HomeMy WebLinkAboutResolution 95-029RESOLUTION NO.95-29 TRANSFERRING THE DISTRICTS’AUDITOR AND CONTROLLER FUNCTIONS FROM THE ORANGE COUNTY AUDITOR/CONTROLLER TO THE DISTRICTS A JOINT RESOLUTION OF THE BOARDS OF DIRECTORS OF COUNTY SANITATION DISTRICTS NOS.1,2,3,5,6, 7,11,13 AND 14 OF ORANGE COUNTY,CALIFORNIA, TRANSFERRING THE DISTRICTS’AUDITOR AND CONTROLLER FUNCTIONS FROM THE ORANGE COUNTY AUDITOR/CONTROLLER TO THE DISTRICTS WHEREAS,the County Sanitation District Act (Health &Safety Code Section 4732)provides that the county auditor of the county in which the district is formed is ex officio the auditor of the district;and, WHEREAS,Government Code Section 26990 provides that,“notwithstanding any other provision of law,the duties and responsibilities previously conferred on the auditor,controller or director of finance of any county to any independent local agency other than the county,may be eliminated or modified if the independent local agency agrees to and is able to assume those duties and responsibilities,and the auditor, controller or director of finance concurs in writing to transfer those duties and responsibilities to the independent local agency.”;and, WHEREAS,the Districts have utilized the services of the Orange County Auditor/Controller for approximately 40 years,which services have been rendered in an exemplary manner;and, WHEREAS,the Boards of Directors have approved of a program calling for the total reorganization of the financial duties and functions relating to the Districts’business 1 operations,including the appointment of their own Treasurer;and, WHEREAS,the Orange County Auditor/Controller’s Office has only provided controller functions and no auditor functions over the years;and, WHEREAS,the Districts have employed a professional staff capable of assuming all duties and responsibilities relating to the controller and accounting functions of the Districts;and, WHEREAS,the Districts desire to transfer all existing duties and responsibilities performed by the County Auditor/Controller to their own Staff and to independent auditors. NOW,THEREFORE,the Boards of Directors of County Sanitation Districts Nos. 1,2,3,5,6,7,11,13 and 14 of Orange County,California, DO HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That pursuant to Government Code Section 26990,the Districts agree to assume all duties and responsibilities presently performed by the Orange County Auditor/Controller and request that the Auditor/Controller concur to the transfer of those duties and responsibilities to the independent agency,effective immediately.
