PLAN FOR SERVICES AND MUNICIPAL SERVICE REVIEW
The Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, as
amended (Government Code §§56000 et seq.) (CKH) governs LAFCO's proceedings for
the proposed actions outlined above. More specifically,CKH Sections 56824.10 through
56824.14 govern LAFCO's proceedings and the application process for the activation of
latent powers, including the requirement to submit a comprehensive Plan for Services.
As part of LAFCO's review of the application, including the Plan for Services, LAFCO is
requiring the preparation of a Municipal Service Review (MSR) under CKH Section
56430, concurrent with LAFCO's consideration of EOCWD's SOI as part of the
reorganization proposal.
LAFCO Review of Alternative Service Providers
As part of LAFCO's review of EOCWD's Plan for Services for the activation of latent
powers, and under the MSR process, LAFCO is required to review alternative service
providers for local retail sewer service to the affected territories. CKH Section
56824.12(a)(6) requires that the Plan for Services for the activation of latent powers
include "alternatives for the establishment of the new or different functions or class of
services within the special district's jurisdictional boundaries." Likewise, CKH 56430(b)
requires that, "in conducting a service review, the commission shall comprehensively
review all of the agencies that provide the identified service or services within the
designated geographic area. The commission may assess various alternatives for
improving efficiency and affordability of infrastructure and service delivery within and
contiguous to the sphere of influence, including, but not limited to, the consolidation of
governmental agencies." The MSR and Plan for Services review will both
comprehensively evaluate multiple factors impacting the efficiency, cost, and reliability
of services to affected customers within the geographic study area.
MSR Scope of Work
Although the specific boundaries of the MSR study area have yet to be defined, they
will generally include OCSD Service Area 7 and immediately surrounding areas. As
LAFCO staff begins to more clearly define the scope of work of the MSR, I would like to
meet with you to discuss and receive feedback from your agency on:
• The geographic area of the MSR;
• Alternative service providers within the area;
• The MSR process, including stakeholder and public participation; and
• MSR data and information requests from LAFCO to stakeholder agencies.

To ensure the MSR is based on the most current, accurate, and reliable data and
information, we will be requesting your staff's support and assistance in collecting
relevant data from your agency.
I will be in contact with you during the next couple of weeks to schedule a meeting to
discuss the MSR scope, process, and timeline. In the meantime, if you would like to
review or obtain a copy of EOCWD's application and Plan for Services, please contact
