HomeMy WebLinkAboutResolution 1989 - 0027RESOLUTION NO.89-27-13 ORDERING ANNEXATION OF TERRITORY TO COUNTY SANITATION DISTRICT NO.13 (ANNEXATION NO.1 - ANAHEIM HILLS/ORANGE HILLS ANNEXATION A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.13 OF ORANGE COUNTY, CALIFORNIA,ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT (ANNEXATION NO.1 -ANAHEIM HILLS! ORANGE HILLS ANNEXATION TO COUNTY SANITATION DISTRICT NO.13) The Board of Directors of County Sanitation District No.13 of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That District No.13,with the consent of the property owners (Baldwin Building Company,Orange Unified School District,Presley of Southern California,Texaco-Anaheim Hills,Roger Williamson,Bonnie Williamson,Paul Williamson and Diane Williamson,and Wood.crest Development Company),has heretofore requested the Local Agency Formation Comission to take the necessary proceedings to annex certain territory to the District in order to eliminate two islands within the District’s sphere of influence;and, Section 2 That the designation assigned by the District to the territory proposed to be annexed Is “Annexation No.1 —Anaheim Hills/Orange Hills Annexation to County Sanitation District No.13”,the exterior boundaries of which are described on Exhibit “A”and shown on Exhibit “B”attached hereto and by reference made a part of this resolution;and, Section 3 That pursuant to the Cortese-Knox Local Government Reorganization Act of 1985,DivisIon 3,comencing with Section 56000 of the California Government Code,application has heretofore been made by District No.13 to the Local Agency Formation Comission for annexation of said territory to County Sanitation District No.13,by means of Resolution No.88—148-13, filed with said Corrinisslon by said District;and, Section 4 That the Local Agency Formation Corrinission of the County of Orange adopted its Resolution No.89—5 on January 25,1989,making determinations and approving proposed Annexation No.1 to County Sanitation District No.13 of Orange County,California,without notice or hearing and without election;and, Section 5 That the territory hereinbefore referred to is uninhabited; and, Section 6 That the reason for annexing said territory is to obtain and provide public sanitary sewer service to said territory;and, Section 7 That payment of annexation acreage fees are hereby waived as District 13 is the proponent of said annexation,and that all terms and conditions specified by the Local Agency Formation Comission have been satisfied;and, Section 8 That the District has agreed,pursuant to Section 99(h)(1)of the Revenue and Taxation Code,to waive its ad valorem property tax allocation exchange with other affected taxing agencies;and, Section 9 That the regular Couny assessment roll is utilized by this District;and, Section 10 That the affected territory will be taxed for the existing bonded Indebtedness of District No.13;and, Section 11 That,as authorized by resolution of the Local Agency Formation Coninission pursuant to the Cortese-Knox Local Government Reorganization Act of 1985,Division 3,Section 56837 of the California Government Code,the territory hereinbefore referred to and described hereinabove,be,and is hereby,ordered annexed to County Sanitation District No.13 without notice or hearing and without election;and, Section 12 That the Secretary of District No.13 transmit a certified copy of this resolution,with applicable fees required by Section 54902.5 of the Government Code,to the Executive Officer of the Local Agency Formation Comisslon of Orange County. EXHIBIT “A” Annexation No.1 2 (Anaheim Bills/Orange Hills Annexation) to 3 County Sanitation.District No.13 Parcel 1 All those certain lands located in the City of Anaheim and in the 6 Unincorporated Territory of the County of Orange,State of California,more 7 particularly described as follows: 8 Beginning at an angle point in the existing boundary line of County Sanitation 9 District No.2 as established by “Annexation No.39 (Anaheim Hills No.59),”said 10 angle point being the Southeasterly terminus of that certain course described as ii “North ll°24’22”West,82.02 feet”in said annexation,said point also being on the 12 Northwesterly boundary of Irvine’s Subdivision recorded in Book 1,Page 88 of Miscellaneous Maps,records of said County; Thence following along said existing boundary line per said annexation,per 15 “Annexation No.12 (Anaheim Hills No.3)”,per “Annexation No.6 (Anaheim Hills 16 No.1)”and per “Annexation No.10 (Anaheim Hills No.2)”through their various 17 courses in a general Northerly,Northeasterly,Northerly,Westerly,Northerly and 18 Northeasterly direction to an angle point in the existing coimnon boundary line of 19 said district with County Sanitation District No.13 as established by the 20 ?ormation (Reorganization No.65)”of said district,said angle point being the 21 Easterly terminus of that certain course described as “North 78030~44”West, ~826.56 feet”in said “Annexation No.10 (Anaheim Hills No.2)”to said District 23 No.2; 24 Thence leaving said existing boundary line of said District No.2 following 25 along the existing boundary line of said District No.13 per said “Formation” through its various courses in a general Northeasterly,Southeasterly and Easterly 27~direction to its intersection with said Northwesterly boundary of said Irvine’s 28 Subdivision; Page 1 of 3 •y’~:--~’-’•’A— EXHIBIT ‘A” Annexation No.1 (Anaheim Hills/Orange Hills Annexation) to 3 County Sanitation District No.13 4 Thence leaving said existing boundary line of said District No.13 following 5 along said Northwesterly line South 35°50’38”West,7,730.50 feet,more or less,to 6 the Point of Beginning. 7 The above described parcel of land contains 203.89 feet,more or less. 8 Parcel 2 9 All those certain lands located in the City of Anaheim,City of Orange and in 10 Unincorporated Territory of the County of Orange,State of California,more 11 particularly described as follows: 12 Beginning at an angle point in the existing boundary line of County Sanitation District No.13 as established by the “Formation (Reorganization No.63)”of said district,said angle point being the Northwesterly terminus of that certain course 15 described as “North 23°38’06”West,539.93 feet”in said formation; 16 Thence following along said existing boundary line of said district per said 17 formation through its various courses in a general Northerly,Northwesterly, 18 Northerly and Northeasterly direction to an angle point in the existing cournon 19 boundary of said district with County Sanitation District No.2 as established by 20 “Annexation No.6 (Anaheim Hills No.1)”to said district,said angle point being 21 I the Easterly terminus of that certain course described as “South 81015100”East, 22 2,150.00 feet”in said annexation; 23 Thence leaving said existing boundary line of said District No.13 following 24 along the existing boundary line of said District No.2 per said annexation and per 25 “Annexation No.59 (Anaheim Hills No.59)”through their various courses in a general Northeasterly,Easterly,Northerly,Northwesterly,Easterly,Southeasterly and Easterly direction to its intersection with the Northwesterly boundary of 28 Irvine’s Subdivision recorded in Book 1,Page 88 of Miscellaneous Maps,records of Page 2 of 3 EXHIBIT A—2 EXHIBIT “A” Annexation No.1 (Anaheim Hills/Orange Hills Annexation) 3 County Sanitation District No.13 4 said County; 5 Thence leaving said existing boundary line of said District No.13 following 6 along said Northwesterly line South 35°50’38”West,2,266.45 feet,more or less to 7 an angle point in the existing boundary line of County Sanitation District No.14 as 8 established by the “Formation”of said district,said angle point being the most 9 Northerly corner as shown on Exhibit “B”of said “Formation”; 10 Thence following along said existing boundary line of said District No.14 and 11 continuing along said Northwesterly boundary of Irvine’s Subdivision 12 South 35°50’38”West,4,455.51 feet,more or less,to the Point of Beginning.
