HomeMy WebLinkAboutResolution 1970 - 0017RESOLUTION NO.70-17--7 -- APPROVING REIMEURSEMENT AGREEMENT (NOT MASTER PLAN A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.7,OF ORANGE COUNTY,CALIF— ORNIA,APPROVING AND AUTHORIZING EXECUTION OF A SEWERAGE FACILITY REIMBURSEMENT AGREEMENT WITH GORDON MAYBEE AND HARRY G.LILJEBLAD The Board of Directors of County Sanitation District No. 7,of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That the certain Sewerage Facility Reimbursement Agreement between County Sanitation District No.7,of Orange Cointy, California,and Gordon Naybee and Harry G.Liljeblad,providing for reimbursement by the District for Rangeview Drive Extension Sewer, which said sewerage facility is more particularly described as: An 8”VCP Sanitary Sewer constructed in Deerhill Drive, Brier Land,and Rangeview Extension to serve a portion of Block 15,Irvine Subdivision in the County of Orange, is hereby approved and accepted;and, Section 2 That the Chairman and the Secretary of the District are hereby authorized and directed to execute said agreement on behalf of the District,in form approved by the General Counsel; and, Section 3 That reimbursement in the total amc~nt of $7,175.37 is hereby authorized to be made in accordance with the terms and coridit:~ons of said agreement and Schedule tIAtT attached hereto, from the Facilities Revolving Fund of the District. As I had discusscd with you in our meeting of January 27,1970,1 find that the Benefit Summary broakdo~m is most unfair to ~r.~Iayboo and myself.In view of the fact that we have invested $9,132~31 in this project over a lengthy and time concuming period of over two years,we feel more consideration is duo for the investment we are burdened with. The main points on which we differ are as follows: A.The acreage benefit of $200 per acre is not realistic. In a recent meeting hero in Cowan fleights the homenwncrs wore advised by the Sanitation District that r~ey ~iou1d incurr a cost of $3,000 per home if they wantc~a sewer system. B.~lo do nt feel that the four homa sites on the downhill side of our sewor line are a real potentiol for connection to our system since they will more logically go downhiill to another new line rather than uphill with a pumping unit. We therefore ask that the division of the benefit sui~nary be changed as follows: 1.Include all adjacent property owners fronting on the new sewer including lots that can install gravity house lateral via an casement. 2.An uphill lot fronting on the now sewer (full lot asscssrri~’nt) 3.An uphill lot that does not front on the now sower,but which hcs,or will have,access to the now sowar via a private house lateral ecsement~(half lot c~sessmont) SCHEDULE ~Au The above would mean that full-lot assessr~ients relative to Item 2 above would be $1,304.61 for the fol~owing homes: De~Ieese Martin 1(anno Fowler Anderson Maybec Half-lot assessements would be applicable to the following homes: Maude Liljeblad ~$652.30 each. The above lot assessment plan is fairest to all concerned and will permit each homeowner to connect on to a sewer line at a very reasonable cost. It will allow I~ssrs.I1aybee/Liljeb1ad a reasonable chance of return on our investment of $9,132.31. Cempared to the costs of $3,000 per home in lower Cowan Hotghts for a sewer connection it is most fair,just and moderate i~1coct. I appreciate very much the time you allowed inc to discuss this with you in your office.I hope that we have presented our side of the picture as an equitable one.
