Follows California Public Contract Code
Invitation for Bids (IFB) are advertised (twice)
Awarded to lowest Responsive & Responsible
bidder
CONSTRUCTION
PUBLIC WORKS
Follows California Government Code
Selection is based on qualifications -not cost
(Mini-Brooks Act)
Request for Proposals (RFP) are advertised
Evaluate & Rank Proposals
Negotiate “fair and reasonable fee” with top
ranked firm
PROFESSIONAL DESIGN SERVICES
GOODS AND SERVICES
Follows California Government Code
Goods and services range from chemicals, information
technology, operational and environmental services,
vehicles, maintenance equipment, and consumables.
Over 680 different classifications of goods and services.
Bidding required for purchases > $5,000
•Award to lowest Responsive & Responsible bidder
GOODS AND SERVICES
Notice Inviting Bids (NIB)
Procurement process for the purchase of supplies,
equipment and services.
Award is made solely on basis of the lowest Responsive
& Responsible bidder.
Negotiations are not permitted.

Sole Source
Non-preferred option
Used when:
•Only one known source is available
•Matching existing system/architecture
•Unique qualification/commercial license
Emergencies

Request for Proposals (RFP)
Used for sophisticated/complex, non-standard goods and
services.
Award is based on best value (experience, financial
standing, delivery, approach, cost).
Negotiations may be necessary.

APPROVAL THRESHOLDS
Per Ordinance No. OCSD-47 Article 7, the following
delegations of authority to award contracts applies
to the following:
Sufficient Budget Available and Authorized
GM up to $100K
Board Committee up to $200K
Board Approval if over $200K
Contingencies for change orders
RECAP
Public Works -Construction
Lowest Responsive & Responsible Bid (IFB)
Public Works -Professional Design Services
Most Qualified Firm (RFP)
Fair & Reasonable Cost
Goods and Services
Lowest Responsive & Responsible Bid (NIB)
