Home My WebLink AboutResolution 1986 - 0054RESOLUTION NO.86-54-14 ORDERING ORANGE COUNTY DISTRICT REORGANIZATION NO. 79 -REORGANIZ~ION OF COUNTY SANITATION DISTRICTS NOS.13 AND 14 (CONSISTING SOLELY OF DETACHMENTS AND ANNEXATIONS) A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICTS NO.14 OF ORANGE COUNTY, CALIFORNIA,ORDERING ORANGE COUNTY DISTRICT RE ORGANIZATION NO.79 (CONSISTING SOLELY OF DETACH- MENTS AND ANNEXATIONS) The Board of Directors of County Sanitation District No.14 of Orange County,California,does hereby determine that: WHEREAS,the “Proposed Orange County District Reorganization No.79”(consisting of the detachment of certain territories from County Sanitation District No.13 and the annexation of same territories to County Sanitation District No.14)was heretofore approved and an application initiating reorganization proceedings was filed with the Local Agency Formation Commission of Orange County,by Resolution No.86—5 of the Boards of Directors of County Sanitation Districts Nos.13 and 14,and accepted for filing on February 18,1986,by the Executive Officer of the Local Agency Formation Commission of Orange County,California; and WHEREAS,The Local Agency Formation Commission of Orange County,California adopted its Resolution No.86—25 on April 2, 1986,approving Proposed Orange County District Reorganization No.79,and designating the Board of Directors of County Sanita tion District No.14 as the conducting authority whereby County Sanitation District No.14 was directed to initiate reorganiza tion proceedings in accordance with Chapter 1,Part 4,Division 3 of Title 5 of the Government Code,and that any resolution ordering such reorganization provide that reorganization be made subject to the following terms and conditions set forth in the Local Agency Formation Commission’s Resolution No.86—25: A.That none of the changes of organization proposed,be ordered completed unless all changes of organization proposed are ordered and completed. B.That the territory to be detached from County Sanita tion District No.13 be relieved from liability for all or any part of the principal,interest,or any other amounts which may become due on account of all or any part of any bonded indebted ness,contracts or obligations,including,but not by way of limitation,any judgments of said District and that said terri tory shall be relieved from levying or fixing and the collection of any taxes or assessments as may be made for the payment thereof. C.That the territory to be annexed to County Sanitation District No.14 shall be,from the effective date of this Re organization No.79,subject to the liability and payment of principal,interest and any other amounts which shall become due on account of any outstanding or authorized but unissued bonds, or other contracts or obligations of County Sanitation District No.14 and the fixing and collection of taxes,assessments, service charges and rates as necessary for such payment,and that said territory be subject to the jurisdiction of such District and that it have the same rights and duties as if said territory had been a part of such District since the time of its original formation. D.That the effective date of the proposed Reorganization shall be the date the Executive Officer of the Local Agency Formation Commission files a Certificate of Completion with the County Recorder. E.All proper expenses,including,but not limited to the payment for publications for legal notices and payment of the applicable State Board of Equalization filing and processing fee, incurred in conducting and completing proceedings for this Re organization shall be paid by County Sanitation Districts of Orange County,California;and WHEREAS,after due notice as provided by law,a public hearing was held this date by this Board on the Proposed Orange County District Reorganization No.79,a description of which is attached hereto as Exhibit “A”;and WHEREAS,all persons wishing to protest,object or be heard, were given an opportunity to do so;and WHEREAS,said hearing was closed. NOW,THEREFORE,BE IT RESOLVED by the Board of Directors of County Sanitation District No.14 of Orange County,California as follows: Section 1 The boundaries of the territory proposed to be reorganized are specifically described in the legal description attached hereto and by this reference made a part hereof. Section...2:That protests filed and not withdrawn consti tute less than twenty—five percent (25%)of the registered voters residing within the affected territory and less than twenty—five percent (25%)of the number of owners of land owning less than twenty—five percent (25%)of the assessed value of land within the affected territory. Section 3 That Orange County District Reorganization No. 79 is hereby ordered without election. Section 4 That the Clerk of this Board is hereby directed to submit a certified copy of this Resolution with the applicable fees required by Section 54902.5 of the Government Code to the Executive Officer of the Local Agency Formation Commission of Orange County,California.
