HomeMy WebLinkAboutResolution 1964 - 0172 << i - i i 1 RESOLUTION NO. 64-172-7 ! 2 A RESOLUTION OF INTENTION OF THE BOARD OF DIREC- TORS OF COUNTY SANITATION DISTRICT NO. 7 OF 3 ORANGE COUNTY, CALIFORNIA, PROPOSING TO CHANGE, MODIFY AND AMEND RESOLUTION OF INTENTION NO. 64- 4 114-7 OF SAID DISTRICT, AND THE PLANS, AND THE DIA- GRAM OF THE DISTRICT, HERETOFORE APPROVED FOR 5 AND PERTAINING TO "ASSESSMENT DISTRICT NO. 5-A, " WHICH SAID PLANS AND DIAGRAM ARE REFERRED TO AND 6 INCORPORATED IN SAID RESOLUTION OF INTENTION, AND TO ENLARGE THE BOUNDARIES OF THE ASSESSMENT DIS- i 7 TRICT AND MODIFY THE WORK TO BE DONE AS DESCRIBED AND SHOWN ON SAID PLANS AND IN SAID RESOLUTION OF 8 INTENTION; FIXING THE TIME AND PLACE OF HEARING UPON THE PROPOSAL TO SO CHANGE, MODIFY AND AMEND 9 SAID RESOLUTION OF INTENTION, PLANS, DIAGRAM AND I'I WORK AND DIRECTING THE SECRETARY OF THIS DISTRICT I 10 TO MAIL AND PUBLISH NOTICE OF SAID HEARING. 11 12 WHEREAS, the diagram or plat describing the boundaries of "ASSESS- ; 13 MEN'r DISTRICT NO. 5-A, " as heretofore approved by the Board of Directors 14 of County Sanitation District No. 7 of Orange County, California, and as re- 15 ferred to and incorporated in Resolution of Intention No. 64-114-7, adopted 16 August 12, 1964, does fix and establish the district and the boundaries thereof 17 benefited by the proposed acquisition, work and improvement and to be 18 assessed to pay the costs and expenses thereof, including incidental expenses; 19 and 20 WHEREAS, the Plans for the construction of sanitary sewer improve- 21 ments in "ASSESSMENT DISTRICT NO. 5-A, 11 as heretofore approved by the I 22 r f Directors f County Dis rict No 7 of Orange Count and Board o D to o Cou y t g y 23 as referred to and incorporated in said Resolution of Intention No. 64-114-7, 24 and the description of work as contained in said resolution of intention, and 25 the description of easements and rights-of-way to be acquired as described in 26 said resolution of intention, do provide among other things for the construction 27 of sanitary sewers and appurtenances and appurtenant work in certain ease- 28 ments therein described, and do also provide for certain work to be done as 29 therein described; and 30 WHEREAS, the Board of Directors of this District proposes to change, 31 modify and amend said plat and diagram of the assessment district so as to 32 include additional territory within the assessment district, and to change, LAW OFFICES OR RIMEL&HARVEY FOURTH FLOOR 1010 NORTH MAIN M -1- SANTA MIA.CALIFORNMi • i 1 1 � Y 11' 1i 1 1 modify and amend said plans and the work therein provided for, and the said 2 Resolution of Intention No. 64-114-7 so as to add additional territory, and to 3 add certain work, delete certain work, and relocate certain work, and to ac- i i 4 quire certain easements and rights-of-way necessary therefor, all as more 5 specifically set forth and described in Exhibit "A" attached hereto and made � 6 a part hereof for all purposes; and 7 WHEREAS, bids have not been invited for the doing of said work and 8 no contract has been awarded therefor; 9 NOW, THEREFORE, the Board of Directors of COUNTY SANITATION 1.0 DISTRICT NO. 7 OF ORANGE COUNTY, California, pursuant to the provisions 11 of Chapter 8. 5, Part 8, Division 7 of the Streets and Highways Code of the 12 State of California, does hereby RESOLVE AND ORDER as follows: 13 SECTION 1: That the said Board of Directors proposes to change, 14 modify and amend the sheets of the diagram or plat of the assessment district, 16 the sheets of the Plans, and the work therein described, and Sections 1, 2, 3, 16 4 and 6 of said Resolution of Intention No. 64-114-7, in the particulars as set 17 forth in Exhibit "A" attached hereto, to which reference is hereby made and 18 by such reference Exhibit "A" is incorporated herein and made a part hereof 19 for all purposes. That the proposed modified plat and diagram of the assess- 20 ment district and the proposed modified plan sheets referred to in said Exhi- 21 bit "A" have been received and filed by this Board of Directors and are on file 22 in the office of the Secretary of this District. ' 23 SECTION 2: That the said Board of Directors does hereby state and 24 determine that the said changes, modifications and amendments to the diagram 25 and boundaries of the assessment district, the Plans, the said Resolution of 26 Intention, and the work will result in an increase of approximately $50,000. 00 27 in the estimated cost of the construction work and in the estimated cost of the 28 entire work. That the original estimated cost of the entire work as set forth 29 in Section 6 of the said Resolution of Intention No. 64-114-7 was $362, 500. 00, 30 and the changes proposed to be made will not exceed the cost limitations as set 31 forth in Section 5234 of the Streets and Highways Code of the State of California 32 That said Resolution of Intention No. 64-114-7 and the plat or diagram of the LAW OFFIC"OF RiMEL&HARVEY FOURTH FLOOR -2- 1010 NORTH MAIN ST. 11 BANTA ANA.CALIFORNIAi 0 A I assessment district and the Plans hereinabove referred to are on file in the 2 office of the Secretary of this District. 3 SECTION 3: That Thursday, the 3rd day of December , 1964,I 4 at the hour of :00 o'clock . m. of said day, is hereby fixed as the day and 7 P Y i, 5 hour and the regular meeting place of the Board of Directors of County Sanita- I 6 tion District No. 7 of Orange County at 10844 Ellis Avenue, Fountain Valley, 7 = Orange County, California, is hereby fixed as the place when and where any ! 8 and all persons having any objection to the aforesaid proposal to change, 9 modify and amend the boundaries of the assessment district, the plans, the 10 work and the, said resolution of intention, may appear before said Board of 11 Directors and show cause why said changes, modifications and amendments 12 should not be adopted. Protests must be in writing and must contain a descrip- 13 tion of the property in which.each 'signer.._is interested, sufficient to identify 14 the same, and must be delivered to the Secretary of the Board of Directors 15 of County Sanitation District No. 7 of Orange County not later than the time 16 set for the hearing and no other protests or objections will be considered. If 17 the signer of any protest is not shown upon the last equalized assessment roll 18 of Orange County as the owner of the property described in the protest, then 19 such protest must contain or be accompanied by written evidence that such 20 I signer is the owner of the property so described. 21 SECTION 4: That this Board of Directors does hereby order and direc 22 the Secretary to give notice of the time and place of the aforesaid hearing by I 23 publishing this resolution once in THE TUSTIN NEWS, a weekly newspaper 24 of general circulation in County Sanitation District No. 7 of Orange County, 25 California. That said publication shall be made at least ten (10) days prior to 26 the date fixed herein for the hearing on the proposal to change, modify and 27 amend the description of the assessment district and the plat and diagram 28 thereof, the plans, the work and said resolution of intention. 29 The Secretary is further directed to mail a copy of this resolution to 30 all persons owning real property within the additional territory to be added to 31 the assessment district as described in Exhibit "A" attached hereto, whose 32 names and addresses appear upon the last equalized assessment roll or as LAW OFFICES OF RIMEL&HARVEY FOURTH FLOOR -3- I010 NORTH MAIN ST.
