Home My WebLink AboutResolution 1971 - 0130-5RESOLUTION NO.71-130-5 ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT (PROPOSED ANNEXATION NO.5 TO COUNTY SANITATION DISTRICT NO.5,PARCELS A AND B A RESOLUTION OF TRE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.5,OF ORANGE COUNTY, CALIFORNIA,ORDERING ANNEXATION OF TERRITORY TO TBE DISTRICT (PROPOSED ANNEXATION NO.5 TO COUNTY SANITATION DISTRICT NO.5,PARCELS AANDB) *********.** The Board of Directors of County Sanitation District No.5,of Orange County,California, DOES REREBY RESOLVE,DETERMINE AND ORDER: Section 1 That application has heretofore been made to the Dist±’ict for annexation of territory to County Sanitation District No.5 by means of petition filed with said District by the Irvine Company,the r~ajority prop~rt~r owner of the area to be annexed; and, Section 2 That a letter h~s been filed with the District stating the position of the minority property owner of the area to be annexed;and, Section 3 That,pursuant to Division 1 (District Reorganization Act of 1965)of Title 6 of the Government Code of the State of California),application has heretofore been made to the Local Agency Formation Commission for annexation Of said territory to County Sanitation District No.5 by means of Resolution No. 71—55—5,filed with said Commission by the District;and, Section 4 That the designation assigned by said Commission to the territory proposed to be annexed is “Proposed Annexation No. 5 to County Sanitation District No.5 of Orange County (Parcels A and B)”,the e*terior boundaries of which are described on Exhibit “A”and shown on Exhibit “B’attached hereto and by reference made a part of this resolution;and, Section 5 That the territory to be annexed is uninhabited; and, Section 6 That the reason for annexation said property is for the purpose of adjusting the District’s boundary by annexing 215.80±aciës of real property to provide public sanitary sewer service to said territory;123.53±acres of which are presently within the boundaries of the Irvine Ranch Water District Sewer Improvement District No.1,which has been ordered detached from said district as a condition of this annexation;and, Section 7 That provisions for fees required to be paid as a condition of the annexation have been satisfied by prior agreement; and, Section 8 That,as authorized by resolution of the Local Agency Formation Commission,pursuant to Division I (District Reorganization Act of 1965)of Title 6 of the Government Code, Section 56261,the territory hereinbefore referred to and described hereinabove,be and it is hereby ordered annexed to County Sanitation District No.5 subject to the conditions set forth by said resolution.
