A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ORANGE
COUNTY SANITATION DISTRICT, MAKING FINDINGS PURSUANT
TO PUBLIC CONTRACT CODE SECTION 3400 IN SUPPORT OF THE
SOLE SOURCE SPECIFICATION OF THICKENING AND
DEWATERING CENTRIFUGES (PROJECT NO. Pl-101, SLUDGE
THICKENING, DEWATERING AND ODOR CONTROL AT PLANT 1)
WHEREAS, the Orange County Sanitation District ("District") is a duly organized
County Sanitation District existing pursuant to the County Sanitation District Act, California
Health and Safety Code section 4700, et seq., providing for the ownership, operation, and
maintenance of wastewater collection, treatment, and disposal facilities within Orange County,
California;
WHEREAS, Public Contract Code § 3400 allows local agencies to draft bid
specifications for public works that call for a designated product if the awarding authority, or its
designee, finds that the product is designated "in order to obtain a necessary item that is only
available from one source ... ";
WHEREAS, Public Contract Code § 3400 establishes that an item is available from only
one source if there is not an "equal" product, meaning a product that will "function as well, in all
essential respects" as the designated product;
WHEREAS, by necessary implication, if only two sources are available for a product,
those two products may be specified to the exclusion of others;
WHEREAS, sludge thickening, dewatering and odor control at Plant 1, Job No. Pl-101,
must be designed around centrifuges selected by the Sanitation District;
WHEREAS, HDR Engineering, Inc. is preparing the plans and specifications for the
project, for which the construction contract is scheduled to be awarded in December 2011;
WHEREAS, based on extensive investigation, Sanitation District staff has determined
that GEA Westfalia Separator, Inc. (Westfalia) manufactures the only centrifuge meeting the
Sanitation District's needs for co-thickening sludge, and Westfalia and Alfa Laval, Inc. (Alfa
Laval) are the only manufacturers of centrifuges meeting the Sanitation District's needs for
dewatering sludge.
NOW, THEREFORE, the Board of Directors of the District DOES HEREBY
RESOLVE, DETERMINE AND ORDER:
Section 1. All of the recitals herein contained are true and correct and the Board of
Directors of the District so finds.

Section 2. GEA Westfalia Separator, Inc. manufactures the only centrifuge meeting
the Sanitation District's needs for co-thickening sludge.
Section 3. GEA Westfalia Separator, Inc. and Alfa Laval, Inc. are the only
manufacturers of centrifuges meeting the Sanitation District's needs for dewatering sludge.
Section 4. A thickening centrifuge from GEA Westfalia Separator, Inc. meeting the
Sanitation District's needs for co-thickening sludge shall be specified by name in the bid
solicitation for Project No. Pl-101, Sludge Thickening, Dewatering and Odor Control at Plant 1.
Section 5. Dewatering Centrifuges from GEA Westfalia Separator, Inc. and Alfa
Laval, Inc. meeting the Sanitation District's needs for dewatering sludge shall be specified by
name in the bid solicitation for Project No. Pl-101, Sludge Thickening, Dewatering and Odor
Control at Plant 1.
Section 6. This Resolution shall take effect immediately upon its adoption.
