HomeMy WebLinkAboutResolution 1988 - 0005RESOLUTION NO.88-5 APPROVING AND ADOPTING CEQA GUIDELINES - A JOINT RESOLUTION OF THE BOARDS OF DIRECTORS OF COUNTY SANITATION DISTRICTS NOS.1,2,3,5,6,7,11, 13 AND 14 OF ORANGE COUNTY,CALIFORNIA,APPROVING AND ADOPTING GUIDELINES AND MANUAL OF PRACTICE PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT,AND REPEALING RESOLUTION NO.83-189 WHEREAS,the County Sanitation Districts of Orange County,California,are a public agency whose responsibilities include the management of the collection, treatment,disposal and reclamation of wastewaters in the urbanized areas of Orange County;and, WHEREAS,the County Sanitation Districts of Orange County,California, construct and operate major wastewater treatment works including over 600 miles of trunk stations,pump stations,two major treatment plants and an ocean outfall;and, WHEREAS,protection and maintenance of a high quality environment is a responsibility of the Districts;and, WHEREAS,the California Environmental Quality Act (CEQA)was enacted in 1970 to set forth public policy and to require the state government to regulate activities of private individuals,corporations and public agencies which are found to affect the quality of the environment;and, WHEREAS,CEQA requires governmental agencies at all levels to develop standards and procedures necessary to protect environmental quality;and, WHEREAS,governmental agencies at all levels are required to consider qualitative factors as well as economic and technical factors,and short-term and long—term benefits and costs,and alternatives to proposed acti.ons affecting the environment;and, WHEREAS,CEQA provides that public agencies shall use the environmental impact —1— report and environmental assessment procedures to identify significant effects of a project on the environment,to identify alternatives to a given project,and to indicate a manner in which significant effects can be mitigated or avoided;and, WHEREAS,the State of California periodically publishes revisions to the California Environmental Quality Act and Guidelines for implementation of said Act; and, WHEREAS,the latest Guidelines became effective in March 1986;and, WHEREAS,public agencies are required to adopt or utilize the State Guidelines or local guidelines for fulfilling their responsibilities under the California Environmental Quality Act;and, WHEREAS,the County Sanitation Districts of Orange County,California periodically review and update their CEQA Guidelines;and, WHEREAS,the amount of activity taking place under the provisions of CEQA in recent years has increased;and, WHEREAS,the Districts’staff is required to fulfill the provisions of the California Environmental Quality Act via the preparation of environmental documentation and review of the environmental documentation of other agencies;and, WHEREAS,at the request of the Districts,the firm of K.P.Lindstrom,Inc.has recently prepared a new set of guidelines implementing the provisions of the California Environmental Quality Act tailored specifically to the Districts’needs and requirements;and, WHEREAS,K.P.Lindstrom,Inc.has prepared a step-by—step procedures manual for use by Districts’staff in implementing the provisions of the California Environmental Quality Act and the Districts’Guidelines,and for completing the necessary documentation;and, WHEREAS,the preparation of the County Sanitation Districts of Orange County -2— CEQA Compliance Guidelines and the CEQA Procedures Manual have been reviewed by the Boards of Directors;and, WHEREAS,these two documents are deemed to be complete. NOW,THEREFORE,the Boards of Directors of County Sanitation Districts Nos.1, 2,3,5,6,7,11,13 and 14 of Orange County,California, DO HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That the Boards of Directors Implementation of the California Environmental use by staff,consultants and other interested activities in fulfilling the provisions of the and, do hereby adopt the Guidelines for Quality Act and Manual of Practice for parties in guiding the Districts’ California Environmental Quality Act; Section 2 That the Districts will maintain and update these Guidelines on a periodic basis,as needed,to be consistent with California State CEQA Guidelines; and, Section 3 That the Districts’staff is hereby authorized and directed to revise the Manual of Practice from time to time,as necessary,to better serve the Districts and the public;and, Section 4 That Resolution No.83-189 is hereby repealed and made of no further effect.
