HomeMy WebLinkAboutResolution 97-11-2RESOLUTION NO.97-11-2 APPROVING REIMBURSEMENT AGREEMENT WITH ORANGE COUNTY FLOOD CONTROL DISTRICT RE 51-INCH SEWER IN THE SANTA ANA RIVER REACH 8 A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2 OF ORANGE COUNTY, CALIFORNIA APPROVING REIMBURSEMENT AGREEMENT WITH THE ORANGE COUNTY FLOOD CONTROL DISTRICT FOR CONSTRUCTION AND ADMINISTRATION COSTS IN CONNECTION WITH DISTRICT’S 51-INCH SEWER IN THE SANTA ANA RIVER REACH 8 ************* WHEREAS,in 1986,the United States Congress passed the Water Resources Development Act;and, WHEREAS,a portion of that legislation provided authorization for what became known as the Santa Ana River Mainstream Project;and, WHEREAS,on December 14,1989,the County of San Bernardino,the Orange County Flood Control District,and the U.S.Army Corps of Engineers entered into a 3- party agreement relating to the construction,utility and other related infrastructure improvements associated with the Mainstream Project;and, WHEREAS,pursuant to said Local Cooperation Agreement,the Orange County Flood Control District (“OCFCD”)provides protection to District’s sewer facilities in the Santa Ana River below Weir Canyon in Reach 8;and, WHEREAS,it is estimated that the total cost for the protection of District’s sewer should not exceed $45,000.00,plus 10%of actual construction costs relating to administration and inspection;and, WHEREAS,OCFCD requires District to provide a deposit for construction of the protection of District’s sewers in the amount of $35,000.00;and, WHEREAS,the total estimated cost of reimbursement by District to OCFCD will not exceed $50,000.00. NOW,THEREFORE,the Board of Directors of County Sanitation District No.2 of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That that certain Reimbursement Agreement by and between County Sanitation District No.2 of Orange County,California and the Orange County Flood Control District relating to the administration,inspection and associated construction costs to protect District’s 51-inch sewer in the Santa Ana River Reach 8 is hereby approved. Section 2 That District shall provide a deposit in the amount of $35,000.00 to the Orange County Flood Control District,to be applied towards the cost of construction and administration of the project. Section 3 That the total estimated cost of reimbursement by District to OCFCD will not exceed the sum of $50,000.00. Section 4 That the Chair and Secretary of the District are hereby authorized and directed to execute said Agreement in a form approved by the General Counsel.
