Home My WebLink AboutResolution 1971 - 0131-5RESOLUTION NO.71-131-5 ORDERING DETACHMENT OF TERRITORY FROM TEE DISTRICT ~PROPOSEB DETACHMENT -NO.3 FROM COUNTY SANITATION DISTRICT NO.5 OF ORANGE COUNTY (PARCELS A AND B A RESOLUTION OF TEE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.5,OF ORANGE COUNTY,CALIFORNIA,ORDERING DETACHMENT OF TERRITORY FROM THE DISTRICT (PROPOSEB DETACHMENT NO.3 FROM COUNTY SANITATION DISTRICT NO.5 OF ORANGE COUNTY,PARCELS A AND B) The Board of Directors of County Sanitation District No.5, of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That application has heretofore been made to the District for detachment of territory from County Sanitation District No.5 by means of petition filed with said District by Irvine Company,the majority property owner of the area to be detached;and, Section 2 That a letter has been filed with the District stating the position of the minority property owner of the area to be detached;and, Section 3 That,pursuant to Division 1 (District Reorganization Act of 1965)of Title 6 of the Government Code of the State of California),application has heretofore been made to the Local Agency Formation Commission for detachment of said territory from County Sanitation District No.5’by means of Resolution No.71-56-5, filed with said Commission by the District;and, Section LI~That.the designation assigned by said Commission to the territory proposed to be detached is “Proposed Detachment No.3 from County Sanitation District No.5 of Orange County (Parcels A and B)”,the exterior boundaries of.which are described on Exhibit “A”and shown on Exhibit “B”attached hereto and by reference made a part of this resolution;and, Section 5 That the territory to be detached is uninhabited; and, Section 6 That the reason for detaching said property is for the-purpose of adjusting the District’s boundary by detaching 254.l~acres of real property as requested by the majority property owner,’sanitary service to said area to be provided by others;and, Section 7 That,as authorized by resolution of the Local Agency Formation Commission,pursuant to Divsion 1 (District Reorganization Act of 1965)of Title 6 of the Government Code, described hereinabove,be and it is hereby ordered detached from County Sanitation District No.5 subject to the conditions set forth by said resolutions;and, Section 8 That the territory to be detached be relieved from liability for payment of all or any part of principal,interest and any other amounts which may become due on account of all or any part of bonded indebtedness or other contracts of obligations, including but not limited to any judgements,of County Sanitation District No.5 and shall be relieved from the levying or fixing and the collection of any taxes or assessments as may be made for the payment thereof,as ordered by Local Agency Formation Commission.
