HomeMy WebLinkAboutResolution 1983 - 0213RESOLUTION NO.83-213 APPROVING AGREEMENT WITH EL TORO WATER DISTRICT,SUCCESSOR-IN-INTEREST TO LAGUNA HILLS SANITATION,INC.,EXTENDING AGREEMENT FOR TEMPORARY DISPOSAL OF SLUDGE AT DISTRICTS’TREATMENT FACILITIES A JOINT RESOLUTION OF THE BOARDS OF DIRECTORS OF COUNTY SANITATION DISTRICTS NOS.1,2,3,5, 6,7 AND 11 OF ORANGE COUNTY,CALIFORNIA, APP~VING AGREEMENT WITH EL TORO WATER DISTRICT, SUCCESSOR-IN-INTEREST TO LAGUNA HILLS SANITATION, INC.,PROVIDING FOR EXTENSION OF AGREEMENT FOR TEMPORARY DISPOSAL OF WASTE ACTIVATED SLUDGE AT THE DISTRICTS’FACILITIES WHEREAS,El Toro is the successor—in—interest to Laguna Hills Sanitation, Inc.,a privately—owned sanitation company;and, WHEREAS,the Districts and Laguna Hills Sanitation had formerly entered into an agreement for temporary disposal of sludge at the Districts’facilities, which said agreement expires December 15,1983;and, WHEREAS,El Toro has now assumed all legal obligations and operations of the former Laguna Hills Sanitation,Inc.and is desirous of entering into an agreement with the Districts for the temporary disposal of the El Toro sludge; and, WHEREAS,said agreement with Laguna Hills Sanitation,Inc.set forth the terms and conditions for extending said agreement for the temporary disposal of sludge at the Districts’facilities;and, WHEREAS,El Toro Water District has requested such an extension to allow time to complete its own facilities for processing and disposal of sludge. NOW,THEREFORE,the Boards of Directors of County Sanitation Districts Nos.1,2,3,5,6,7 and 11 of Orange County,California, DO HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That the certain agreement dated December 15,1983,by and between County Sanitation Districts Nos.1,2,3,5,6,7 and ii.of Orange County,California,and El Toro Water District,providing for,temporary disposal of waste activated sludge at the Districts’treatment fac~~1ities during the period from December 15,1983 to December 15,1984,is hereby approved and accepted;and, Section 2 That the charge for said services to El Toro Water District is hereby established at five times the annually adjusted charge to Industrial Waste dischargers within the Sanitation Districts;and, Section 3 That the Chairman and Secretary of District No.1 are hereby authorized and directed to execute said agreement on behalf of itself and Districts Nos.2,3,5,6,7 and 11 in form approved by the General Counsel.
