Home My WebLink AboutResolution 1968 - 0057RESOLUTION NO.68-57-7 APPROVING ANNEXATION OF TERRITORY TO THE DISTRICT (Annexation No.14) A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.7 OF ORANGE COUNTY,CALIFORNIA,ORDERING ANNEXATION OF TERRITORY TO THE DISTRICT “NEWPORT AVENUE ANNEXATION NO.14 TO COUNTY SANITATION DIS TRICT NO.7” The Board of Directors of County Sanitation District No.7,of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That application has heretofore been made to the Local Agency Formation Commission for annexation of territory to County ,Sanitation District No.7,by means of a petition filed with said Commission;and, Section 2 That the designation assigned by said Commission to the territory proposed to be annexed is “Newport Avenue Annexation No.14 to County Sanitation District No.7”, the exterior boundaries of which are described on Exhibit “A~ attached hereto and by reference made a part of this resolution; and, Section 3 That the territory hereinbefore referred to is inhabited;and, Section 4 That the reason for annexing said territory is to provide public sanitary sewer service to said territory;and, Section 5 That,as authorized by Resolution of the Local Agency Formation Commission pursuant to Division 1 (District Reorganization Act of 1965)of Title 6 of the Government Code of the State of California,Resolution No.68-23-7 was adopted setting a time and place for the hearing on the proposed annexa tion.Notice of said hearing was given as provided by law. 1. The public hearing was held on the 23rd day of May,1968 at 4:00 o~clock p.m.at 10844 Ellis Avenue,Fountain Valley, California,at which time written protests were received and filed.Said public hearing was continued until the 19th day of June,1968 at said place at 5:00 p.m.at which time certain of the protests theretofore filed were witl-idrawr~and at which time it was determined that less than 25%of the number of land owners within the territory sought to be annexed,owning not more than 25%of the assessed value of land therein,had filed protests,and that less than 25%of the voting power of voters entitled to vote as a result of residing or owning property within said territory had filed protests. Section 6 That annexation fees in the amount of $8,766.60 are fixed as an annexation fee to be paid to County Sanitation District No.7 of orange County and that said sum of $8,766.60 shall be paid by the collection of a special and additional tax on the real property within said annexed territory in equal installments over a period of five taxable years. - Section 7.That the territory hereinabove referred to and described hereinabove as Newport Avenue Annexation No.14 to County Sanitation District No.7,be,and it is hereby ordered annexed to County Sanitation District No.7. 2. 1 Description of PROPOSED NEWPORT AVENUE ANNEXATION NO.14 TO Or~ANGE COUNT’~ SANITATION DISTRICT NO.7 2 3 PARCEL 1 4 Commencing at the centerline intersection of Newport Avenue,60.00 feet wide,and 5 Greenwald Lane,50.00 feet wide,as said intersection is shown in Book 53,page 25 of 6 Records of Survey,records of Orange County,California;thence olong the Centerline of 7 Newport Avenue,South 73°12’30”East 195.18 feet;thence North 35°22’30’East 31.65 8 feet to a point in the existing boundary of Orange Coui1ty Sanitation District No.7 as 9 established by Exclusion Resolution No.61—984 dated September 27,1961,said point being 10.also the most westerly corner of the Panorama Elementary School Site Annexation No.13 11 to said District as established March 23,1967 by Resolution No.67—32-7 and the True Point 12 of Beginning;thence along said existing boundary through the following described courses: 13 North 73°21’00’West 226.52 feet,North 35°10’00”East 109.71 feet,North 59°00’00” 14 West 267.68 feet,North 35°09’5Q1 West 223.00 feet,North 35°11’00”East 653.80 feet 15 and South 55°40’00”East 529.52 feet;thence leaving s&d boundary South 64°41’00”East 16 215.31 feet too point in the existing boundary of said District as established by said 17 Annexafion No.13;thence along the northwesterly line of said annexation the following 18 described courses:South 35°22’30’West 215.31 feet,North 64°41.’00”West 27.42 feet 19 and South 35°22’30’West 541 .65 feet to the True Point of Beginning. 20 PARCEL 2 . 21 Commencing at the centerline intersection of Newport Avenue,60.00 feet wide,and 22 Greenwald Lane,5b.00 feet wide,as said intersection is shown in Book 53,page 25 of 23 Records 0f Survey,records of Orange County,California;thence along the centerline of 24 Newport Avenue,South 73°12’30”East 195.18 feet;thence North 35°22’30’East 31.65 25 feet to the most westerly corner of said Annexation No.13 and said existing boundary;thence 26 along said b~undary the followjng described courses:South 73°21’00”East 175.44 Feet and 27 South 50°53’00”East 201 .44 feet to the most southerly corner of said annexation No.13 and 28 the True Point of Beginning;thence leaving said boundary (e~tcbIished by Resolution No.61—984 29 and along the exiSting District boundary as established by said Annexation No.13,North 35° 30 23’35’East 761 .71 feet;thence leaving said District boundary South 54°36’25”Ecst 453.45 31 feet;thence North 35°20’10”East 61 .23 feet;thence South 54°39’50 East 422.81 feet;
