Home My WebLink AboutResolution 1984 - 0178-24 RESOLUTION NO.84-178-2 ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT (ANNEXATION NO.41 -TRACT NO.9713) A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2 OF ORANGE COUNTY, CALIFORNIA,ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT (ANNEXATION NO.41 -TRACT NO.9713 TO COUNTY SANITATION DISTRICT NO.2) ***************** WHEREAS,the Board of Directors of County Sanitation District No.2,on July 9,1980,adopted Resolution No.80—123—2,authorizing initiation of proceedings to annex Tract No.9713 to the District;and, WHEREAS,the Board of Directors of County Sanitation District No.2,on September 12,1984,adopted Resolution No.84—162—2,fixing the time,date and place of hearing regarding Annexation No.41 —Tract No.9713,providing for notice thereof and establishing procedures for filing of written protest;and, WHEREAS,after due notice provided by law,a public hearing was held on October 10,1984,by this Board of Directors on proposed Annexation No.41 —Tract No.9713. NOW,THEREFORE,the Board of Directors of County Sanitation District No.2 of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That application has heretofore been made to County Sanitation District No.2 for annexation of territory to the District by means of a petition filed by the former property owner,David J.Sabag;and, Section 2 That pursuant to Division 1 (District Reorganization Act of 1965) of Title 6 of the Government Code of the State of California,application has heretofore been made to the Local Agency Formation Commission for annexation of said territory to County Sanitation District No.2 by the former owner,David J.Sabag, the owner of said property to be annexed,by means of Resolution No.8—123—2,filed with said Commission by the District,which said Commission has approved said annexation by adoption of its Resolution No.84—44;and, Section 3 That the designation assigned by said Commission to the territory proposed to be annexed is “Annexation No.41 —Tract No.9713 to County Sanitation District No.2”,the exterior boundaries of which are described on Exhibit “A”and shown on Exhibit “B”attached hereto and by reference made a part of this resolution;and, Section 4 That the territory hereinbefore referred to is uninhabited;and, Section 5 That the reason for annexing said territory is to obtain and provide public sanitary sewer service to said territory;and, Section 6 That provision for payment of annexation acreage fees in the amount of $3,196.45 has been satisfied;and, Section 7 That pursuant to public hearing on October 10,1984,on said Annexation No.41 —Tract No.9713,during which no protests were filed,either written or oral,the Board of Directors hereby finds that protests filed represent less than 25 percent of the number of landowners within such territory owning not more than 25 percent of the assessed value of land therein;and less than 25 percent of the voting power of voters entitled to vote as a result of residing in or owning property within such territory;and, Section 8 That the District hereby agrees,pursuant to Section 99(h)(1)of the Revenue and Taxation Code,to waive its ad valorem property tax allocation exchange with other affected taxing agencies;and Section 9 That,as authorized by resolution of the Local Agency Formation Commission and pursuant to Division 1 (District Reorganization Act of 1965)of Title 6 of the Government Code,Section 56320 and 56322,inclusive,the territory hereinbefore referred to and described above,be,and it is hereby,ordered annexed to County Sanitation District No.2.
