HomeMy WebLinkAboutResolution 1967 - 0028RESOLUTION NO.67-28-2 AUTHORIZING ACCEPTANCE OF EASEMENTS A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2, OF ORANGE COUNTY,CALIFORNIA,AUTHORIZ ING ACCEPTANCE OF GRANTS OF EASEMENTS FROM FULLERTON ELEMENTARY SCHOOL DISTRICT The Board of Directors of County Sanitation District No.2, of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That the certain Temporary Working Easement dated February 23,1967,wherein FULLERTON ELEMENTARY SCHOOL DISTRICT grants to County Sanitation District No.2 a temporary working ease ment for the purpose of placing dirt,machinery,refuse and other materials and equipment relating to the construction of Rolling Hills Drive Sub-Trunk Sewer,Contract No.2-11-1,is hereby approved and accepted at no cost to the District;and, Section 2 That the certain real property over which said easement is granted is more particularly described on Schedule “A” attached hereto and made a part of this resolution;and, Section 3 That the certain permanent Grant of Easement and right of way dated February 23,1967,wherein FULLERTON ELEMENTARY SCHOOL DISTRICT grants to County Sanitation District No.2 a permanent easement for sewer purposes in connection with the con struction of Rolling Hills Drive Sub-Trunk Sewer,Contract No. 2—11-1,is hereby approved and accepted at no cost to the District; and, Section 4 That the certain real property over which said easement is granted is more particularly described on Schedule “B” attached hereto and made a part of this resolution;and, Section 5 That the Secretary of the District is hereby authorized and directed to record said permanent easement in the Official Records of Orange County,California. Excluding any portion of land which is not des cribed in Case No.138981 in the Superior Court of the State of California,in and for the County of Orange. PARCEL C: All that land lying within a 40 foot strip of land, the Northerly line of which is the Northerly line of said Section 24,the Southerly line of which Is a line lying 40 feet South of said Northerly line,lying East of the East line of State College Boulevard,and West of the Westerly boundary of that certain parcel of land as described in the Lis Pendens filed in the Dis trict Court of the United States in and for the South ern District of California,Central Division No.779-B Civil,a copy of which was recorded March 6,1940 in Book 1029,page 447 of Official Records. Schedule “A” SCHEDULE “B”TO RESOLUTION NO.67-28-2 PARCEL A: A portion of land in the Northwest quarter (NW 1/4) of the Northwest quarter (NW 1/4)of Section 24,Town ship 3 South,Range 10 West,,in the Rancho San Juan Cajori de Santa Ana,as said Section is shown on a map recorded in Book 51,page 7 of Miscellaneous Maps,re cords of Orange County,California,and said portion is further described in Case No.138981 of the Superior Court of the State of California,in and for the County of Orange,Fullerton School District of Orange County, California versus Anaheim Union Water Co.,et al;said parcels for sewer purposes being more particularly des cribed as follows: A fifteen foot (15’)wide sewer easement,lying 75 feet each side of the following described line: Beginning at the intersection of the North line of said Section 24 and the Easterly right of way line of North State College Boulevard,as same is described in a deed to the City of Fullerton,recorded FebruAry 5, 1965,in Book 7405,page 449 of Official Records,said point being distant South 89°57’27”East 70.18 feet measured along said North line of Section 24 from the Northwest corner of said Section 24;Thence along said North line South 89°57’27”East 539.61 feet to a point in the Westerly boundary of that certain parcel of land as described in the Lie Pendens filed in the District Court of the United States in and for the Southern District of California,Central Division No. 779-B Civil,a copy of which was recorded March 6, 1940 in Book 1029,page 447 of Official Re8ords;thence along last said Westerly boundary South 44 03’25” East 226.27 feet to the true point of beginning;thence North 57~23’45”West,a distance of 32.51 feet to an angle point;thence North 440 03’25”West along a line lying 7.5 feet Southwesterly from last said Westerly boundary described above,measured perpendicular to said Westerly boundary,a distance of 201.90 feet, more or less,to an intersection with the Northerly line of said Section 24. The side lines of said easement shall be lengthened or shortened so as to terminate at the true point of beginning arid the North line of said Section 24. Schedule “B”
