VIOLATIONS RE INDUSTRIAL WASTE DISCHARGE PERMIT NO.
1—271 —RHEEM METALS,INC
A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO..1 OF ORANGE COUNTY,
CALIFORNIA,ADOPTING FINDINGS OF FACT AND ORDERS
PERTAINING TO VIOLATIONS RE INDUSTRIAL WASTE DIS
CHARGE PERMIT NO.1-271 -RHEEM METALS,INC.

WHEREAS,Rheem Metals,Inc.,located at 1722 South Santa
Fe Street,Santa Ana,California,within the jurisdictional
boundaries of County Sanitation District No.1,has been issued
a Class I permit,effective August 1,1980,pursuant to the
provisions of District Ordinance No.103,for the discharge
of industrial wastewaters to the District facilities;and,
WHEREAS,said permit contains limitations as to the quan
tities of certain metals,chemicals and toxics;and,
WHEREAS,the District has caused an investigation of the
discharge by the Permittee,Rheem Metals,Inc.,to determine
if the maximum limitations have been exceeded in violation
of the provisions of the permit and the District ordinance;and,
WHEREAS,a hearing on the alleged violations of the permit
was held by the District’s General ManacTer and Staff on March 9,
1982,at which time the Owner/Manager,Mr.M.W.Al-Jamie of
Rheem Metals,Inc.,was present;and,
WHEREAS,the District’s General Manager recommended that
Industrial Waste Permit No.1-271 be revoked;and,
WHEREAS,the question of revocation of Industrial Waste
Discharge Permit No.1—271 was ~referred to the Board of Di
rectors of the District for purposes of having a hearing on
the proposed revocation and other actions to be taken by the
Board;and,
WHEREAS,the District’s Board held said hearing on April
14,1982.
NOW,THEREFORE,the Board of Directors of County Sanitation
District No.1 of Orange County,California,
DOES HEREBY RESOLVE,DETERMINE AND ORDER:
Section 1:Findings
A.The recitals set forth above are determined to
be true and correct and are incorporated herein as substantive
provisions of this resolution.
B.That Rheem Metals,Inc.has caused a continuous
discharge into the District’s system of copper,nickel,zinc
and acid in excess of the limitations set forth in Permit No.
1—271,commencing August 13,1980.
C.That subsequent to August 13,1980,Rheem Metals,
Inc.continued to discharge industrial waste into the District’s
system in violation of Ordinance No.103 and Permit No.1-271.
D.That on May 7,1981,Rheem Metals,Inc.failed
to meet the permit-limitations and discharged industrial waste
into the District’s system in violation of said permit and
Ordinance No.103,which resulted in the District issuing a
cease and desist order terminating all process tank discharges.

E.Subsequent to May 7,1981,the District conducted
samples and evaluations of the discharge and determined that
the Permittee discharged levels of copper,nickel,zinc and
acid in excess of the permit limitations.
F.That Rheem Metals,Inc.has failed to install
adequate on—site wastewater pre—treatrnent equipment of fa
cilities to prevent the discharge of industrial wastes which
constitute violations in that they exceed the permit limitations.
G.That discharge of excess quantities of copper,
nickel,zinc and acid by Permittee constitutes a public nuisance
in that it causes a physical deterioration and possible des
truction of District facilities necessary for the collection
and transportation of wastewater serving all residents within
the District.The loss of facilities could result in the in
ability to treat waste which could result in harmful effects to
the health,welfare and safety of persons within the District
by being exposed to unsanitary conditions.
H.The District has conducted 13 individual samplings
of the wastewater discharge of Rheem Metals,Inc.during the
past 18 months,of which 11 constituted violations of the permit
limitation.
I.Rheem Metals,Inc.has continuously failed to
maintain its pollution control equipment in a manner that
would assist in controlling the excess discharge of industrial
wastes.

Section 2:Orders
A.That Industrial Waste Permit No.1—271 is hereby
terminated effective April 14,1982.
B.That the General Manager and his designated
representatives are directed to cause the physical disconnec—
tion of the Rheem Metals,Inc.property from the District’s
facilities until such time as pre-treatment equipment is in
stalled on the Rheem Metals,Inc.site and certified by the
District as adequate to allow a discharge which will be in
full compliance with the limitations set forth in a newly
issued permit.
C.The District’s General Counsel is authorized
and instructed to initiate all legal proceedings necessary
to effect the terms of this order.
PASSED AND ADOPTED at a regular meeting held this 14th
day of April,1982.
