HomeMy WebLinkAboutResolution 1966 - 0146RESOLUTION NO.66-146-2 APPROVING ACQUISITION OF RIGHTS OF WAY A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.2,OF ORANGE COUNTY,CALIFORNIA,AUTHORIZING ACQUISITION OF RIGHT OF WAY DESIGNATED AS PARCELS 3-P AND 4-P IN ACTION NO.91526,RE:CONTRACT NO.2-9 The Board of Directors of County Sanitation District No.2, of Orange County,California, DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1 That C.Arthur Nisson,as General Counsel,be authorized to acquire for County Sanitation District No.2,by purchase,the right of way designated as Parcels 3-P and 4-P in Action No.91526 (County Sanitation District No.2 vs.Stephens etal),relative to construction of Cypress Avenue Sub-Trunk Sewer, Contract No.2-9. Section 2 That the General Counsel be authorized to purchase said Rights of Way which are more particularly described on Schedule “A”attached hereto,for the sum of $5,000.00 plus the cost of policy of title insurance. Section 3 The payment of the $5,000.00 is to be made to the owners thereof in the following proportions: Ann G.Butte $625.00 R.H.Gilnian,III 625.00 Albert Launer and Frederick T. Mason as Conservators of Helen G.Bowen 1,250.00 Josephine G.Tritt 1,250.00 Agnes G.Cruzen 1,250.00 $5~ooo . Section 4 That the General Counsel be authorized to sign the warrants and approve the form of Grant of Easement on behalf of the District as required to complete the above trans action. SCHEDULE “A”TO RESOLUTION NO.66-146-2 PARCEL 3-P A strip of land 30 feet in width lying 15 feet on each side of the following described centerline: Beginning in the West line of the Northeast one-quarter of the Southwest one-quarter of Section 24,Township 3 South,Range 10 West in the Raricho San Juan Cajon de Santa Ana,Orange County, California per map recorded in Book 51,page 7 of Miscellaneous Maps of said County,said West line being also the East line of Associated Road (40 feet wide)at a point distant thereon North 00 13’26”East 274.57 feet from the Southwest corner of said Northeast one-quarter and running thence North 770 13’26”East 389.47 feet;thence North 45° 540.14 feet;thence North 67° North 00 00’43”West 222.93 feet to the centerline of Imperial Highway and the East-and-West centerline of Section 18,TownshIp 3 South,Range 9 West,of said Rancho San Juan Cajon de Santa Ana.
