HomeMy WebLinkAboutResolution 1987 - 0061RESOLUTION NO.87-61-1 NJTHORIZTh7G FtLfl~FOR FEDERAL AND STATE CLEAN WATER GRANTS AND LOANS —1987—88 JOINr W)RKS IMPROVE~4ENTS AND ADDITIONS A RESOLUTION OF THE BOARD OF DIRECIORS OF COUNTY SANITATION DISTRICT NO.1 OF ORA~E COUNTY, CALIFORNIA,I%Ifl~IORIZfl~AND DIRECPI~THE EXE~JTION AND FILI~3 OF DC~JM~IS NECESSARY FOR FEDERAL AND STATE CLEAN WATER GRAt’flS AND LOANS UNDER 33 U.S.C., 1251 F~SEQ.;AND CHAPTERS 12.5,13,14 AND 15;AND DIVISION 7 OF THE CALIFORNIA WATER CODE ON BEHALF OF COUNTY SANITATION DISTRICrS NOS.2,3,5,6,7, II,13 AND 14 OF ORA~E ODUNTY,CALIFORNIA,AND PROVIDI~3 CERTAIN ASSURANCES **************** The Board of Directors of County Sanitation District No.1 of Orange County,Ca1ifornia~ DOES HEREBY RESOLVE,DF~ERNINE AND ORDER THAT: Section 1 An Act of Congress known as the Federal Water Pollution Control Act,as amended (also known as the Clean Water Act and the Water Qiality Act of 1987)(33 U.S.C.,1251 et seq.)provides for federal grants and loans for construction of sewage treatment ~rks. Section 2 The State Clean Water Bond Laws of 1970,1974,1978 and 1984 authorize the State Water Resources Control Board to enter into contracts with public agencies for State grants and loans for construction of sewage treatment s~rks. Section 3 County Sanitation District No.1 of Orange County is a separate and distinct agency organized under Chapter 3,Part 3,Division 5,of the Health and Safety Code of the State of California,for the purpose of constructing,operating and itaintaining a n~jor trunk sewer system for the collection of sewage fran the cities and other local sewering agencies,and has joined with other County Sanitation Districts -namely,County Sanitation Districts Nos.2,3,5,6,7,U,13 and 14,in constructing,operating and maintaining joint sewage treatnEnt plants and disposal facilities under an agreenent dat~July 1,1985,known as the Joint (~nership,Operation and Construction 1~greenent. Section 4 In accordance with the terms of said Joint CX~nership, Operation and Construction 1~reenent,County Sanitation District No.1 of Orange County,California acts for itself and as agent for County Sanitation Districts Nos.2,3,5,6,7,U,13 and 14 of Orange County,California,each organiz~1 for similar purposes and serving different territories,all in Orange County, California,for the purpose of constructing and operating said joint sewage treatnent plants and disposal facilities. Section 5 By neans of this Resolution and of the Resolutions set forth below by number,the following County Sanitation Districts of Orange County, California have authoriz~the filing of applications for grants and loans under said Acts of Congress and said Clean Water Bond Laws and have authorizei County Sanitation District No.1 to file said applications on their behalf: •DISTRICI’NO.RESOLUTION NO 2 87—62—2 3 87—63—3 5 87—64—5 6 87—65—6 7 87—66—7 II 87—67—U 13 87—68—13 14 87—69—14 Section 6 J.Wayne Sylvester,General Manager,is hereby authorized and directed to sign and file for and on behalf of County Sanitation District No.1 of Orange County,California,acting for itself and as agent for County Sanitation Districts Nos.2,3,5,6,7,11,13 and 14 of Orange County, California,Application for a Federal Grant and/or Loan for S~age Treatnent Works under 33 U.S.C.,1251 et seq.,and a State Grant and/or Loan for Clean Water under the Clean Water Bond Laws of 1970,1974,1978 and 1984,for a joint project generally described as follows: 1987—88 Joint Works Ii~rovemants and Mditions Section 7 District No.1,acting for itself and as agent for County Sanitation Districts Nos.2,3,5,6,7,11,13 and 14,hereby agrees and further does authorize the aforenentioned representative to certify that if a federal grant or loan for its project is made pursuant to the Federal Water Pollution Control Act,as airended (33 U.S.C.,1251 et seq.),it will pay the renaming cost of the approved project;it will provide proper and efficient operation and maintenance of the approved project after carpletion of construction thereof;it will c~ply with Title VI of the Civil Rights Act of 1964 (F.L.88—352)and the regulations issued pursuant thereto and state that the assurance and ccii~pliance with such regulations attached to the application for federal grant or loan applies to this project;and it will cai~p1y with requirenents of Executive Order 11246 pertaining to eqi~ial eniployrrent opportunity in federally-assisted construction contracts.
