HomeMy WebLinkAboutResolution 1980 - 0029“~ RESOLUTION NO.80-29 A RESOLUTION OF THE BOARDS OF DIRECTORS OF COUNTY SANITATION DISTRICTS NOS.1, 2,3,5,6,7 AND 11 OF ORANGE COUNTY, CALIFORNIA,DECLARING OPPOSITION TO THE INDUSTRIAL COST RECOVERY PROVISIONS OF THE FEDERAL CLEAN WATER ACT **************** WHEREAS,in 1977 the Congress,by the passage of Public Law 95-217 declared an 18-month moratorium on the imposition of industrial cost recovery (ICR)as provided in Public Law 92-500 and ordered EPA “to study the efficiency of,and the need for,the payment by industrial users”of their share of the Federal grants for publicly-owned treatment works used by industry;and, WHEREAS,in January,1979,the industrial cost recovery (ICR) feasibility study was presented to the Congress by Coopers and Lybrand,the firm commissioned to conduct said study;and, WHEREAS,‘the first recommendation in the Coopers and Lybrand ICR feasibility study recommends the elimination of the industrial cost recovery requirements from the Federal Clean Water Act;and, WHEREAS,the full findings of the Coopers and Lybrand investi gations strongly indicate that ICR cannot achieve its goals at all and that other EPA program requirements currently in force accomplish those ends more effectively. NOW,THEREFORE,BElT RESOLVED that the Boards of Directors of the County Sanitation Districts Nos.1,2,3,5,6,7 and 11 of Orange County,California,do hereby support the finding in the Coopers and Lybrand study relative to industrial cost,recovery and recommend that the Congress eliminate in its entirety ICR provisions of Public Laws 92—500 and 95—217. PASSED AND ADOPTED at a regular meetin9 held Feb~u~ry~13,1980.
