Section 3 Fred A.Harper is hereby employed in the position of General Manager at the salary set forth on Exhibit “B”.. Section 4 The General Manager is hereby authorized to employ and assign persons as needed to occupy the positions established in Section 2 herein and to exercise supervision over all persons in accordance with the provisions of this resolution and the current resolution Providing for Rules and Regulations Re Terms and Conditions of Employment and to terminate,for cause,the employ ment of any person employed under the provisions of said resolutions. Section 5 J.lcayne Sylvester is hereby employed in the position of Director of Finance at the salary set forth on Exhibit “B”.The person employed as Director of Finance shall also be the Secretary of the Boards of Directors of County Sanitation Districts Nos.1,2,3,5,6,7 and 11,and of the Joint Administrative Organization of said Districts,and is hereby authorized to certify actions taken by the Boards of Directors;to attest formal instruments; and to execute the necessary documents as Secretary of the Boards of Directors. The person employed as Director.of Finance shall hold this position by virtue of appointment thereto by resolution of each of the ‘Boards of Directors of County Sanitation Districts Nos.J,2,3,5,6,7 and 11 of Orange County, and shall serve at the pleasure of said Boards. Section 6 The General Manager,subject to approval of the Boards of Directors,is hereby authorized to employ a person to occupy the position of Chief Engineer. —2- .,.,~‘~ Section 7 The current organi:ational chart of the County Sanitation Districts of Orange County,Joint Administrative Organization,designated Exhibit “C”,and dated July,1973,is attached hereto and made a part of this resolution. A.Said Exhibit “Ct’sets forth tile departments and/or divisions of the Joint Administrative Organi:ation and designates the maximum number of allowable •positions and personnel for the classifications in each organizational line as heretofor established and from time to time amended by the Boards of Directors. This number shall determine tile maximum number of personnel allowable in e~ch classification,except as provided hereafter in Section 7B. The term “positions”,as used in this section,is defined as the •authorized maximum number of positions for each classification.The term “personnel”,as used in this section,is defined as the maximum allowable personnel assignable to fill the authorized positions.Authorized positions and personnel (are set forth for each classification on Exhibit “B”herein. B.If,in the determination of the General Manager,qualified applicants and/or personnel are not available to fill an open position,tile General Manager shall have the authority to close said position and open an additional established position in the organizational line that is assigned a lower salary range until such time that qualified personnel are available.In no event shall this section be construed as to authorize the opening of an additional position that is assigned a higher salary range,unless,it is the reopening of a position previously closed pursuant to provisions of this section. III.CO~IPENSATION. Section 8 Employees shall receive compensation at the hourly rate for the range and step assigned to the position classification in which they arc employed as set forth in Exhibit “B”. -3- IV.OVERTI~II3 PAY Section 9 ~~hen overtime,as defined in Section 3 of the current resolution Providing for Rules and Regulations Re Terms and Conditions of Employment,is performed,payment thorefor will be made at the rate of one and one-half times the rate at which the employee was employed at the time the overtime service was performed,except as hereafter provided in this section. Any overtime pay shall be separately itemized and paid on the payroll for the period in which the overtime service is performed. Management and Supervisory personnel as defined in Exhibit “B”herein shall not be compensated for overtime. V.SHIFT DIFFERENTIAL PAY Section 10 Personnel designated as shift employees by the General Manager who are required to work on shifts other than the day time shift shall receive shift differential pay in addition to the employees’regular or overtime pay as follows: Designated Shift Rate P.M.$.44 per hour worked A.M..50 per hour worked VI.STAND-BY PAY Section 11 The General Manager may designate employees who are required to be immediately available for emergency maintenance and repair work during normal off-duty hours.Such employees,when so desigTlated,shall be continuously available for a ~criodof one week arid shall be compensatedfor such additional services,in addition to overtime compensation,at the rate of $45.00 per calendar week for each week of such additional service performed.Insofar as practicable,no employee will be assigned such emergency duty availability for more than thirteen weeks in any one year. —4- VII.•CALL BACK PAY Section 12 Any employee that is called back for emergency work shall receive a minimum of two hours pay,provided,however,that said work does not commence with the close of the employee’s rcgula~-work day,nor conclude at the beginning of the employee’s regular work day. VIII VACATION Section 13 Every employee holding a duly established full time,permanent position who has completed one full year of service shall be entitled to an annual paid vacation leave of eighty (80)hours at the conclusion of the first full year of.service dating from the date of commencement of service. Section 14 Except as provided in Section 15 herein,every employee holding a duly established full time,permanent position who has completed more than one but less than four consecutive years of service shall,commencing with the first day of the pay period following the first year of full time service,accrue vacation leave at the rate of 3.08 hours (approximately eighty (80)hours per year)for each complete biweekly pay period of service.For such employees a maximum of eighty (80)hours of unused vacation time from prior periods may be carried over,provided,however,that the maximum total accumulated vacation time for any employee shall not exceed one hundred sixty (160)hours.Any unused accrued vacation time in excess of one hundred sixty (160)hours shall be.automatically cancelled. Section lE Every empl.oyee employed prior to January 1,1974,and holding a duly established full time,permanent position who has completed more than three consecutive years of full time service shall,coir~encing with the first day of the pay period following the third consecutive year of full time service, accrue vacation leave at the rate of 4.62 hours (approximately one hundred twenty (120)hours per year)for each complete biweekly pay period of service. For such employees,a maximum of forty (40)hours of unused vacation time from prior periods’accrua]s may be carried over,provided,however,that the maxir~um —5- total accumulated vacation time for any employee shall not exceed one hundred sixty (160)hours.:\fl~unused accrued vacation time in excess of one hundred sixty (160)hours shall be automatically cancelled. • Section 16 Every employee employed after December 31,1973,and holding a duly established full time,permanent position who has completed more than four consecutive years of full time service shall,commencing with the first day of the pay period following the fourth consecutive year of service,accrue vacation leave at the rate of 4.62 hours (approximately one hundred twenty (120) hours per year)for each complete biweekly pay period of service.For such employees,arnaxamu~of forty hours (40)of unused vacation time from prior periods’accumulation may be carried over,provided,however,that the maximum total accumulated vacation time for any employee shall not exceed one hundred sixty (160)hours.Any unused accrued vacation time in excess of one hundred sixty (160)hours shall be automatically cancelled. •Section 17 Every employee holding a duly established full time,permanent • .position whohas completed more than ten consecutive years of full time service shall,commencing with the first day of the pay period following completion of • the required consecutive years of service,accrue vacation leave for each complete biweekly pay period of service in accordance with the following schedule: Consecutive Years Biweekly Approximate Annual of Service Accrual Hours Vacation Hours More than 10 4.93 128 MOre than 11 5.24 136 More than 12 5.54 144 More than 13 5.85 •152 More than 14 6.16 160 For suéh employees,unused vacation time for prior periods’accruals may be carried over provided,however,that the maximum total accumulated vacation time for any employee at any time shall not exceed one hundred sixty (160)hours. Any unused ‘vacation tii~e in excess of one hundred sixty (160)hours shall be automatically cancelled. -6- IX.SICK LEAVE Section 15 1~very employee employed in a duly established full time,perma ne.nt position shall accrue 3.70 hours (approximately ninety-six (96)hours per year)sick leave with pay for each complete biweekly period of actual continuous service.No such employee shall earn sick leave credit during a biweekly pay period in which said employee is absent without pay for more than eleven working hours. Section 19 Upon the retirement or death of a full time,permanent employee, the.employee or the employee’s estate shall be entitled to receive a cash payment equal to the percent of the value of unused,accumulated sick leave as of the date of retirement or death,as •set forth below,or in the alternative,to have the said value applied by the Districts to the payment of group medical insurance premiums during retirement,for such period of time as the cash value at date of retirement will purchase. Administrative/Clerical, Supervisory and Management Employees 40% Engineering,Laboratory.and Operations ~Maintenance Employees .35% X.UNIFORMS Section 20 Employees required to wear uniforms or protective garments shall be provided with said uniforms and regular laundering thereof at the Districts’ expense.. Uniforms will be provided in quantities according to the following schedule: .. No.Biweekly Division Pants Shirts Plant Maintenance 10 10 Collection Facilities 10 10 Mechanical 10 10 Electrical 7 10 Operations 7 10 Laboratory ~Research 7 7 Engineering 7 7 -7— In addition to the uniforms supplied each employee,coveralls shall be made available in the Mechanical Division and lab coats shall he made available in the Laboratory Division on a pool basis to be used by employees as required. XI.HOLIDAYS Section 21 The following paid holidays shall be granted to all employees holding duly established permanent,full time positions:New Year’s Day, Lincoli~’s Birthday,Washington’s Birthday,Memorial Day,Independence Day, Labor Day,Veteran’s Day,Thanksgiving Day,the day after Thanksgiving Day, and Christmas Day. When a holiday falls on Sunday,the following Monday will be observed as a holiday.When a holiday falls on a regularly scheduled day off for an employee who is eligible to receive paid holidays,the employee shall be entitled to equivalent tine off with pay,provided,however,that employees designated as shift employees may be compensated therefor as provided in Section 9 and Section 10 of this resolution. X11.SALARY ADJUSTMENTS Section 22 Salary ranges as hereinabove set forth in Section 2 will be adjusted in accordance with the following: A.Administrative/Clerical Employees Salary ranges for Administrative! Clerical Employees will be adjusted in accordance with the provisions of Exhibit “D”,attached hereto and made a part of this resolution. B.Supervisory Employees Salary ranges for Supervisory Employees will be adjusted in accordance with the provisions of Exhibit “E”,attached hereto and made a part of this resolution. C.Engineering Employees Salary ranges for Engineering Employees will be adjusted in accordance with the provisions of Exhibit “F”,attached hereto and made a part of this resolution. -8- D.Laboratory Employees Sal~iry ranges for Laboratory Employees will be adjusted in accordance with the provisions of Exhibit “F”,attached hereto and made a part of this resolution. E.Operations and Maintenance Employees Operations and Maintenance Employees shall be paid in accordance with the salary ranges hereinabove set forth in Section 2.In addition thereto a one-time flat dollar payment of sixty ($60.00) dollars shall be added to a paycheck no later than March 7,1979. F.Management Employees Not applicable. XIII.INSURANCE PROGRAMS Section 23.Life Insurance on Emnloyees The Districts shall provide life and AD~D insurance on the life of each full time,permanent employee and pay the full premium as set forth on Exhibits “G”and “H”,attached hereto and made a •part of this resolution.The face aJfloui~t of said policy shall be: Management employees $50,000.00 Supervisory Employees at one and one-half times annual salary not to exceed $28,000.00 All,other full time,permanent employees $5,000.00 Section 24.Disability Insurance The Districts shall provide a disability •insurance plan for each full time,permanent employee.The Districts shall obtain.. and may pay the full premium or a lesser amount as set forth on Exhibits “G”and “H”,for said disability insurance plan which plan shall provide a benefit of at least one hundred twenty dollars (120.00)per week for a period of up to twenty-six (26)weeks at a cost to the employee of not to exceed three dollars and.sixty-six ($3.66)per month. Section 25.Medical Health Insurance The Districts shall provide a medical health insurance program for the benefit of the full time,permanent employees and their dependents in accordance with the present progran choices of prepaid health care medical plan (JI~.10)or an indemnity type group health insurance plan which arc presently in force and effect. -9- A.Employee.The Districts will pay full premium for the medical plan for each employee as set forth on Exhibits “G”and “W’. B.Dependents The Districts will make available dependent medical plan coverage and will pay toward the premium cost of said dependent coverage the amount set forth on Exhibits “G”and “H”. Section 26.Dental Insurance The Districts shall provide a dental plan for Administrative/Clerical and Management Employees and their dependents and contribute thirteen dollars and seventy-five cents ($13.75)toward the premium cost of said plan.The Districts will further increase or reduce their contribution toward the monthly total Cost of the dental premiums for said employees,as necessary, to balance any increase or decrease in said total monthly premium resulting from a change in the distribution of employees electing self-coverage and employees electing dependent coverage on the effective date of said Dental Plan. Section 27.Insurance Plan Changes •A.Contribution Limit The Districts will keep their contribution to existing plans equal,provided,however,that in no event will the financial contribution by the Districts be greater than the actual full cost of the plan. • B.Premium Adjustments The General Manager is hereby authorized to adjust. the respective Districts’and employee share of premium costs,pursuant to notification from time to time of such premium adjustments by the insurance underwriters,in accordance with the provisions of executed Memoranda of Understanding with employee units,as amended,and the terms of this resolution. C.Additional Optional Plans In the event the Districts add additional optional plans,the Districts’share of the premium will be the same as for existing plans as set forth above. 0.Change of Unden.Titers In the event the Districts change underwriters for existing plans,the Districts’share of the premium will.be the same as for existing plans as set forth above. -.10- 4 I Section 2S.Effective Date of Insurance Covera~e All insurance coverages shall be effective from the first day of the month following one full calendar month of employment. XIV.SEVERANCE PAY Section 29.Severance Pay Eligibility Employees separating from employment with the Districts may be deemed eligible for severance pay pursuant to the policy set forth in the Districts’most current resolution Providing for Rules and Regulations Re Terms and Conditions of Employment. Section 30.Severance Pay Amount If an employee separating from employment with the Districts is determined by the General Manager to be eligible for severance pay,such payment shall be at the rate at which the employee was employed at the time of separation. XV.MISCELLANEOUS PROVISIONS Section 31 The General Manager may authorize special adjustments to avoid or eliminate inconsistencies resulting from the strict application of any provisions of this resolution. Se~tion 32 The General Manager is authorized to administer written personnel rules,regulations and policies designed to.augment or clarify the provisions of this resolution. Section 33 Any resolutions,motions or portions thereof that are in conflict herewith are hereby rescinded and made of no further effect on the effective date of the various provisions hereof.
