APPROVING REIMBURSEMENT AGREEMENT WITH ORANGE
COUNTY FLOOD CONTROL DISTRICT RE MILLER-HOLDER
TRUNK SEWER.CONTRACT 3-4B
A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO.3 OF ORANGE COUNTY,
CALIFORNIA APPROVING REIMBURSEMENT AGREEMENT
WITH ORANGE COUNTY FLOOD CONTROL DISTRICT FOR
CONSTRUCTION AND ADMINISTRATION COSTS IN
CONNECTION WITH REBUILDING A PORTION OF THE MILLER-
HOLDER TRUNK SEWER,CONTRACT 3-4B

WHEREAS,the Orange County Flood Control District (OCFCD)proposes to
improve its existing Brea Creek Channel in the City of Buena Park at Kingman Avenue,
just north of Franklin Street,which consists of the construction of a reinforced-concrete
open channel and a transition structure with several bridge crossings,known as the
Project;and,
WHEREAS,District owns,operates and maintains a 27-inch sewer line and a
30-inch sewer line crossing under the channel at Kingman Avenue;and,
WHEREAS,the 27-inch sewer line is in conflict with the proposed Project,and
relocation is necessary;and,
WHEREAS,OCFCD has indicated that they will perform the construction
relating to this relocation;and,
WHEREAS,as a result of rights acquired by OCFCD which are paramount to
District’s rights by virtue of a deed recorded on January 17,1935,all construction
costs,including administration costs relating thereto,pertaining to said relocation of
District’s 27-inch sewer line will be paid directly by District to OCFCD;and,
WHEREAS,it is estimated that the total cost of construction to rebuild a portion
of the Miller-Holder Trunk Sewer,Contract No.3-4B,on behalf of District No.3,
together with all administration costs to OCFCD,will be approximately $100,000.00.
NOW,THEREFORE,the Board of Directors of County Sanitation District No.3
of Orange County,California,
DOES HEREBY RESOLVE,DETERMINE AND ORDER:
Section 1 That that certain Reimbursement Agreement by and between
County Sanitation District No.3 of Orange County,California and the Orange County
Flood Control District,providing for the cost of construction and administration of
District’s portion of OCFCD’s Brea Creek Channel construction contract,is hereby
approved and accepted.
Section 2 That District No.3 shall deposit $100,000.00 with OCFCD as the
estimated cost for modification of the channel,construction of the improvements and
relocation of District’s 27-inch sewer,within sixty (60)days of execution of said
Reimbursement Agreement.
Section 3 That the Chairman and Secretary of District are hereby authorized
and directed to execute said Agreement in a form approved by the General Counsel.
