HomeMy WebLinkAboutResolution 1964 - 0035 r x r r . l RESOLUTION OF INTENTION NO. 64-35-7 2 A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 7 OF ORANGE COUNTY, CALI- 3 FORNIA, DECLARING ITS INTENTION TO ORDER THE CON- STRUCTION,OF SANITARY SEWERS AND APPURTENANCES 4 AND ALL APPURTENANT WORK IN "ASSESSMENT DISTRICT NO. 2" IN SAID SANITATION DISTRICT; DECLARING ITS IN- 5 TENTION TO ORDER THE ACQUISITION OF CERTAIN LANDS, RIGHTS-OF-WAY AND EASEMENTS NECESSARY IN CONNEC- 6 TION WITH SAID WORK AND IMPROVEMENT AND TO ASSESS THE COSTS OF SAID ACQUISITION, INCLUDING THE INCI- 7 DENTAL COSTS AND EXPENSES THEREOF, AS PART OF THE COST OF SAID WORK AND IMPROVEMENT; DECLARING THE 8 ACQUISITION OF SAID LANDS, RIGHTS-OF-WAY AND EASE- MENTS AND THE WORK AND IMPROVEMENT TO BE OF MORE 9 THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIB- ING THE DISTRICT TO BE BENEFITED BY SAID ACQUISITION 10 AND WORK AND IMPROVEMENT AND TO PAY THE COSTS AND EXPENSES THEREOF; FIXING THE TIME AND PLACE 11 FOR HEARING OF OBJECTIONS TO SAID ACQUISITION, WORK AND IMPROVEMENT. 3.2 13 14 THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT 15 NO. 7 OF ORANGE COUNTY, California, pursuant to the provisions of Article 16 4. 5, Chapter 3, Division 5 of the Health and Safety Code of the State of Califor- 17 nia, and to the provisions of the "Improvement Act of 1911, " being Division 7 18 of the Streets and Highways Code of the State of California, does RESOLVE as 19 follows: 20 ACQUISITION 21 22 SECTION 1: That the public interest, necessity and convenience 23 require and it is the intention of the Board of Directors of COUNTY SANITATION 24 DISTRICT NO. 7 OF ORANGE COUNTY to order the acquisition of the following 25 described lands, easements and rights-of-way, all of which are hereby deter- 26 mined to be necessary in connection with the work and improvement consisting 27 of the construction of sanitary sewers and all appurtenances and appurtenant 28 work, described in Section 2 hereof, for the said "ASSESSMENT DISTRICT NO. 29 2, f1 and to assess the costs of said acquisition, including all incidental expenses 30 thereof, as a part of the cost of said work and improvement, to-wit: 31 A perpetual easement and right-of-way for all public sewer purposes 32 in, over, under, along, through and across the following described parcels of LAW OFFICES OF RIMEL & HARVEY FOURTH FLOOR 1010 NORTH MAIN ST. - - SANTAANA.CALIFORNIA ' e • t 1 real property situated in the County of Orange, State of California, and as shown 2 on the Plans, to-wit: 3 (1) Easement No, 1: 4 A strip of land five (5) feet in width consisting of the Northeasterly 5, 00 5 feet of Lot 9 and the Northwesterly extension of said strip of land across 6 Lot 11 to Cameron Lane as said Lots and Lane are shown on a map of 7 Tract 1743, recorded in Book 51, page 2 of Miscellaneous Maps of 8 Orange County. 9 The above described easement is over the Northeasterly 5. 00 feet of 10 Assessor's Parcels 102-240-35 and 102-240-37. 11 (2) Easement No. 2: 12 Parcel No. 1: 13 The Easterly 20. 00 feet of the Westerly 123. 62 feet of the Southerly 14 300 feet of Lot 26, Vanderlip and Rowan Tract, per map recorded in 15 Book 1, page 27 of Miscellaneous Maps, records of Orange County. 16 Parcel No. 2: 17 The Southerly 10 feet of said Lot 26, except the Westerly 123. 62 feet 18 and the Easterly 122. 61 feet, . 19 Parcel No. 3: 20 The Northerly and Northeasterly 15. 00 feet of that certain parcel of 21 land, described in a deed recorded January 8, 1958, in Book 4158, 22 page 460 of Official Records of said County. 23 The above described easement is over the Westerly 10. 00 feet of 24 Assessor's Parcel 102-250-78; all of Assessor's Parcel 102-250-86; 25 The Easterly 10 feet of the Westerly 113. 62 feet, the Westerly 10 feet 26 of the Easterly 110 feet and the Southerly 10 feet of the Easterly 100 27 feet of Assessor's Parcel 102-250-85; the Southerly 10 feet of Assessor's 28 Parcel 102-250-27; and the Northerly and Northeasterly 15.feet of 29 Assessor's Parcel 102-250-77. 30 (3) Easement No. 3: 31 The Westerly 30 feet of the Easterly 122. 61 feet of the Southerly 446. 00 32 feet of Lot 26 of the Vanderlip and Rowan Tract,, per map recorded in LAW OFFICES of RIMEL Bic HARVEY FOURTH FLOOR 1010 NORTH MAIN ST. SANTA ANA.CALIFORNIA -2- 1 Book 1, page 27 of Miscellaneous Maps, records of Orange County, the 2 east line of said lot being shown on a map of a portion of Lot 27 of said 3 Tract, recorded in Book 54, page 26 of Records of Survey of Orange 4 County. 5 The above described easement is over the Westerly 30 feet of Assessor's 6 Parcels 102-250-63, 102-250-65, 102-250-66, 102-250-67, 102-250-68, 7 and 102-250-69. 8 (4) Easement No. 4: 9 Parcel No. 1: 3.0 That certain "20-foot road easement" shown on a map of a portion of Lot 11 27 of the supplementary map of Vanderlip and Rowan Tract, per map 12 recorded in Book 1, page 27 of Miscellaneous Maps, Records of Orange 13 County, and the southerly extension thereof to the south line of said lot 14 as said easement and south line are shown on a map thereof, recorded 15 in Book 54, page 26 of Records of Survey of said County, 16 Parcel No, 2: 17 That certain 250. 18 foot long "30-foot road easement" as shown on said 18 Record of Survey map, excepting the Northerly 140 feet of the West 19 one-half and the Northerly 200 feet of the East one-half of said road ease- 20 ment. 21 The above described easement is over the Easterly 20 feet of Assessor's 22 Parcels 102-250-81, 102-250-82, 102-250-83, and 102-250-84; the Wes- 23 terly 15 feet of Assessor's Parcel 102-250-52 and the Easterly 15 feet of 24 Assessor's Parcel 102-250-22. 25 (5) Easement No. 5: 26 A strip of land of varying widths described as follows: 27 Beginning at the west corner of that portion of Lot 1, Block 12, Irvine's 28 Subdivision, per map recorded in Book 1, page 88 of Miscellaneous Maps, 29 of Orange County, said portion being shown as "Atchison, Topeka and 30 Santa Fe Railway right of way, as per deed recorded in 302-164 Deeds, 31 25 June 1917" on a map recorded in Book 32, page 16 of Records of Sur- 32 vey of said County, and running thence North 39° 50' 05" East along the LAW OFFIc OR RIMEL & HARVEY FOURTH FLOOR IOiO NORTH MAIN ST. SANTA ANA•CALIFORN 1A -1 0- 1 "B" STREET STREET 2 between Mitchell Avenue and a point approximately 410 feet northerly of the 3 intersection of Mitchell Avenue and "B" Street (including work in the intersection 4 of Mitchell Avenue and "B" Street), as shown on Sheet 38 of said Plans; and in '1 C" STREET 6 between the centerline of Mitchell Avenue and a point approximately 305 feet 7 northerly of the centerline of Mitchell Avenue (including work in the intersection 8 of "C" Street and Mitchell Avenue), as shown on Sheet 38 of said Plans, and in 9 HO LT AVENUE 10 between the easterly prolongation of the northerly right-of-way line of that por- 11 tion of Vanderlip Avenue west of Holt Avenue and the westerly prolongation of 12 the southerly right-of-way line of that portion of Vanderlip Avenue east of Holt 13 Avenue, as shown on Sheet 19 of said Plans. 14 15 PLANS# PROFILES, DRAWINGS AND SPECIFICATIONS 16 17 SECTION 3: That all of the said work and improvement to be done as 18 described in Section 2 of this Resolution shall be constructed upon the grades, 19 along the lines, between the points, of the dimensions, at the places and in the 20 manner shown on the plans, profiles and drawings for the construction of the 21 said work and improvement in "ASSESSMENT DISTRICT NO. 2" for County Sani- 22 tation District No. 7 of Orange County, consisting of 39 sheets, numbered 1 to 23 39, inclusive, and identified as "Construction Plans for Sanitary Sewers in 24 Assessment District No. 2, County Sanitation Districts of Orange County, Cali- 25 fornia, District No. 7, " dated February 1964, all of which plans are on file in 26 the office of the Secretary of County Sanitation District No. 7 of Orange County, 27 California, and in the office of the Engineer of Work, and except as otherwise 28 provided on said plans, in further accordance with the specifications for the con- 29 struction of said work and improvement, said specifications being on file in the 30 office of the Secretary of County Sanitation District No. 7 of Orange County, 31 California (and in the office of the Engineer of Work), and to which plans, pro- 32 files, drawings and specifications, heretofore approved by the Board of Director LAW OFFICES OF RIMEL &HARVEY FOURTH FLOOR 1010 NORTH MAIN ST. Lots or parcels of land owned by school boards, school districts 10 or other public or private educational authorities, whether or not devoted to 11 public or school uses and purposes, shall not be excepted or omitted from said 12 district or from said assessment, but shall be included in said assessment. 13 Reference is hereby made to said plat for further, full and more particular des- 14 cription of the said assessment district, and the said plat so on file shall govern 15 for all details as to the extent of said assessment district. 16 DESCRIPTION OF BONDS 17 SECTION 5: That serial bonds, bearing interest at the rate of six 18 percent (616) per annum, shall be issued to represent each assessment of Fifty 19 Dollars ($50. 00) or more, remaining unpaid for thirty (30) days after the date 20 of recording the warrant. Said serial bonds shall extend over a period ending 21 nine (9) years from the second day of January next succeeding the next Septem- 22 ber 1st following their date.
