HomeMy WebLinkAboutOCSD 00-19RESOLUTION NO.OCSD 00-19 CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT/ENVIRONMENTAL IMPACT STATEMENT FOR THE RELOCATION AND/OR PROTECTION OF THE SANTA ANA RIVER INTERCEPTOR PROJECT A RESOLUTION OF THE BOARD OF DIRECTORS OF THE ORANGE COUNTY SANITATION DISTRICT CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT!ENVIRONMENTAL IMPACT STATEMENT FOR THE RELOCATION AND/OR PROECTECTION OF THE SANTA ANA RIVER INTERCEPTOR JULY 19,2000 WHEREAS,the Board of Directors of the Orange County Sanitation District (OCSD),hereinafter referred to as “District”,is presently considering the approval of an Environmental Impact Report/Environmental Impact Statement,described as the Relocation and/or Protection of the Santa Ana River Interceptor,hereinafter referred to as “Relocation and/or Protection of the SARI”;and, WHEREAS,District is the lead agency for the preparation and consideration of environmental documents for the Relocation and/or Protection of the SARI,pursuant to the California Environmental Quality Act of 1970,as amended,(“CEQA”),the State of California CEQA Guidelines and District CEQA procedures;and, WHEREAS,to assess the Relocation and/or Protection of the SARI’s environmental impacts objectively,the District has caused to be prepared a Draft Environmental Impact Report/Environmental Impact Statement (EIR/EIS)to assess the significant environmental impacts,mitigation measures,and alternatives associated with the Relocation and/or Protection of the SARI;and, WHEREAS,the District has consulted with other public agencies and the general public,giving them an opportunity to comment on the Draft EIR/EIS as required by CEQA;and, WHEREAS,on May 24,2000,the District held a duly-noticed public hearing,to provide a further opportunity for the general public to comment on and respond to the Draft EIR/EIS;and, WHEREAS,the District has objectively evaluated the comments from public agencies and persons who reviewed the Draft EIR/EIS;and, WHEREAS,the comments and recommendations received on the Draft EIR/EIS, either in full or in summary,in response to significant environmental concerns raised in the review and consultation process,have been included in the Final EIR/EIS;and, 1 WHEREAS,said Final EIR/EIS consisting of the Draft EIR/EIS and the Supplement,which includes changes to the Draft EIR/EIS in response to comments, which have been presented to the members of the District’s Board of Directors for review and consideration prior to the final approval of,and commitment to,the Relocation and/or Protection of the SARI. NOW,THEREFORE,the Board of Directors of Orange County Sanitation District, DOES HEREBY RESOLVE,DETERMINE AND ORDER: That the Board of Directors hereby certifies that the Final EIR/EIS on the Relocation and/or Protection of the SARI has been completed in compliance with CEQA, the State CEQA Guidelines,and District’s CEQA procedures,and that the Board of Directors has reviewed and considered the information contained in the Final EIR/EIS prior to approval of,or commitment to,the Relocation and/or Protection of the SARI,and that the Final EIR/EIS,consisting of the Draft EIR/EIS,and the Supplement,reflects the District’s independent judgment and analysis;and That the contents of the administrative record are incorporated by reference and made part of the record supporting these findings and the actions taken by the District in certifying the Final EIR/EIS and approving the project: 1.The Final EIR/EIS and all documents relied upon or incorporated by reference in the Final EIR/EIS. 2.All testimony,documentary evidence,and all correspondence submitted to or delivered to the District in connection with the meetings and public hearings at which the Draft EIRIEIS or Final EIR/EIS,was considered by the District. 3.All staff reports,memoranda,maps,slides;letters,minutes of meetings,and other documents relied upon or prepared by District staff and consultants relating to the project. 4.Any other documents specified by Public Resources Code section 21167.6(e).
