2 A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY
SANITATION DISTRICT NO. 7 OF ORANGE COUNTY, CALI-
3 FORNIA, DECLARING ITS INTENTION TO ORDER THE CON-
STRUCTION,OF SANITARY SEWERS AND APPURTENANCES
4 AND ALL APPURTENANT WORK IN "ASSESSMENT DISTRICT
NO. 2" IN SAID SANITATION DISTRICT; DECLARING ITS IN-
5 TENTION TO ORDER THE ACQUISITION OF CERTAIN LANDS,
RIGHTS-OF-WAY AND EASEMENTS NECESSARY IN CONNEC-
6 TION WITH SAID WORK AND IMPROVEMENT AND TO ASSESS
THE COSTS OF SAID ACQUISITION, INCLUDING THE INCI-
7 DENTAL COSTS AND EXPENSES THEREOF, AS PART OF THE
COST OF SAID WORK AND IMPROVEMENT; DECLARING THE
8 ACQUISITION OF SAID LANDS, RIGHTS-OF-WAY AND EASE-
MENTS AND THE WORK AND IMPROVEMENT TO BE OF MORE
9 THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIB-
ING THE DISTRICT TO BE BENEFITED BY SAID ACQUISITION
10 AND WORK AND IMPROVEMENT AND TO PAY THE COSTS
AND EXPENSES THEREOF; FIXING THE TIME AND PLACE
11 FOR HEARING OF OBJECTIONS TO SAID ACQUISITION, WORK
AND IMPROVEMENT.

14 THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT
15 NO. 7 OF ORANGE COUNTY, California, pursuant to the provisions of Article
16 4. 5, Chapter 3, Division 5 of the Health and Safety Code of the State of Califor-
17 nia, and to the provisions of the "Improvement Act of 1911, " being Division 7
18 of the Streets and Highways Code of the State of California, does RESOLVE as
19 follows:

ACQUISITION

22 SECTION 1: That the public interest, necessity and convenience
23 require and it is the intention of the Board of Directors of COUNTY SANITATION
24 DISTRICT NO. 7 OF ORANGE COUNTY to order the acquisition of the following
25 described lands, easements and rights-of-way, all of which are hereby deter-
26 mined to be necessary in connection with the work and improvement consisting
27 of the construction of sanitary sewers and all appurtenances and appurtenant
28 work, described in Section 2 hereof, for the said "ASSESSMENT DISTRICT NO.
29 2, f1 and to assess the costs of said acquisition, including all incidental expenses
30 thereof, as a part of the cost of said work and improvement, to-wit:
31 A perpetual easement and right-of-way for all public sewer purposes
32 in, over, under, along, through and across the following described parcels of

4 A strip of land five (5) feet in width consisting of the Northeasterly 5, 00
5 feet of Lot 9 and the Northwesterly extension of said strip of land across
6 Lot 11 to Cameron Lane as said Lots and Lane are shown on a map of
7 Tract 1743, recorded in Book 51, page 2 of Miscellaneous Maps of
8 Orange County.

26 of the Easterly 110 feet and the Southerly 10 feet of the Easterly 100

28 Parcel 102-250-27; and the Northerly and Northeasterly 15.feet of

18 Record of Survey map, excepting the Northerly 140 feet of the West
19 one-half and the Northerly 200 feet of the East one-half of said road ease-

29 of Orange County, said portion being shown as "Atchison, Topeka and
30 Santa Fe Railway right of way, as per deed recorded in 302-164 Deeds,
31 25 June 1917" on a map recorded in Book 32, page 16 of Records of Sur-

17 SECTION 3: That all of the said work and improvement to be done as
18 described in Section 2 of this Resolution shall be constructed upon the grades,
19 along the lines, between the points, of the dimensions, at the places and in the
20 manner shown on the plans, profiles and drawings for the construction of the
21 said work and improvement in "ASSESSMENT DISTRICT NO. 2" for County Sani-
22 tation District No. 7 of Orange County, consisting of 39 sheets, numbered 1 to
23 39, inclusive, and identified as "Construction Plans for Sanitary Sewers in
24 Assessment District No. 2, County Sanitation Districts of Orange County, Cali-
25 fornia, District No. 7, " dated February 1964, all of which plans are on file in
26 the office of the Secretary of County Sanitation District No. 7 of Orange County,
27 California, and in the office of the Engineer of Work, and except as otherwise
28 provided on said plans, in further accordance with the specifications for the con-
29 struction of said work and improvement, said specifications being on file in the
30 office of the Secretary of County Sanitation District No. 7 of Orange County,
31 California (and in the office of the Engineer of Work), and to which plans, pro-
32 files, drawings and specifications, heretofore approved by the Board of Director

8 SECTION 4: That the said acquisition of lands, easements and rights-
9 of-way for all public sewer purposes and the said contemplated work and im- .
10 provement, as aforesaid, is of more than local or ordinary public benefit and the

17 County of Orange, and in the incorporated territory of the City of Tustin, in-
18 cluded within the exterior boundary lines shown on the plat exhibiting the property
19 affected or benefited by or to be assessed to pay the costs and expenses of said
20 acquisition, work and improvement in said "ASSESSMENT DISTRICT NO. 2, "
21 which said plat consists of 14 sheets, numbered 1 to 14, inclusive, entitled
22 "Diagram exhibiting the property affected or benefited by and to be assessed to
23 pay the costs and expenses of the improvement of Sanitary Sewers in Assess-
24 ment District No. 2, County Sanitation Districts of Orange County, California,
25 District No. 7, February 1964, " and which was finally approved by the Board of
26 Directors of said County Sanitation District No. 7 of Orange County on the 1 lth
27 day of March, 1964, indicating by said boundary lines the extent of the territory
28 included within the proposed assessment district, and which map or plat is on
29 file in the office of the Secretary of County Sanitation District No. 7 of Orange
30 County and a copy of which is on file in the office of the Engineer of Work,

1 lanes, public roads, public drives, public courts, public alleys and all ease-
2 ments and rights-of-way therein contained belonging to the United States, and
3 also excepting therefrom any lot or parcel of land belonging to the State of Cali-
4 fornia or to the County of Orange or to the City of Tustin or to the Orange County
5 Flood Control District, which lot or parcel of land is in use for the performance
6 of any public function, and all such property above mentioned and described as
7 being excepted from the area shall be omitted from the assessment hereinafter
8 to be made to cover the costs and expenses of such acquisition, work and im-
9 provement. Lots or parcels of land owned by school boards, school districts
10 or other public or private educational authorities, whether or not devoted to
11 public or school uses and purposes, shall not be excepted or omitted from said
12 district or from said assessment, but shall be included in said assessment.
13 Reference is hereby made to said plat for further, full and more particular des-
14 cription of the said assessment district, and the said plat so on file shall govern
15 for all details as to the extent of said assessment district.
16 DESCRIPTION OF BONDS
17 SECTION 5: That serial bonds, bearing interest at the rate of six
18 percent (616) per annum, shall be issued to represent each assessment of Fifty
19 Dollars ($50. 00) or more, remaining unpaid for thirty (30) days after the date
20 of recording the warrant. Said serial bonds shall extend over a period ending
21 nine (9) years from the second day of January next succeeding the next Septem-
22 ber 1st following their date. Payments on the principal of unpaid assessments
23 and interest thereon shall be made by property owners to the County Treasurer
24 and the same shall be disbursed by said County Treasurer, all as provided in
25 the "Improvement Act of 1911" hereinafter referred to.
26 This Board of Directors does hereby elect and determine to have the
27 redemption provisions of said bonds provide a premium of five per cent (5%) of
28 the unmatured principal in accordance with the provisions of Section 6464 of the
29 Streets and Highways Code of the State of California.

TIME AND PLACE OF HEARING

13 SECTION 7: NOTICE IS HEREBY GIVEN that on the ]L5th day of
14 April , 1964, at the hour of 7;30 o'clock p,m. , in the Cham-
15 bers of the Board of Directors of County Sanitation District No. 7 of Orange
16 County, 10844 Ellis Avenue, Fountain Valley, California, any and all persons
17 having any objections to the proposed acquisition, work or improvement, or to
18 the extent of the assessment district, or to the proposed grades, may appear
19 and show cause why said acquisition and/or said work should not be done or
20 carried out in accordance with this Resolution of Intention. Protests must be
21 in writing and must contain a description of the property in which each signer
22 thereof is interested, sufficient to identify the same, and must be delivered to
23 the Secretary of the Board of Directors of County Sanitation District No. 7 of
24 Orange County prior to the time set for the hearing and no other protests or
25 objections will be considered. If the signer of any protest is not shown upon the
26 last equalized assessment roll of Orange County as the owner of the property
27 described in the protest, then such protest must contain or be accompanied by
28 written evidence that such signer is the owner of the property so described.

1 State of California, designated as the "Improvement Act of 1911, " being Division
2 7 of the Streets and Highways Code of the State of California. Prior to the adop-
3 tion of this resolution, the Board of Directors received a written communication
4 from the Health Officer of the County of Orange, written pursuant to the provi-
5 sions of Section 2808 of the Streets and Highways Code of the State of California,
6 being a part of the "Special Assessment Investigation, Limitation and Majority
7 Protest Act of 1931"; that thereafter and in accordance with the provisions of
8 said Section 2808 of the said Streets and Highways Coder the Board of Directors
9 of said County Sanitation District No. 7 of Orange County duly and regularly
10 adopted its Resolution No. 64-24-7 on February 13, 1964, determining that the
11 acquisition and work herein provided for are necessary as a health measure and
12 determining to proceed under the provisions of the "Improvement Act of 1911"
13 without further reference to or application of the provisions of the said "Special
14 Assessment Investigation, Limitation and Majority Protest Act of 1931. "

PROPERTY OWNERS NOT TO TAKE CONTRACT

17 SECTION 9: Pursuant to the provisions and the authority granted by
18 Section 5260 of the Streets and Highways Code of the State of California, the
3.9 Board of Directors of County Sanitation District No. 7 of Orange County does
20 hereby determine and declare that, in the opinion of this Board of Directors,
21 the public interest will not be served by allowing the property owners to take the
22 contract and the property owners will not be allowed or permitted to take the
23 contract. The Board of Directors of said County Sanitation District No. 7 of
24 Orange County does further hereby determine and declare that the Contractor to
25 whom the contract is awarded may sign said contract immediately upon the award
26 of the contract and must execute said contract and file the required bonds with
27 said County Sanitation District No. 7 within twenty-five (25) days after the date
28 of first publication of notice of award of contract.

3 of Intention shall be published by the Secretary, in the manner and form pro-

6 The Secretary is directed to mail notices of the adoption of this Reso-
7 lution of Intention to all persons owning real property proposed to be assessed,
8 whose names and addresses appear on the last equalized assessment roll for
9 County taxes, or as known to the Secretary, all in the manner and form pro-
10 vided for under Sections 5070, 5194 and 5195 of the said "Improvement Act of

21 SECTION 12: That the Secretary is directed to endorse on the ori-
22 ginal and on at least one copy of the map or plat of the assessment district as
23 referred to in Section 4 hereof his certificate evidencing the date and adoption of
24 this Resolution of Intention, and he is further directed to file the original of
25 such map or plat in his office and within fifteen (15) days after the adoption of
26 this resolution and in no event later than fifteen (15) days prior to the date of
27 hearing as provided in Section 7 hereof, he is further directed to file a copy of
28 said map or plat, with his endorsement thereon, with the County Clerk of Orange
.29 County, California, all in the manner and form provided for in Section 3111 of
30 the Streets and Highways Code of the State of California.

and upon all the streets and highways existing within the district proposed to
18 be assessed, copies of the passage of said Resolution of Intention, said notice
consisting of copies of the Resolution of Intention headed "NOTICE OF IM-
19 PROVEMENT, ' said heading being in letters each of which was not less than
one inch in height, a copy of said notice being attached hereto and made a part
20 hereof; that all of said notices were posted less than 300 feet in distance apart
from each other and not less than three of said notices in all were posted on
21 each and every street,and highway situated within the district to be assessed
for said work and improvement, and that there were a total of 217
