HomeMy WebLinkAboutResolution 1973 - 0073I RESOLUTION NO.73—73 AUTHORIZING AMENDMENT TO CONTRACT WITH PUBLIC EMPLOYEES RETIREMENT SYSTEM A RESOLUTION OF THE BOARD OF DIRECTORS AUTHORIZING AN AMENDMENT TO THE CONTRACT PROVIDING FOR THE PARTICIPATION OF COUNTY SANITATION DISTRICT.NO.1, OF ORANGE COUNTY,ACTING FOR ITSELF AND COUNTY SANITATION DISTRICTS NOS.2,3,5,6,7,AND 11, IN THE PUBLIC EMPLOYEES’RETIREMENT SYSTEM,MAKING ITS EMPLOYEES MEMBERS OF SAID SYSTEM WHEREAS,the Board of Administration of the Public Employees’ Retirement System and the Board of Directors of County Sanitation District No.1,of Orange County,acting for itself and County —~Sanitation Districts Nos.2,3,5,6,7,and 11,entered into a Contract effective on October 1,l95~,providing for the participation of said County Sanitation Districts of Orange County in the Public Employees’Retirement System;and, WHEREAS,it is now desirable to take advantage of certain benefits provided under said Retirement System,and not included in said contract; NOW,THEREFORE,BE IT RESOLVED: Section 1 That said Boards of Directors of County Sanitation Districts Nos.1,2,3,5,6,7,and 11,of Orange County,authorized, and they do hereby authorize,an amendment to said Contract,a copy of said amendment being attached hereto marked “Exhibit A”,and by such reference made a part hereof as though herein set out in full;and, Section 2 That the Chairman and Secretary of District No.1 be,and they are hereby authorized,empowered and directed to execute said amendment for and on behalf of said Boards of Directors of County Sanitation Districts Nos.2,3,5,6,7,and 11. The Board of Administration,Public Employees’Retirement System,hereinafter referred to as Board,and the BOARD OF DIR2CTOES of the COIJNTI SANITATION DISTRICT NO.3.OF OEAN~COtJNT~(ACTITO FOR ITSELF AND COUNTY SANITATION DISTRICTS NO.2,3, 5,6,7 AND 11,hereinafter referred to as Public Agency,having entered into a contract under date of October 1,1954,effective October 1,1954,and as amended effective July 1,1960,July 1,1961 and February 1,1965,and as provided in Chapter 170,Statutes of 1971,which provides for participation of Public Agency in said System,Board and Public Agency hereby agree as rollows: A.Para~rapbs 1 through 10.are hereby striàken fron said contract as executed effective October 1,1954,and are..hereby replaced by the following pam. graphs nwnbered 3.through 9 inclueive; 1.All words and terms used,herein which are defined in the Public Employees’Retirement Law shall have the meaning as defined therein unless otherwise spec ificaU.y provided.“Normal retirement age” ahafl mean age 60 for miscellaneous memberó. 2.Public Agency &hall participate in the Public Employees’Retirement System from and after October 1,1954,asking its employees as hereinafter provided,members of said System subject to all provi. eiona of the Public Employees’Retirement Law except such as aoply only on election of a contracting agency and are not provided for herein and to afl,amendments to said Law hereafter enacted except such as by express proviuion thereof apply only on the election of contracting agencies. This contract is a continuation,according to the provisions of Section 20567.5,Government Code,of th’~contract of the Orange County Joint Outfall Sever which was assumed by the Districts pursuant to the assumption of the functions and personnel of the Joint Outfall Sever. 3.Employees of Public Agency in the following classes shall becoaie me~r.bers of said Retirement S~Jstcni except such in each such class as are excluded by law or this agreement: a.Employees other than local firemen and local policemen (herein referred to as Miscellaneous Members). The foflowlr.g employees shall be excluded fron membership in said Retirement System: Form 702.1 EXHIBIT “A” to Resolution No.73—73 !~O ADD~I0NAL ZXCLUBIONS The fraction or final compensation to be provided for each year of credited prior and current service as a miscellaneous member upon retirement at normel retirement age shall be applied as provided In Section 21251.13 ‘of said Retirement Law. 5.Contributions for micceU.an~ous members shall be,aub~ject to Section 20603 of said Retirement Law. 6.The following additional.provisions of the Public ~ployeea’Retire. ment Law which apply only upon election of a contracting agency abel]. apply to the Public Agency and ita employees: a.Section ~n ~.l (providing for increases in allowances to which the annual cost-of-living provisions apply,payable for time con. mencing on the fi.rst day of th~calendar month coinciding with or next following the effective date of this amendment to or on account of persons retired or members deceased.on or prior to December 31,1970).., . .. b.Sections 21380-7 (providing foi’allowances of survivors of members upon death before retirement). 7.Public Agency shall contribute to said Retirement System as follows: a.With respect to’miscellaneous members,the public agency shall contribute the following percentages of monthly salariea earned as miscellaneous members of said System: (i)0~l7 percent until June 30,1990 on account of the liability for prior service benefits. (2)7.67 percent on account of the liability for current service benófits. (3)0.70 percent on account,of the liability for the 1959 Survivor Program. (le)A lump sum of $13,455 payable within 30 days of the effective date of this amendment on account of the benefits provided by Section 21222.1 of the Government Code. b •A reasonable amount per annum,as , fjxed by Board to cover the éosta of administering said System as it affects the employees of Public Agency,not including the costs of special valuations or time period. icb.1 investigations and valuation required by law. o •A reasonable amount as fixed by the Board,payable in one install ment as the occasions arise,to cover costs of special valuations on account of employees of Public Agency,and costs of the period ical investigation and valuation required by law.
