B.That Rheem Metals,Inc.has caused a continuous discharge into the District’s system of copper, nickel, zinc and acid in excess of the limitations set forth in Permit No. 1—271,commencing August 13,1980. D.That on May 7,1981,Rheem Metals,Inc.failed to meet the permit-limitations and discharged industrial waste into the District’s system in violation of said permit and Ordinance No.103,which resulted in the District issuing a cease and desist order terminating all process tank discharges. —2— E.Subsequent to May 7,1981,the District conducted samples and evaluations of the discharge and determined that the Permittee discharged levels of copper, nickel, zinc and acid in excess of the permit limitations. F.That Rheem Metals,Inc.has failed to install adequate on—site wastewater pre—treatrnent equipment of fa cilities to prevent the discharge of industrial wastes which constitute violations in that they exceed the permit limitations. G.That discharge of excess quantities of copper, nickel, zinc and acid by Permittee constitutes a public nuisance in that it causes a physical deterioration and possible des truction of District facilities necessary for the collection and transportation of wastewater serving all residents within the District. The loss of facilities could result in the in ability to treat waste which could result in harmful effects to the health, welfare and safety of persons within the District by being exposed to unsanitary conditions.
