HomeMy WebLinkAboutResolution 1991 - 0076RESOLUTION NO.91-76-2 ORDERING ANNEXATION OF TERRITORY TO COUNTY SANITATION DISTRICT NO.2 (ANNEXATION NO.72 - TRIDER ANNEXATION) A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2 OF ORANGE COUNTY, CALIFORNIA,ORDERING ANNEXATION OF TERRITORY .10 THE DISTRICT (ANNEXATION NO.72 -TRIDER ANNEXATION TO COUNTY SANITATION DISTRICT NO.2) The Board of Directors of County Sanitation District No.2 of Orange County, California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That a request has heretofore been made to County Sanitation District No.2 for annexation of territory to the District by means of a petition filed by Trider Corporation,the property owners;and, Section 2 That the designation assigned by the District to the territory proposed to be annexed is “Annexation No.72 —Trider Annexation to County Sanitation District No.2”,the exterior boundaries of which are described on Exhibit “A”and shown on Exhibit “B”attached hereto and by reference made a part of this resolution;and, Section 3 That pursuant to the Cortese—Knox Local Government Reorganization Act of 1985,Division 3,comencing with Section 56000 of the California Government Code,application has heretofore been made by District No.2 to the Local Agency Formation Comission for annexation of said territory to County Sanitation District No.2,by means of Resolution No.90—113-2,filed with said Comission by said District;and, Section 4 That the Local Agency Formation Cormiission of the County of Orange adopted its Resolution No.91—2 on March 6,1991,making determinations and approving proposed Annexation No.72 to County Sanitation District No.2 of Orange County,California,without notice or hearing and without election;and, Section 5 That the territory hereinbefore referred to is uninhabited; and, Section 6 That the reason for annexing said territory is to obtain and provide public sanitary sewer service to said territory;and, Section 7 That payment of annexation acreage fees in the amount of $25,537.65 has been made and all terms and conditions specified by the Local Agency Formation Comission have been satisfied;and, Section 8 That the District has agreed,pursuant tO Section 99(h)(1)of the Revenue and Taxation Code,to waive its ad valorem property tax allocation exchange with other affected taxing agencies;and, Section 9 That the regular County assessment roll is utilized by this District;and, Section 10 That the affected territory will be taxed for the existing bonded indebtedness of District No.2;and, Section 11 That,as authorized by resolution of the Local Agency Formation Coninission pursuant to the Cortese-Knox Local Government Reorganization Act of 1985,Division 3,Section 56837 of the California Government Code,the territory hereinbefore referred to and described hereinabove,be,and is hereby,ordered annexed to County Sanitation District No.2 without notice or hearing and without election;and, Section 12 That the Secretary of District No.2 transmit a certified copy of this resolution,with applicable fees required by Section 54902.5 of the Government Code,to the Executive Officer of the Local Agency Formation Coniiiission of Orange County. Sanitation District No.2 as established by “Annexation No.41”to said district, said angle point being the Southwesterly terminus of that certain course described as “South 48°29’43”West,32.90 feet”in said annexation,said angle point also being in 81 the centerline of Santiago Boulevard; Thence following along said existing boundary line per said annexation and said 10 centerline through the following described courses:North 17°15’43”West, 11 199~.O7 feet to the beginning of a tangent curve concave Southwesterly and having a 12 radius of 200.00 feet; Thence continuing along said existing boundary line Northerly and Westerly 14 along said centerline and said curve through a central angle of 42°29’36”an arc 15 distance of 148.38 feet; 16~ I Thence North 30°14’41”East,54.99 feet; 17 Thence North 18°26’57”West,9.60 feet to an angle point in said existing 18 boundary line per said “Annexation No.41”; 19, I Thence continuing along said existing boundary line per the “Formation”of said 20’ district,South 84°39’lB”West,436.61 feet to an angle point in “Annexation No.54” 21’ to said district,said point also being the centerline intersection of said Santiago 22r I Boulevard with Sycamore Street; 23 Thence continuing along said existing boundary line following along said 24’ “Annexation No.54”,South 0O008l27!~West,470.15 feet to a point •in existing 25 boundary line of the City of Villa Park,as established by the “Incorporation”of 271 said city; 281 EXHIBIT A~-) Block 6052 Module 29 EXUTBIT “A~ ‘TRIDER’ANNEXATION NO.72 TO COUNTY SANITATION DISTRICT NO.2 1 Thence leaving said existing boundary line of said district following along 2 said existing boundary line of said city per said.“Incorporation”South 00°08’27” West,54.85 feet; 4 Thence leaving said existing boundary line of said city South 89°51’33”East, 625.00 feet following along the Southerly line of Parcel 1 of a deed recorded in 6 Book 6045,Page 296 of Official Records,in the office of the Recorder of said County of Orange,and its Easterly prolongation to said centerline of Santiago Boulevard; 8 Thence following said centerline North 17°15’43”West,216.79 feet to the point of Beginning. 10 The above described parcel of land contains 6.687 acres,more or less. Attached and made a part of is a map designated as Exhibit “B”.
