RESOLUTION OF INTENTION NO. 64-114-7 A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 7 OF ORANGE COUNTY, CALI- FORNIA, DECLARING ITS INTENTION TO ORDER THE CON- STRUCTION OF SANITARY SEWERS AND APPURTENANCES AND ALL APPURTENANT WORK IN "ASSESSMENT DISTRICT NO. 5-A," IN SAID SANITATION DISTRICT; DECLARING ITS INTENTION TO ORDER THE ACQUISITION OF CERTAIN LANDS., RIGHTS-OF-WAY AND EASEMENTS NECESSARY IN CONNEC- TION WITH SAID WORK AND IMPROVEMENT AND TO ASSESS THE COSTS OF SAID ACQUISITION, INCLUDING THE INCI- DENTAL COSTS AND EXPENSES THEREOF, AS PART OF THE COST OF SAID WORK 'AND IMPROVEMENT; DECLARING THE ACQUISITION OF SAID LANDS., RIGHTS-OF-WAY AND EASE- MENTS AND THE WORK AND IMPROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIB- ING THE DISTRICT TO BE BENEFITED BY SAID ACQUISITION AND WORK AND IMPROVEMENT AND TO PAY THE COSTS AND EXPENSES THEREOF; FIXING THE TIME AND PLACE FOR HEARING OF OBJECTIONS TO SAID ACQUISITION., WORK AND IMPROVEMENT. This meeting will be held at the location specified In the notice. Thts assessment district Is one of several such districts proposed to be formed by the Directors of Sanitation District No. 7. A map of the proposed assessment district ts printed on the back of the enclosed notice. In 1962, a bond proposition amounting to some $3.7 mtt'lion was approved by the voters of Sanitation District No. 7. Bond funds were authorized to be used to Install the main trunk sewers and subtrunk sewers only within the Dlstrfet. This work has now been completed and the DI rectors--of the District are now proceeding with the program to Install local collector sewers. The Health Offlce1· of Orange County has ft led with the District a letter indicating the need for the Installation of local collector sewers in order to preserve the health and welfare of the community, With the growth of this area, which creates a much higher density of population, septic tanks and cesspools could and in some cases are a health hazard to the convnunity. Even . in areas where septic tanks operate satisfactorily, there is the possibility that the over-saturation of the soil will bring sewage wastes to the surface on lands at lower elevations. Following receipt of this letter, the Direc• tors of District No. 7 held numerous meetings to determine the most satis- factory method of financing the construction of local collector sewers. It was finally determined that the Improvement Act of 1911 financing procedure would be used. The unincorporated portion of Sanitation District No. 7 was then divided into six proposed assessment districts and petiti·ons were circulated within these districts to develop an indication as to the desires of the property owners. As soon as sufficient signatures were received, the Directors·authorized Boyle and Lowry as Engineer of Work to proceed with the preparation of the plans and specifications for the respective districts. · The plans and specifications for the collector sewers have been presented to the Board of Directors for their approval. Following the approval of the plans, the Board adopted the Resolution of Intention to form this assessm~nt district and all property owners, as shown on the last equalized assessment roll, are 6eing notified of the hearing by means of the enclosed notice. In addition to legal notices in the Tustin News and written notices sent to the property owners, large notices wi11 be posted along the line of construction within the proposed district. The hearing is for the purpose of allowing the property owners to express their desires relative to the project, at which time they may appear to pre- sent any written protests or statements relative to approval of the proposed assessment district. Following the hearing, the Board of Directors of the Sanitation District will make a determination whether to proceed with the formation of the. assessment district as proposed in the Resolution of Intention. If the Board elects to proceed with the construction of the collector sewers as proposed· in the plans and specifications, they will then advertise for public bids to be received by the Board for the construction of said facilities and the contract for the con- struction thereof will be awarded to the lowest responsible bidder. -1- -Following completion of your project, which should take approximate,y six ~(6) months, the total cost will be spread against your property and other proper-ties receiving benefit from the local sewers. Each property owner will then receive a written notice of the Engineer 1 s recommended property assessment, after which a hearing will be held at which time the property owners can be heard relative to the total assessment levied against their respective proper-ties. Following the confirmation of the assessment, the property owners will be given thirty (30) days In which to pay for their assessments in cash (all or part) or they may individually elect to let the assessment go to bond, pay-ment of which will be spread over approximately ten (10) years with each annual payment being one-tenth of the principal of the assessment and two semiannual interest payments at the rate of six (6) percent per year on the unpaid balance. The minimum amount of the ~ssessment that can go to bond is $50.00. Assessments under $50.00 must be paid in cash. • At the presentdme, it is not possible to determine the exact amount of the assessment against each parcel until the construction bids are received; how-ever, it is felt that the assessments within this assessment district should be approximately the same as those experienced within the City of Tustin which completed construction of local collector sewers in 1963 under the same Improvement Act of 1911. The assessments in the case of rectangular shaped lots in the City of Tustin were computed on the basis of $5.65 per front foot. Odd shaped lots were assessed according to adjusted or average widths for the front footage com- putation. In addition, each property receiving a house lateral under the project from the street sewer to the property line was charged $155.42 for the 4-inch lateral. Lots located in tracts where there were dry ~ewers which could be connected to a sewer main constructed by the assessment district were assessed a nominal charge of $50.00 a lot. Lots which fronted on both trunk or subtrunk sewers constructed by both Sanitation District No. 7 of Orange County and the assessment district were not assessed, since sewers were already available to serve such lots. However, if the property owner desired to con- nect to the assessment district sewer, he did so by the execution of a waiver petition, in which case the property was assessea the same as other properties within the assessment district. These assessment district charges will be com- parable for your area; however, it must be remembered that prices vary from job to job and these figures are submitted as guides. In addition to the above expenses, any property owner desiring to make a con-nection will bear the expense of making the house connection to the 4-inch lateral at the property line and pay the District's $50.00 connection charge for single residences. In addition, the property owner will be required to meet the requirements of the Orange County Building Department with regard to the abandonment of their individual disposal systems. (Pumping and backfilling septic tank, cesspools, seepage pits, etc.). As the District's Engineer of Work, Boyle and Lowry.will have ccmplete charge of the work.
