OCSD 12-13 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ORANGE COUNTY SANITATION DISTRICT (OCSD) DECLARING THE UNUSED PORTION OF REAL PROPERTY LOCATED AT 1700-2000 WEST COAST HIGHWAY IN NEWPORT BEACH TO BE SURPLUS PROPERTY; AND FIND THE DISPOSAL OF THESE PROPERTIES EXEMPT FROM THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER THE GUIDELINES OF 14 C.C.R. 15312. WHEREAS, in 2004, OCSD purchased real property located at 1700-2000 West Coast Highway in the City of Newport Beach ("OCSD Property") for the purpose of constructing a replacement for the outdated Rocky Point Pump Station; and WHEREAS, the design and construction of the Rocky Point Pump Station left a portion of the OCSD Property, specifically, Lots 61, 62, 63, 64, and 65 available for other uses. NOW, THEREFORE, the Board of Directors of the Orange County Sanitation District, DOES HEREBY RESOLVE, DETERMINE AND ORDER: Section 1: That the unused portion of real property located at 1700-2000 West Coast Highway in Newport Beach, specifically Lots 61, 62, 63, 64, and 65, are surplus property and are in excess of OCSD's foreseeable needs. Section 2: That the sale or lease of the surplus real property at 1700-2000 West Coast Highway is exempt from CEQA under CEQA Guideline Section 15312 because the OCSD Property is not located in an area of statewide, regional, or areawide concern identified in Section 15206, subdivision (b)(4) of the CEQA Guidelines. In addition,the recommended action is statutorily exempt from CEQA under Sections 15060 and 15378 of the CEQA Guidelines because the action will not result in a direct or reasonably foreseeable indirect physical change in the environment.
