOODS AND SERVICES THE METHODS CONT. Request for Proposals (RFP) Used for sophisticated or complex, non-standard goods and services. Award is based on Best Value (experience, financial standing, delivery, approach, cost). Negotiations may be necessary.
