HomeMy WebLinkAboutResolution 1978 - 0055RESOLUTION NO.78-55-2 DECLARING THE DAMAGE DONE TO THE ORANGE SUB-TRUNK SANTA ANA RIVER CROSSING SEWER LINE TO BE A CONDITION CONDUCIVE TO GREAT PUBLIC CALAMITY AND DISPENSING WITH THE BIDDING REQUIREMENTS FOR THE REPLACEMENT THEREOF A RESOLtTFION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2 OF ORANGE COUNTY,CALIFORNIA,DECLARING THAT THE DAMAGE DONE TO THE ORANGE SUB-TRUNK SANTA ANA RIVER CROSSING SEWER LINE TO BE A CONDITION CONDUCIVE TO GREAT PUBLIC CALAMITY AND DISPENSING WITH THE BIDDING REQUIREMENTS FOR TI-lB REPLACEMENT THEREOF ***************.*** WHEREAS,the recent break in the Orange Sub-Trunk Santa Ana River Crossing Sewer Line has caused an estimated 4.5 -.5 MCD of untreated sewage to be discharged into the open river channel and through it into the ocean,creating a health hazard to humans and unknown damage to the marine ecology;and, WHEREAS,pursuant to the District~s emergency powers,it has caused provisional repairs to be effected which have temporarily abated the condition;and, WHEREAS,said temporary repair is not of a substantial nature and may not withstand another storm of the magnitude of those recently encountered;and, WHEREAS,there is a pressing need for a permanent repair to said Orange Sub-Trunk Santa Ana River Crossing Sewer Line;and, WHEREAS,Health and Safety Code Section 4755 allows the Board to dispense with the formal bidding process if there is an anticipated great public calamity and the public interest and necessity demand immediate expenditure of public money to safeguard life,health or property. NOW,THEREFORE,the Board of Directors of County Sanitation District No.2 of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That the temporary repairs to the Orange Sub-Trunk Santa Ma River Crossing may not be able to withstand a storm of the same magnitude as those recently encountered and that a great public calamity is anticipated if permanent repairs are not made promptly;and Section 2 That the public interest and necessity demand an immediate expenditure of public money to safeguard life,health or property and that the requirements of the formalized procedure are therefore dispensed with;and Section 3 That the District’s General Manager is hereby authorized and directed to cause the permanent repairs to be made forthwith by a responsible contractor on the best terms and conditions and the best price available on an informal bid or quote basis and without compliance with formal bid procedures.
