HomeMy WebLinkAboutResolution 95-011RESOLUTION NO.95-11 CERTIFYING FINAL SUPPLEMENT NO.3 TO PROGRAM EIR FOR COLLECTION.TREATMENT AND DISPOSAL FACILITIES MASTER PLAN -1989 RE OCEAN OUTFALL RELIABILITY UPGRADES.JOB NO.J-34-1 (THE “PROJECT’):MAKING CERTAIN FINDINGS RELATING TO SIGNIFICANT ENVIRONMENTAL EFFECTS IDENTIFIED IN SUPPLEMENT NO.3 TO PROGRAM EIR:ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS:ADOPTING MITIGATION MEASURES AND MONITORING PLAN:AND AUTHORIZING THE FILING OF A NOTICE OF DETERMINATION AND COMPLETION RE SAID PROJECT A JOINT RESOLUTION OF THE BOARDS OF DIRECTORS OF COUNTY SANITATION DISTRICTS NOS.1,2,3,5,6,7,11,13, AND 14 OF ORANGE COUNTY,CALIFORNIA,CERTIFYING FINAL SUPPLEMENT NO.3 TO PROGRAM ENVIRONMENTAL IMPACT REPORT FOR THE COLLECTION,TREATMENT AND DISPOSAL FACILITIES MASTER PLAN -1989 RE OCEAN OUTFALL RELIABILITY UPGRADES,JOB NO.J-34-1 (THE “PROJECT’);MAKING CERTAIN FINDINGS RELATING TO SIGNIFICANT ENVIRONMENTAL EFFECTS IDENTIFIED IN SUPPLEMENT NO.3 TO PROGRAM EIR;ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS;ADOPTING MITIGATION MEASURES AND MONITORING PLAN;AND AUTHORIZING THE FILING OF A NOTICE OF DETERMINATION RE SAID PROJECT WHEREAS,the Boards of Directors of County Sanitation Districts of Orange County, California (“Districts”),certified the Final Program Environmental Impact Report for Collection, Treatment and Disposal Facilities Master Plan (“EIR”)in July 1989;and, WHEREAS,the Districts are the Lead Agency for the preparation and consideration of environmental documents for the projects contained with the 1989 Collection,Treatment and Disposal Facilities Master Plan,pursuant to the California Environmental Quality Act of 1970,as amended,(“CEQA”),the State of California CEQA guidelines and the Districts’CEQA procedures;and WHEREAS,the Districts are presently considering the approval of Project,described as the Ocean Outfall Reliability Upgrades,Job No.J-34-1 (“Project”);and, WHEREAS,Districts have determined additional environmental studies are required before proceeding with the Project,described as Supplement No.3 (“Supplement”);and, WHEREAS,to assess the Project’s environmental impacts objectively,the Districts have caused to have prepared a Draft Supplement No.3 to Program Environmental Impact Report for Amendment No.1 to the Collection,Treatment and Disposal Facilities Master Plan (“Draft”)to assess the significant environmental impacts,mitigation measures,and alternatives associated with the Project;and, WHEREAS,the Districts have consulted with other public agencies and the general public,giving them an opportunity to comment on the Draft as required by CEQA;and, WHEREAS,on December 14,1994,the Boards of Directors of the Districts held a duly-noticed public hearing to provide a further opportunity for the general public to comment on and respond to the Draft;and, WHEREAS,the Districts have objectively evaluated the comments from public agencies and persons who reviewed the Draft;and, WHEREAS,the Districts have objectively evaluated the comments from public agencies and persons who reviewed the Draft;and, WHEREAS,the comments and recommendations received on the Draft,either in full or in summary,together with the Districts’responses to significant environmental concerns raised in the review and consultation process,have been included in the Final Supplement No.3 to Program Environmental Impact Report;and, WHEREAS,said Supplement has been presented to the members of the Boards of Directors of the Districts for review and consideration prior to the final approval of,and commitment to,the Project. NOW,THEREFORE,the Boards of Directors of County Sanitation Districts of Orange County,California, DO HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That the Boards of Directors do hereby certify that the Final Supplement No.3 to EIR has been completed in compliance with CEQA,the State CEQA guidelines,and the Districts’CEQA procedures,and that the Boards of Directors have reviewed and considered the information contained in the Final Supplement No.3 prior to approval of,or commitment to,the Project.The Final Supplement No.3 consists of the following two documents: A.“Draft Supplement No.3 to Program Environmental Impact Report on Collection, Treatment and Disposal Facilities Master Plan addressing Ocean Outfall Reliability Upgrades, Project J-34-1,dated October 1994;and, B.“Final Supplement No.3 to Program Environmental Impact Report on Collection, Treatment and Disposal Facilities Master Plan addressing Ocean Outfall Reliability Upgrades, Project J-34-1,dated February 1995. Section 2 That the Draft Supplement No.3 and the Final Supplement No.3 to the Program EIR have fully and adequately addressed all expressed environmental concerns resulting from the proposed construction of the Project. Section 3 That the proposed Project will create a number of significant,or potentially significant,environmental effects.These impacts are identified in Table A of the Draft Supplement No.3 to Final Program EIR that are appended to this Resolution as Attachment A. Section 4 That the Boards of Directors of DISTRICTS do further find that changes or alterations have been required in,or incorporated into,the proposed Project which avoid,or substantially lessen,significant environmental effects as identified in the Final Supplement No.3 to Final Program EIR. Section 5 Significant,or potentially significant,impacts identified in the Final Supplement No.3 to Final Program EIR will be mitigated to less-than-significant levels by the DISTRICTS as specified in Attachment A to this Resolution. Section 6 The DISTRICTS will implement mitigation measures for impacts identified as less than significant in the Final Supplement No.3 as specified in Attachment A to this Resolution. Section 7 The DISTRICTS hereby adopt the following monitoring and reporting program to ensure implementation of the mitigation measures described in Sections 5 and 6. A.The Director of Engineering shall be the Environmental Monitor responsible for coordinating mitigation monitoring and reporting activities. B.The Environmental shall review the design of the Project and certify that the facility design complies with Final Supplement No.3,or recommend design modifications necessary to achieve such compliance.In addition,prior to the DISTRICTS obtaining bids for construction,the Environmental Monitor shall review the bid documents and certify compliance with applicable mitigation measures. C.The Director of Engineering shall assign staff responsibilities to certify compliance with mitigation measures during and after construction of the Project. Section 8 The Boards of Directors of County Sanitation Districts of Orange County, California,have balanced the benefits of the Project against its unavoidable environmental risks in determining whether to approve the Project. Section 9 The Project described in Final Supplement No.3 is the preferred alternative and is hereby approved. Section 10 That the Board Secretary is authorized and directed to file the Notices of Determination and Completion and any other documents in accordance with the requirements of CEQA and the DISTRICTS’CEQA procedures. Project area Is seismically sensitive.Severe ground shaking and unstable soil conditions could result In pipeline rupture or surge tower upIift~ng or flqulfactlon with resulting discharge of treated effluent underground or along ground surface and possibly Into the Santa Ma River (See Section 5.1.2.) . Construction would involve the excavation of some 5900 cubic yard soil to allow the Installation of pipelines and valves and the foundation for the new surge tower and demolition of the old facilities being replaced. Some 471 cubic yards of concrete rubble will be generated by demolition of old pipes and the existing surge tower being replaced.Some 2268 cubIc yards of new concrete will be required for construction. Local topography would be temporarily altered due to stockpiling of soils.Disturbed areas would be subject to wind erosion and potential water erosion during the construction period expected to last about 4-5 months. PS • Adherence to recommendations of geotechnical engineering consultants will minimize potential damage to sewer facilities during a seismic event. (See Section 5.1.3.) A geotechnical study completed by Converse Consultants Orange County for the Districts contained recommendations which were used by the project design engineers in the design of the proposed facilities.These recommendations addressed a number of potential impacts Including seismic safety,liquefaction,settling,groundwater uplifting that could float structures and the need for supporting piles for the surge tower. ~ Excavation work will be done to assure safety and performed In the manner set forth in the operation rules,orders,and regulations prescribed by the CAL/OSHA Construction Safety Orders through the specifications that must be followed by the contractor.Contractor will be required to obtain needed permits. NS . • Hydrology! Water Quality During the construction period,there are no anticipated times that effluent disposal operations will be Impaired. This is critical since the Dlstrlct~s NPDES permit prohibits bypassing of the ocean outfall or allowing wastewater to overflow into the Santa Ma River. Open trenches may be subject to groundwater infiltration, which will need to be discharged properly. PS Scheduling sewer construction during dry months. Groundwater will be pumped and discharged pursuant to the Districts’NPDES permit.(See Section 5.3.2.) NS . It Is estimated that as many as 250-880 truck trips may be required to complete the Job requirements.The calculated emissions will be minor on a regional scale and not cause any significant local air pollution but will contribute to the ~evera~regional ajr pollution problems. in this particular case,the emissions from construction workers will be relatively minor since it is estimated that the full-time workforce will only average about 25 workers for the year.This project would represent about lIl3th of the impacts previously reported for the average on-going emissions associated with construction workers In the 1989 Master Plan. PS • Dutsuppression by watering.(See Section 5.7.3.) ~ Gaseous pollutant emissions from vehicles can be reduced by the use of well-tuned and properly maintained equipment. . Stockpiles of soil on site should be wetted as needed to control dust.An alternative for semipermanent storage is the use of dust suppressant materials sprayed on the piles. . : NS . 0 Aesthetics . , Loss of vegetation In a few areas along with exposed soil from excavation.Visual Impacts from machi nery trenching,and dirt piles during construction as seen from Santa Ana River Recreation Trail. The only long-term visual impact will be associated with the relocation of one surge tower and height increase of the existing Surge Tower No.1.These height Increases are not expected to create any significant adverse impacts that are significantly different than the visual environment which presently exists. PS ~ ~ Landscaping will be done after construction Is completed to re-establish landscaped areas Impacted by construction.The work will be dor~e as part of the Districts’long-term Landscaping and Security Master Plan.
