Home My WebLink AboutResolution 1975 - 0041RESOLUTION NO.75—141-2 ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT (ANNEXATION NO.8 —TRACT NO.~4980 A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2 OF ORANGE COUNTY,CALIFORNIA,ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT (ANNEXATION NO.8- TRACT NO.14980 TO COUNTY SANITATION DISTRICT NO.2) WHEREAS,the Board of Directors of County Sanitation District No.2,on October 10,1973,adopted Resolution No.73—1149—2, authorizing initiation of proceedings re Annexation No.8 —Tract No.14980;and, WHEREAS,the Local Agency Formation Commission on April 214,19714, adopted Resolution No.714—39,declarings its findings,approving said annexation and directing County Sanitation District No.2 to proceed; and, WHEREAS,the Board of Directors of County Sanitation District No.2 on February 19,1975,adopted Resolution No.75—20—2,fixing the time,date and place of hearing regarding Annexation No.8 — Tract No.14980,providing for notice thereof,and establishing pro ceedings for filing of written protest;and, WHEREAS,after due notice provided by law,a public hearing was held on March 12,1975,by this Board of Directors on proposed Annexation No.8 —Tract No.14980. NOW,THEREFORE,the Board of Directors of County Sanitation District No.2 of Orange County,California, DOES HEREBY RESOLVE,DETERMINE ANP ORDER: Section 1 That application has heretofore been made to County Sanitation District No.2 for annexation of territory to the District by means of a letter from the City of Orange on behalf of the property owners;and, Section 2 That pursuant to Division 1 (District Reorganiza— tion Act of 1965)of Title 6 of the Government Code of the State of California,application has heretofore been made to the Local Agency Formation Commission for annexation of said territory to Cpunty Sanitation District No.2 by means of Resolution No.73—149—2,filed with said Commission by the District,which said Commission has approved said annexation;and, Section 3 That the designation assigned by said Commission to the territory proposed to be annexed is “Annexation No.8 —Tract No.‘1980 to CountySanitation District.No.2”,the exterior boundaries of which are described on Exhibit “A”and shown on Exhibit “B”attached hereto and by reference made a part of this resolution;and, Section 4 That the territory hereinbefore referred to is inhabited;and, Section 5 That the reason for annexing said territory is to obtain and provide public sanitary sewer service to said territory;and, Section 6 That provislon for payment of annexation fees in the amount of $1,612.28 has been satisfied;and, Section 7 Pursuant to public hearing on March 12,1975,on said Annexation No.8,—Tract No.4980,during which no protests were filed,either written or oral,the Board of Directors hereby finds that protests filed represent less than 25 percent of the number of landowners within such territory owning not more than 25 percent of the assessed value of land therein;and less than 25 percent of the voting power of voters entitled to vote as a result of residing in or owning property within such territory;and, Section 8 That,as authorized by resolution of the Local Agency Formation Commission and pursuant to Division 1 (District Reorganization Act of l965)of Title 6 of the Government Code,Sections 56320 and 56322,inclusive,the territory hereinbefore referred to and described hereinabove,be and it is hereby ordered annexed to County Sanitation District No.2.
