Home My WebLink AboutOCSD 98-48RESOLUTION NO.OCSD 98-48 ORDERING ANNEXATION OF TERRITORY TO ORANGE COUNTY SANITATION DISTRICT (NO.OCSD-2 —PORTION OF TRACT NO.14185 ANNEXATION A RESOLUTION OF THE BOARD OF DIRECTORS OF ORANGE COUNTY SANITATION DISTRICT,ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT (ANNEXATION NO.OCSD-2 — PORTION OF TRACT NO.14185 ANNEXATION) The Board of Directors of Orange County Sanitation District, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That a request has heretofore been made to Orange County Sanitation District for annexation of territory to the District by means of a petition filed by the property owner,Boulevard Development;and, Section 2 That the designation assigned by the District to the territory proposed to be annexed is “Annexation No.OCSD-2 —Portion of Tract No.14185 Annexation to Orange County Sanitation District “,the exterior boundaries of which are described on Exhibit “A”and shown on Exhibit “B”attached hereto and by reference made a part of this resolution;and, Section 3 That pursuant to the Cortese-Knox Local Government Reorganization Act of 1985,Division 3,commencing with Section 56000 of the California Government Code,application has heretofore been made by Orange County Sanitation District to the Orange County Local Agency Formation Commission for annexation of said territory to Orange County Sanitation District,by means of Resolution No.97-34-2,filed with said Commission by District;and, Section 4 That the Orange County Local Agency Formation Commission adopted its Resolution No.96-17 on September 2,1998,making determinations and approving proposed Annexation No.OCSD 98-2 —Portion of Tract No.14185 Annexation to Orange County Sanitation District,without notice or hearing and without election;and, Section 5 That the territory hereinbefore referred to is uninhabited;and, Section 6 That the reason for annexing said territory is to obtain and provide public sanitary sewer service to said territory;and, Section 7 That payment of annexation acreage fees in the amount of $28,156.20 has been made and all terms and conditions specified by the Orange County Local Agency Formation Commission have been satisfied;and, Section 8 That the District has agreed,pursuant to Section 99(h)(1)of the Revenue and Taxation Code,to waive its ad valorem property tax allocation exchange with other affected taxing agencies;and, Section 9 That the regular County assessment roll is utilized by the District; and, Section 10 That the affected territory will be taxed for the existing bonded indebtedness of the District;and, Section 11 That,as authorized by resolution of the Orange County Local Agency Formation Commission pursuant to the Cortese-Knox Local Government Reorganization Act of 1985,Division 3,Section 56837 of the California Government Code,the territory hereinbefore referred to and described hereinabove,be,and is hereby,ordered annexed to Orange County Sanitation District without notice or hearing and without election;and, Section 12 That the Secretary of Orange County Sanitation District shall transmit a certified copy of this resolution,with applicable fees required by Section 54902.5 of the Government Code,to the Executive Officer of the Orange County Local Agency Formation Commission.
