2 A RESOLUTION OF THE BOARD OF DIRECTORS OF
COUNTY SANITATION DISTRICT NO. 7 OF ORANGE
3 COUNTY, CALIFORNIA, ORDERING THE WORK
DESCRIBED IN RESOLUTION OF INTENTION NO. 72-42-7,
4 "ASSESSMENT DISTRICT NO. 9" OF SAID DISTRICT.

6 THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT
7 NO. 7 OF ORANGE COUNTY, CALIFORNIA, pursuant to the provisions of
8 the "Improvement Act of 1911, " being Division 7 of the Streets and High-
9 ways Code of the State of California, does RESOLVE as follows:
10 That the public interest and convenience require the work herein-
11 after mentioned to be done and, therefore, the said Board of Directors
12 hereby orders the following work to be done and improvements to be made
13 in said County Sanitation District No. 7 of Orange County, to-wit:
14 The construction of sanitary sewers and all appurtenances and
15 appurtenant work in connection therewith in "ASSESSMENT DISTRICT NO. 9"
16 in said County Sanitation District No. 7 of Orange County, all as more par-
17 ticularly described in Resolution of Intention No. 72-42-7, passed and
18 adopted by the Board of Directors of said Sanitation District on March 21,
19 1972.
20 For further particulars, reference is hereby made to said
21 Resolution of Intention No. 72-42-7 and to the plans, profiles and drawings
22 on file in the offices of the Secretary and the Engineer of Work of said
23 sanitation district, and to the specifications for the said work heretofore
24 adopted by the said Board of Directors and on file in the offices of the
25 Secretary and the Engineer of Work for said district, and all of said plans,
26 profiles, drawings and specifications heretofore approved by the Board of
27 Directors of said County Sanitation District No. 7 are incorporated herein
28 and reference is hereby made thereto for a more particular description of
29 said work.
30 Said Board of Directors has determined and declared that the
31 contemplated work and improvement heretofore mentioned was, in the opin-
32 ion of said Board of Directors, of more than local or ordinary public

]. benefit, and the said Board of Directors has made the expense of said work
2 chargeable upon a district. For the particular description of said district,
3 reference is hereby made to said Resolution of Intention No. 72-42-7.
4 Said Board of Directors has determined and declared that serial
5 bonds bearing interest at the rate of seven per cent (M) per annum and
6 extending over a period ending nine (9) years from the second day of
7 January next succeeding the next September 1st following their date, will
8 be issued hereunder in the manner provided by the "Improvement Act of
9 1911, " being Part 5, Division 7 of the Streets and Highways Code of the
10 State of California, to represent each assessment of Fifty Dollars ($50. 00)
11 or more remaining unpaid at the expiration of the last date fixed for payment
12 of assessment in the notice to property owners mailed pursuant to the pro-
13 visions of Section 5390 of the Streets and Highways Code of the State of
14 California.
15 Said Board of Directors has elected and determined to have the
16 redemption provisions of said bonds provide a premium of five per cent
17 (K) of the unmatured principal in accordance with the provisions of Section
18 6464 of the Streets and Highways Code of the State of California.
19 All of the work herein ordered shall be done and carried through
20 in pursuance of an Act of the Legislature of the State of California, desig-
21 nated the "Improvement Act of 1911, " being Division 7 of the Streets and
22 Highways Code.
23 All of the said work shall be done under the direction of and to the
24 satisfaction of the Engineer of Work and all of the materials used shall com-
25 ply with the specifications and be to the satisfaction of the Engineer of Work.
26 The Secretary of said County Sanitation District No. 7 is hereby
27 directed to post conspicuously for five (5) days on or near the Chamber door
28 of the Board of Directors of said county sanitation district, in the manner
29 and form required by said Code, a Notice Inviting Sealed Proposals or Bids
30 for doing the work herein ordered, and the Secretary is hereby directed to
31 publish twice in THE ORANGE CITY NEWS, a weekly newspaper printed
32 and published four times weekly and of general circulation in said county and

That pursuant to the provisions of the "Improvement Act of 1911, "
11 being Division 7 of the Streets and Highways Code of the State of California,
he duly posted conspicuously near the Chamber door of the Board of Directors
12 of said District, a NOTICE INVITING SEALED PROPOSALS for the construc-
tion of sanitary sewers and appurtenances and appurtenant work in "ASSESS-
13 MENT DISTRICT NO. 9" in said County Sanitation District No. 7 of Orange
County, as contemplated by Resolution of Intention No. 72-42-7, a copy of

3 Pursuant to statute and Resolution No. 72_43_7 adopted on
4 April 12 1972, by the Board of Directors of COUNTY SANITATION
5 DISTRICT NO. 7 OF ORANGE COUNTY, California, and on file in the office
6 of the Secretary of said sanitation district, ordering the work described in
7 said resolution, to-wit:
8 The construction of sanitary sewers and all appurtenances and
9 appurtenant work in connection therewith in "ASSESSMENT DISTRICT NO. 9"
10 in said County Sanitation District No. 7 of Orange County, all as more parti-
11 cularly described in Resolution of Intention No. 72-42-7, passed and adopted
12 by the Board of Directors of said sanitation district on March 21, 1972.

14 of Intention No. 72-42-7, and to the plans, profiles and drawings on file in
15 the offices of the Secretary and the Engineer of Work of said sanitation

19 and specifications heretofore approved by the Board of Directors of said
20 County Sanitation District No. 7 are incorporated herein and reference is here
21 by made thereto for a more particular description of said work.
22 Said Board of Directors has determined and declared that the contem-
23 plated work and improvement heretofore mentioned was, in the opinion of said
24 Board of Directors, of more than local or ordinary public benefit, and the
25 said Board of Directors has made the expense of said work chargeable upon a
26 district. For the particular description of said district, reference is hereby
27 made to said Resolution of Intention No. 72-42-7.
28 Said Board of Directors has determined and declared that serial bonds,
29 bearing interest at the rate of seven per cent (7%) per annum and extending

1 Division 7 of the Streets and Highways Code of the State of California, to
2 represent each assessment of Fifty Dollars ($50. 00) or more remaining

14 Said Board, pursuant to the Labor Code of the State of California,
15 did on the 14th day of July, 1971, adopt its Resolution No. 71-88, ascertaining
16 and determining the prevailing rate of wages to be paid for said public works
17 within said District, and said resolution is on file in the office of the Secretary
18 of said District, and for further particulars reference is hereby made thereto.
19 It shall be mandatory upon the contractor to whom the contract is
20 awarded and upon any subcontractor under him to pay not less than the rates
21 specified in said Resolution No. 71-88 to all laborers, workmen and mechanic
22 employed by them in the execution of the contract,
23 NOTICE IS HEREBY GIVEN inviting sealed proposals or bids for
24 doing all the work hereinbefore described and ordered in said Resolution
25 Ordering Work No. 72-43-7 , to be presented to the Secretary at the
26 Administrative Offices of said County Sanitation District No. 7, at 10844 Ellis
27 Avenue, Fountain Valley, California, up to the hour of 11: OOo' a.m.

28 Tuesday the 2nd day of May 1972, at which time the
29 bids and proposals so received will be opened, examined, received and
30 declared by the Secretary at a public meeting in the office of the Secretary.
31 The proposals or bids offered shall be accompanied by cash, a
32 cashier's check or a certified check payable to the order of said County

]. Sanitation District No. 7, or by a bond as required by law, for an amount
2 which shall be not less than ten per cent (10%) of the aggregate of the proposal
3 Each bid shall be made out on a form to be obtained of the Engineer of Work
4 of said District. In the event the bidder elects to furnish a bid bond, the bid
5 bond form must be of the forfeiture type and a form of this bond will be
6 furnished by the District for use or examination by the bidder.
7 All of the work will be done under the "Improvement Act of 1911. "
8 When the work is completed and accepted by the Board of Directors of said
9 District and the assessment is confirmed, a warrant, assessment and diagram
10 will be delivered to the contractor, or his assigns, for the total cost of the
11 work, including all incidental expenses which he has advanced to the District,
12 less any cash contributions made by the District.
13 NOTICE IS FURTHER HEREBY GIVEN to the bidders that the success-
14 ful bidder shall pay to the District at the time of executing the contract a
15 cash payment for incidental expenses incurred by the District up to the date
16 when the contract is signed, estimated to be $6, 000, 00. At the conclusion
17 of the work and at the time the contractor receives the warrant, assessment
18 and diagram, he shall pay to the District an additional cash payment for the
19 balance of the incidental expenses, estimated at $5, 400. 00.
20 The contractor to whom an award may be made will be required to
21 furnish with the contract two surety bonds, one faithful performance bond
22 in an amount equal to not less than one hundred per cent (100%) of the aggre-
23 gate amount of the bid, and one material and labor bond in an amount equal
24 to not less than one hundred per cent (100%) of the aggregate amount of the
25 bid,
26 The Board of Directors of said County Sanitation District No. 7
27 reserves the right to reject any and all bids and to waive any informality in
28 a bid not affected by law.

6 You have several copies of the Notice Inviting Bids. They have
not been stapled together as there are some resolution numbers
7 on pages 1 and 2 of the resolution ordering work to be filled in,
dates, etc.

9 2. PUBLICATION
10 The Notice Inviting Bids, when completed, is then to be published
twice in The Orange City News. The publications should be one week
11 r I�v" apart. The first publication must be completed not less than ten days
prior to the date fixed for opening bids. Be sure to have the newspaper
12 furnish you with three copies of the Affidavit of Publication and two
of these copies should be sent to me.

14 3, POSTING
15 A copy of the Notice Inviting Bids must also be posted on the
Chamber door or wherever you post these things near that door.
16 The posting should be put up not less than five days prior to the date
of the bid opening (not including the bid opening date). The Affidavit
17 of Posting should be completed after the posting by attaching a copy
of the Notice Inviting Bids to the Affidavit and filling in the date of
18 posting. Again, two copies are to be returned for my files.

PUBLICATION OF NOTICE OF AWARD OF CONTRACT

5 You are required to publish the Notice of Award of Contract in
6 The Orange City News. There must be two separate publications which
7 should be one week apart. Proof should be read and any corrections made
8 prior to first publication. After publication is completed, secure from
9 the newspaper three affidavits of publication. Keep one in the District's
10 file and send two to me.
11 The Contractor may sign the contract any time after the first
1.2 publication of the Notice of Award. , The contractor must sign the contract
13 within twenty-five (25) days after the first publication of Notice of Award .
14 We will be preparing the contract and bond forms and letter of
15 instructions to the contractor and will probably have these ready for mailing
16 to the contractor as soon as you notify us the date of the first publication of
17 the Notice of Award.

olution No. 71-88 ascertaining
and determining the prevailing
rate of wages to be paid for said
public works within said District,
and said resolution Is on file in
the office of.the Secretary of
said District, and for further
particulars reference is hereby
made thereto.
It shall be mandatory upon
the contractor to whom the con-
tract is awarded and upon any
subcontractor-under him to pay
not less than the rates specified
in said Resolution No. 71-88 to
all laborers,workmen and mech-
anics employed by them in the
execution of the'coptract.

the Secretary at the Administra-
tive Offices of said County San-
itation District No. 7, at 10844
Ellis Avenue, Fountain Valley,
California, up to the hour of 11
o'clock a.m.of Tuesday,the 2nd
day of May, 1972, at which
time the bids and proposals so
received will be opened,examin-
ed, received and declared by the
Secretary at a public meeting in
the office of the Secretary.
The proposals or bids offered
shall be accompanied by cash,a
cashier's check or a certified
check payable to the order of
said County Sanitation District
No. 7, or by a bond as required
by law, for an amount which
shall be not less than ton per
cent (10%) of the aggregate of
the proposal. Each bid shall be
made out on a form to be ob-
tained of the Engineer of Work of
said District.In the event the bid-
der elects to furnish a bid bond
the bid bond form must be oi'
the forfeiture type and it form of
this bond will be furnished by
the District for use or examin-
ation by the bidder.
All of the work will be done
under the "Improvement Act of
1911." When the work is com-
pleted and accepted by the
Board of Directors of said Dist-
rict and the assessment is con-
firmed,a warrant,assessment and
diagram will be delivered to the
contractor,or his assigns,for the
total cost of the work,including
all incidental expenses which he
has advanced to the District,
less any cash contributions made
.by the District.
NOTICE IS FURTHER
HEREBY GIVEN to the bidder
that the successful bidder shall
pay to the District at the time
of executing the contract a cash
payment for incidental expenses
incurred by the District up to the
date when the contract is signed,
i estimated to be $6,000.00. A
I the conclusion of the work and
at the time the contractor re-
ceives the warrant, assessment
and diagram, he shall pay to the
District an additional cash pay-
ment for the balance of the in-
cidental expenses, estimated a
$5,400.00.
The contractor to whom a
award may be made will be re-
quired to furnish with the con-
tract two surety bonds, on
faithful performance bond in a
amount equal to not less than
one hundred per cent(100%)o
the aggregate amount of the bid
and one material and labor bona
in an amount equal to not less
