Home My WebLink AboutResolution 1984 - 0162RESOLUTION NO.84-162-2 FIXING HEARING RE PROPOSED ANNEXATION NO.41 -TRACT NO.9713 TO COUNTY SANITATION DISTRICT NO.2 A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2 OF ORANGE COUNTY,CALIFORNIA,FIXING THE DATE,TIME AND PLACE OF HEARING ON PROPOSED ANNEXATION NO.41 -TRACT NO.9713 TO COUNTY SANITATION DISTRICT NO.2 ************ Whereas,pursuant to the request of David J.Sabag,the former owner of the territory within proposed Annexation No.41 —Tract No.9713,the Board of Directors on July 9,1980,adopted Resolution No.80—123—2 authorizing initiation of proceedings re said Annexation No.41;and, Whereas,prior to completion of annexation proceedings,the property was sold to nine (9)new landowners;and, Whereas,.the written consent of 100%of the current property owners relative to the annexation of this territory to the District has not been received.Accordingly,the Local Agency Formation Commission has conducted a public hearing in conjunction with their approval of said annexation;and, Whereas,the’Local Agency Formation Commission adopted Resolution No.84—44 on June 6,1984,designating County Sanitation District No.2 as the conducting district with regard to Annexation No.41 and directing that the District hold a public hearing prior to final ordering of said territory to the District. NOW,THEREFORE,the Board of Directors of County Sanitation District No.2 of Orange County,Californa, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That the short—form designation assigned to the territory proposed to be annexed is “Annexation No.41 —Tract No.9713 to County 4 Sanitation District No.2”,the boundaries of which are more particularly described and delineated on Exhibits “A”and “B”attached hereto and by reference made a part of this resolution;and, Section 2 That the territory to be annexed is uninhabited;and, Section 3 That the reason for annexing said territory is to obtain and provide public sanitary sewer service to said territory;and, Section 4 That payment was received from the original property owner of all fees in effect at that time;and, Section 5 That the property owners in said territory to be annexed shall assume their proportionate share of the existing bonded indebtedness of County Sanitation District No.2 as shown on the books of account of said District,to be levied as part of the tax on the property to be annexed,or other means of collectionas may be established from time to time by the Board of Directors; and, Section 6 That the property owners in said territory to be annexed ~shall assume their proportionate share of annual operating and capital costs of County Sanitation District No.2,levied in accordance with applicable law as an ad valorem tax or other means of collection as may be established from time to time by the Board of Directors;and, Section 7 That Wednesday,October 10,1984,at 7:30 p.m.is hereby fixed as the date and time of hearing on said proposed annexation,which said hearing shall be conducted in the Board Room of the Administration Building of the County Sanitation Districts of Orange County at 10844 Ellis Avenue,Fountain Valley,California;and, Section 8 That any interested persons desiring to make written protest against said proposed annexation shall do so by written communication filed with the Secretary of County Sanitation District No.2 no later than the date and 4 time hereinabove fixed.Any written protest by a landowner shall contain a description sufficient to identify the land owned by him;any written protest by a voter shall contain the residential address of such voter. EXHI8LT A ANNEXATtON NO.41 •~NEXATION OF A PORTION OF TRACT NO.9713 dod A ?ORTION OF SANTIAGO BLVD.TO COUNTY SANITATION DISTRICT NO.2 All that certain porcton of land located in the Unincorporated Territory and in 2!the City of Orange,being a portion of Re~rded Tract No.9713 filed in book 434, 3,page 35 to 37 mci.of Miscellaneous Maps to the Office of the County Recorder of the County of Orange,State of California;more particularly described as follows: Beginning at a point to the existing boundary Line of the County Sanitation 61 District No.2,as established by the “VORIIATION,”said point being distant thereon 7 North 38°38’50”East,407.22 feet and North B4*3918~East 439.56 feat from the 81 Northeasterly corner of Annexation No.13 (RECORDED TRACT NO.7350)to said district, 9 said point also being the Northwest corner of gaid Tract No.9713;thence along said 10 existing Boundary line North 84°39’18”East 509.30 feet to the most Easterly corner of said Tract No.9713;thence leaving said existing boundary line and following along l2~said Tract boundary South Os5852 East 68.04 feet;thence South 48°29’43”West 479.38 feet to the Southwesterly corner of said Iract;thence leaving said Tract boundary continuing South 48°29’43”West.,32.90 feet.along the Southwesterly prolongation of 15 last mentioned course to the centerline of Santiago Boulevard;thence along said 161 centerline North t7°l5’43”West 199.07 feet to the beginning of a tangent curve concave 171 Southwesterly hawing a radius of 200.00 feet;thence NorthwesterLy along said curve l8~through a central angle of 42°29’36”ad arc distance of 148.33 feet;thence radial to 19~said curve North 30°l4’41”East 54.99 feet to a point on the Easterly right of way line 20.1 of Santiago Boulevard and said Tract Boundary;thence along said Tract boundary 21 ,~North l8°26’57”West 9.60 feet to the Point of Beginning.
