OPPOSING SB 275)“COLLECTIVE BARGAINING
ACT FOR PUBLIC EMPLOYMENT”
A RESOLUTION OF THE BOARDS OF DIRECTORS
OF COUNTY SANITATION DISTRICTS NOS.1,
2,3,5,6,7 AND 11 OF ORANGE COUNTY,
CALIFORNIA,EXPRESSING OPPOSITION TO
SENATE BILL 275,THE “COLLECTIVE
BARGAINING ACT FOR PUBLIC EMPLOYMENT’!
WHEREAS,the existing Myers—Milias—Brown Act adequately
provides for public agency employer—employee relations and sets
forth provisions for meeting and conferring with recognized public
employee organizations in good faith in order to resolve any
conflicts and to reach agreements on matters of wages,hours,and
working conditions;and,
WHEREAS,Senate Bill 275,the Collective Bargaining Act for
Public Employment,if enacted,would repeal the existing system for
public employer—employee labor relations and significantly disrupt
employer—employee relations at the local level;and,
WHEREAS,Senate Bill 275 does not recognize the substantial
distinctions between public and private employer—employee sectors;
and,
WHEREAS,Senate Bill 275,if enacted,would remove the inherent
decision—making power from the hands of locally—elected officials and
then incumbent responsibility relative to major financial and
budgetary considerations of their respective entities,and relegate
these decisions to non—elected persons,parties,and commissions
who are not responsible or answerable to the public;and,
WHEREAS,Senate Bill 275,if enacted,would impose on local
government collective bargaining and arbitrary systems which do not
take into consideration the fact that public employers are not
organized,nor do they operate under the same standards and for the
same purposes as a private employer;and,
WHEJ~EAS,Senate Bill 275,if enacted,would permit public
employees the right to strike,which could seriously jeopardize the
health,safety,and welfare of the general public by interrupting
the vital services which said public agencies perform.
NOW THEREFORE,BE IT RESOLVED:
That the Boards of Directors of County Sanitation Districts
Nos.1,2,3,5,6,7 and 11 do hereby express their adamant
opposition to Senate Bill 275 for the reasons hereinabove stated.
PASSED AND ADOPTED at an adjourned regular meeting held
February 19,1975.
