HomeMy WebLinkAboutResolution 1975 - 0059RESOLUTION NO.75..~59 A RESOLUTION OF THE BOARDS OF DIRECTORS OF COUNTY SANITATION DISTRICTS NOS.1,2,3, 5,6,7 AND 11 OF ORANGE COUNTY,CALIFORNIA, DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND IMMEDIATE EXPENDITURE OF MONIES TO SAFEGUARD LIFE,HEALTH AND PROPERTY IN ORDER TO MEET ESTABLISHED DISCHARGE REQUIRE MENTS,WITHOUT PUBLIC BID AS DESCRIBED IN SECTION L~755 OF THE HEALTH &SAFETY CODE WHEREAS,the California Regional Water Quality Control Board, Santa Ana Region,of the State Water Resources Control Board of the State of California,jointly with the Federal Environmental Protection Agency,did on June 7,l97~,adopt and establish effluent discharge requirements for wastewater discharge to the Pacific Ocean by the County Sanitation Districts Nos.1,2,3, 5,6,7 and 11 of Orange County,California,pursuant to the Water Quality Control Plan —Ocean Waters of California,and Section ~~O2 of the Federal Water Pollution Control Act,as amended (33 U.S.C.1251 et seq);and WHEREAS,said effluent discharge requirements,a.s set forth in a National Pollutant Discharge Elimination System Permit No.CAOllO6O24,are established to safeguard life,health and property,and said permit does establish prohibitions and limita tions on pollutants discharged to the Pacific Ocean;and WHEREAS,to achieve the degree of treatment tequired to meet said pollutant limitations,said Districts must construct additional treatment facilities f or further treatment beyond the capabilities of the present treatment facilities now owned, operated,and maintained by said Districts,and said permit does provide that the Districts shall complete final construction V plans and specifications on or before April 1,1976;and WHEREAS,it is anticipated that the safeguards to life, health,and property as provided in said National Pollutant Discharge Elimination System Permit may not be provided unless there i&an immediate expenditure of public funds necessary to meet those certain provisions of compliance,as set forth in said permit;and WHEREAS,said Districts did receive and accept a Step I construction grant from the Environmental Protection Agency and the State Water Resources Control Board in a total eligible amount of $3.5 million for the purpose of assisting the Districts to determine and set forth in a Facilities Plan thebest apparent alternative forsaid required.additional facilities;and WHEREAS,it is imperative that said Districts construct and operate certain wastewater process treatment pilot facilities to select the best apparent alternative for said required additional. treatment facilities;and WHEREAS,to design said pilot facilities and to procure bids by formal advertising as prescribed in Section ~755 of the-Health and Safety Code of the State of California and construct said pilot facilities by normal contractual procedures established by said Districts would create delays whereby said Districts would be unable to determine-the best apparent alternative for said additional facilities in sufficient time to meet the requirements of said National Pollutant Discharge Elimination System Permit. —2— NOW,THEREFORE,the Boards of Directors of County Sanitation Districts Nos.1,2,3,5,6,7 and 11 of Orange County,California, DO HEREBY RESOLVE,DETERMINE,AND ORDER: 1.That the foregoing premises do constitute an anticipated great public calamity and an emergency as is contemplated and provided in the provisions of Section ~I755 of the Health and Safety Code,and that the public interest and necessity demand Immediate expenditure of public money to safeguard life,health, and property in order to meet the discharge requirements under which the Districts must operate. 2.That the General Manager is hereby authorized and directed to expend such funds as are necessary to complete the Facilities Plan and other requirements as set forth in said Step I construction grant without public bids as described in Section )4755 of the Health and Safety Code of the State of California.• 3.That the General Manager is hereby authorized to negotiate for the labor,materials,and services necessary to meet the provisions of said Step I grant substantially in accordance with the paragraph 6 of Procurement Standards as set forth in Volume 38,No.151,of the CFR dated Tuesday,August 7, 1973,provided that no monies shall be obligated by said Districts unless approved by the State Water Resources Control Board and Environmental Protection Agency officials pursuant to said Step I grant. 4.That cost records of any labor,material or services as authorized shall be kept in the manner provided in Sectlons 4000 to 4007,inclusive,of the Government Code of the State of California.
