HomeMy WebLinkAboutResolution 1975 - 0017RESOLUTION NO.75-17 POSITIONS AND SALARIES A JOINT RESOLUTION OF THE BOARDS OF DIRECTORS OF COUNTY SANITATION DISTRICTS NOS.1,2,3, 5,6,7,AND 11 OF ORANGE COUNTY,CALIFORNIA, ESTABLISHING EMPLOYEE POSITIONS AND FIXING SALARIES THEREFOR;AUTHORIZING THE EMPLOYMENT OF PERSONNEL;AND RESCINDING ALL RESOLUTIONS PREVIOUSLY ADOPTED IN THIS CONNECTION The Boards of Directors of County Sanitation Districts Nos.1, 2,3,5,6,7,and 11 of Orange County,California,hereby resolve that: BASIC SALARY RANGES Section 1 There are hereby established in the Joint Adminis trative Organization the Basic Salary Ranges set forth on Exhibit “A”, Exhibit “B”,and Exhibit “C”,attached hereto and made a part of this resolution. POSITIONS AND SALARIES Section 2 There are hereby established In the Joint Adminis— trative Organization the position c1assi~ications of employment and the respective salary ranges therefor,as set forth on Exhibit “D”, attached hereto and made a part of this resolution. Section 3 There Is hereby also established in the Joint Administrative Organization the following position of employment at the salary indicated opposite said position: •General Manager $37,500/yr. Section LI Fred A.Harper Is hereby employed In the position designated “General Manager.” Section 5 The person employed as Director of Finance shall also be the Secretary ot the Boards of Directors of County Sanitation Districts Nos.1,2,3,5,6,7,;and 11,and of the Joint Adminis trative Organization of said Districts,and.is hereby authorized to certify actions taken by the Boards.of Directors;to attest formal instruments;and to execute the necessary documents as Secretary of the Boards of Directors.• The person employed as Director of Finance shall hold this position by virtue of appointment thereto by resolution of each of the Boards of Directors of County Sanitation Districts Nos.1,2,3, 5,6,7,and liof Orange County,and shall serve at thepleasure of said Boards;and that 3.Wayne Sylvester is hereby employed in the position designated “Director of Finance.” Section 6 The current organizátiona].chart of the County Sanitation Districts of Orange County,Joint Administrative Organiza tion,designated Exhibit “E”and dated January,1975,is attached hereto and made a part of this resolution. A.Said Exhibit “E”sets forth the departments and/or divisions and designates the authorized maximum number of positions ~in the Joint Administrative Organization and the maximum number of personnel assignable to fill said authorized positions. The term “positions”,as used in this section,is defined as the authorized maximum number of positions in each classification.The term “personnel”,as used in this section,is defined as the maximum allowable personnel assignable to fill the authorized positions. 4 B.Exhibit “E”shall indicate in each classification block the maximum number of allowable positions for the classifications in each organizational line.This number shall determine the maximum number of personnel allowable in each classification,except as pro vided hereafter in Section 6C. C.If,in the determination of the General Manager,qualified applicants and/or personnel are not available to fill an open position as established in Section 2 hereof,the General Manager shall have the authority to close said position and open an additional established position In the organizational line that is assigned a lower salary range until such time that qualified personnel are available.In no event shall this section be construed as to authorize the opening of an additional position that is assigned a higher salary range. D.If,in the determination of the General Manager,qualified applicants and/or personnel are not available to fill the Apprentice II —2— positions of a given department,or if qualified applicants and/or personnel available exceed the authorized number of personnel for the position of Apprentice II,the General Manager shall have the authority to employ within each department personnel.in either the Apprenticell position or its equivalent departmental position as established by the Apprenticeship II Program heretofore approved by the Boards of Directors on April 9,1969;insofar as the total number of personnel employed in the respective positions do not exceed the total number of personnel authorized for the Apprentice ii and its equivalent departmental position. Section 7 WIth respect to positions designated as Apprentice, the General Manager shall exercise control and direction in accordance with the provisions outlined In the Apprentice Program developed pursuant to authorization of the Boards of DirectOrs on November 9, 1966,and April 9,1969,and as modified by authorization of said Boards on.June 9,1971. Section 8 The General Manager is hereby authorized to employ and assign persons as needed to occupy the positions established in Section 2 hereof at salary rates as provided herein. Section 9 The General Manager is hereby authorized and directed to exercise supervision over all persons and to terminate, * for cause,the employment of any person employed under the provisions of this resolution. Section 10 The General Manager,subject to approval by the Boards of Directors,is hereby authorized to employ a person to occupy the position of Chief Engineer. COMPENSATION FOR EMPLOYEES Section 11 Employees shall receive compensation at;the bi—weekly or hourly rate for the range and step assigned to the position classification in which they are employed. Except for employees reclassified in accordance with the pro visions of Section 12 hereof,each employee employed before the —3-. effective date of this resolution and assigned to a full—time permanent position established in Section 2 hereof,shall be assigned a salary no greater than that provided for by the step nuxnber to which such employee is entitled on the effective date of this resolution,under the provisions of,and the salary assignments authorized by prior resolutions,as amended. Each employee employed on or after the effective date of this~ resolution shall be assigned,insofar as practicable,a salary provided for by the first step rate hereinabove established for the position being filled;provided,however;that upon a determination by the General Manager that an individual being employed has unusual qualifications or that there is unusual difficulty in recruiting an employee for the position,the General Manager may ass:ign to such an employee a salary not to exceed that provided for by the third full step rate for the position being filled at any time during the first ninety (90)days of employment.It is further provided,that on recommendation of the General Manager the Boards of Directors may,by motion,authorize the assignment to such an employee a salary :exceeding that provided for by the third full step rate for the position being filled. Each employee employed in a part—time position established in Section 2 hereof shall,at the discretion of the General Manager, be assigneda salary equal to or less than the hourly rates specified in Section 2. Section 12 Upon the determination by the General Manager, with the advice and recommendation of the Personnel Review Committee, that a person already employed should be transferred or reclassified to a position with a different title or range number,the assignment of a new salary to such a person shall be made as follows: A.For an employee transferred to a position of substantially the same responsibility,the employee shall be assigned a salary corresponding to the same step number occupied under his former classification on the effective date of his reclassification. _L’_ B.For an employee transferred to a position of higher responsibility,the employee shall be assigned a salary corresponding to the step number occupied under his former classification on the effective date of his reclassification or,under unusual circumstanc.es and at the determination of the General.Manager)to a salary corres ponding to a lower step number,but in no event shall he receive less than a one—half step increase. C.For an employee transferred to a position of lesser •responsibility or lower salary range,the employee shall be assigned a salary corresponding to that which he would receive as a new employee in the new classification as provided in Section 11 hereof. •Section 13 If,in the determination of the General Manager, work of a higher paid classification is required by a Department Head or Departmental Supervisor of an employee on a temporary basis for a period of more than twenty—one (21)consecutive working days in a payroll year,the employee working temporarily in said higher classifi cation shall be eligible to receive a temporary Increase tn pay rate for time worked in the higher paid classification beginning with the 22nd consecutive working day,provided (a)that it is established by the Department Head that said employee is,in fact,performing In the capacity of the higher position;(b)that the higher position classifi cation .is vacant by virtue of the Incumbent having been promoted, terminated,or being on an extended leave;and (c)that written’ notification of the required work of a higher paid classification has been properly filed with the Department Head within t;he first ten (10)consecutive days of said work.The increased compensation to be paid to an employee who meets the aforementioned ‘criteria shall be equal to a one full step salary increase or the first step of the position classification for which said work is allegedly being performed,whichever is greater,provided that only the percentage of time actually devoted to performing work of the highe:r classifica tion commencing with the 22nd consecutive work day shall be compensated at the higher rate of pay.. —5— When an employee is requested by the Department Head to work in an upgraded classification wherein it is the intent to permanently upgrade said employee in that classification,•the twenty—one (21) consecutIve working day waiting period for temporary increase in pay rate eligibility,as hereinabove provided,may be waived by the General Manager. Section ill Except as provided hereafter for those positions designated as Apprentices,for eachemployee in the Joint Administrative Organization assigned to a position for which a salary range number is established in Section 2 hereof,there shall be a salary anniversary date which,in the case of employees employed before the effective date of this resolution,shall be the first day of the bi—weekly pay period in which said employees’salary anniversary date heretofore established under the provisions of prior resolutions,as amended, falls,commencing with the effective date of this resolution and continuing through January 29,1976.Thereafter,such employees’ annual salary anniversary date shall be the first d~y of the bi—weekly pay period following fifty—two (52).weeks of continuous service from 4 the preceding.salary anniversary date. In the case of employees employed after the effective date of this resolution,the salary anniversary dat.e shall be the first day of the bi—weekly pay period following the completion of the first twenty—six (26)weeks of continuous service.Thereafter,such employees’annual salary anniversary date shall be the first day of the bi—weekly pay period following fifty—two (52)weeks of continuous service from the preceding salary anniversary date. For each employee assigned to a position designated as Apprentice I,~as established in Section 2 hereof,there,shall be assigned four salary anniversary,dates;the first of which shall be the first day ~f the bi—weekly pay period after such an employee completes the first thirteen (13)weeks of continuous service;the subsequent of which shall be the first day of the bi—weekly pay period after such employee completes each successive thirteen (13)week period of continuous service. —6— For each employee assigned to a position designated as Apprentice II,as established in Section 2 hereof,there shall be assigned two salary anniversary dates;the first of which shall be the first day of the bi—weekly pay period after such an employee completes the first twenty—six (26)weeks of continuous service as an Apprentice .11;and the second of which shall be the first day of the bi—weekly pay period after such an employee completes each succes— sive twenty—six (26)week period of continuous service as an Apprentice II. Upon completion of the ApprenticeshIp Program,the permanent salary anniversary date of personnel who have completed either the Apprentice I or Apprentice II program shall be established as the first day of the bi—weekly pay period following th.e period in which the apprentice has successfully completed the program;and thereafter, such employees’annual salary anniversary date shall be the first day of the bi—weekly pay period following fifty—two (52)weeks of continuous service from the preceding salary anniversary date. For each employee assigned to a posi-tion designated as super visory In Section.2,Subsection D hereof,there shall be established. a salary anniversary date which shall be the first day of the bi—weekly pay period in which the Districts’fiscal year begins. Section 15 Except as provided hereafter In this section, thirty (30)days prior to the salary anniversary date of each employee,the General Manager shall cause to be made a review of such employee’s performance on the.job.With the advice of the Personnel Review Committee,the General Manager shall either (1)assign to each such employee a salary representing a higher step rate not to exceed one full step effective on the employee’s anniversary date,or (2). cause such assignment tb be postponed for a period up to the next anniversary date.The General Manager shall cause such postponement only for reason of sub—standard performance by the employee or to establish as much as possible within each position classification equal salary for equal ability and work performance with due considera tion for training and seniority. —7— In the case of employees’positions designated.as supervisory in Section 2,Subsection D hereof,the General Manager shall cause to be made a review of such employee’s performance on the Job.With the advice and recommendation of the employee’s Department.Head and the Personnel Review Committee,the General Manager shall either (1)assign to each such employee a salary representing a higher step rate not to exceed one—half full step effective on the employee1s anniversary date or (2)cause such assignment to be postponed for a period up to the next.anniversary date.The General Manager shall cause such postpone ment only for reason of sub—standard performance by the employee or to establish as much as possible within each position classification equal salary for equal ability and work performance with due considera tion for training and seniority. Section 16 When overtime,as defined in Section 3 of Resolution No.75—il is performed,payment therefor will be made at the rate of one and one—half times the rate at which the employee was employed at the time the overtime service was performed. Any overtime pay shall be separately itemized and paid on the payroll for the period in which the overtime service is performed. Section 17 Personnel designated as shift employees .by the General Manager who are required.to work on shifts other than the day—time shift shall receive shift differential pay as follows: P.M.Shift $.1~Li per hour worked A.M.Shift .50’per hour worked Said sums shall be in addition to the employee’s regular salary. Said compensation is separate and apart from overtime pay provided herein.Any employee not designated as entitled to shift differential pay shall receive compensation for overtime provided herein. Section 18 The G~nera1 Manager may designate employees who are required to be immediately available,for emergency maintenance and repair work during normal off-day hours.Such employees,when so designated,shall be continuously available for a period of one week and shall be compensated for such additional service,in addition to —8— overtime compensation,at the rate of $142.00 per calendar week for each week of such additional service performed.Insofar as practicable, no employee will be assigned such emergency duty availabiLity for more than 13 weeks in any one year. Notwithstanding the above,any employee,except as provided in Section 19 hereof,that is called back for emergency work shall receive a minimum of two (2)hours pay,provided,however,that said work does not commence with the close of the regular work day,nor conclude at the beginning of the regular work day. Section 19 No management,supervisory,or administrative employee who occupies a position that has a salary range exceeding that of Range No.56C,Range No.355,or ~514B,as hereinabove respectively established,will be compensated under the provisions of Sections 16,17,and 18 of this resolution. Section 20 Any and all prior resolutions or motions or portions thereof previously adopted and relating to positions and salaries are hereby rescinded and made of no further effect. Section 21 That this resolution shall become effective January 31,1975.
