HomeMy WebLinkAboutResolution 1963 - 0165 d t 1 RESOLUTION NO.63-165- 2 A RESOLUTION OF THE BOARD OF DIRECTORS OF DISTRICT NO. 7, COUNTY SANITATION DIS- 3 TRICTS OF ORANGE COUNTY, CALIFORNIA, ORDERING THE WORK DESCRIBED IN RESOLUTION 4 OF INTENTION NO. 63-145-7. 5 6 THE BOARD OF DIRECTORS of DISTRICT NO. 7, COUNTY SANITA- 7 TION DISTRICTS OF ORANGE COUNTY, CALIFORNIA, pursuant to the provi- 8 sions of the "Improvement Act of 1911, 11 being Division 7 of the Streets and 9 Highways Code of the State of California, does RESOLVE as follows: 10 That the public interest and convenience require the work hereinafter 11 mentioned to be done and, therefore, the said Board of Directors hereby orders 12 the following work to be done and improvements to be made in said District No. 13 7, to-wit: 14 The construction of sanitary sewers and all appurtenances and all ap- 15 purtenant work in "ASSESSMENT DISTRICT NO. 411 in District No. 7, County 16 Sanitation Districts of Orange County, California, all as more particularly des- 17 cribed in Resolution of Intention No. 63-145-7, passed and adopted by the 18 Board of Directors of said district on the 26th day of September, 1963. 19 For further particulars, reference is hereby made to said Resolution 20 of Intention No. 63-145-7, and to the plans, profiles and drawings on file in 21 the offices of the Secretary and the Engineer of Work of said district, and to the 22 specifications for the said work heretofore adopted by the said Board of Director 23 and on file in the offices of the Secretary and the Engineer of Work for said dis- 24 trict, and all of said plans, profiles, drawings and specifications heretofore 25 approved by the Board of Directors of said District No. 7 are incorporated here- 26 in and reference is hereby made thereto for a more particular description of 27 said work. 28 Said Board of Directors has determined and declared that the contena- 29 plated work and improvement heretofore mentioned was, in the opinion of said 30 Board of Directors, of more than local or ordinary public benefit, and the said 31 Board of Directors has made the expense of said work chargeable upon a district. 32 For the particular description of said district, reference is hereby made to said LAW OFFICES OF RIMEL & HARVEY FOURTH FLOOR 1010 NORTH MAIN ST. SAWA ANA.CALIFORNIA -1- 1 Resolution of Intention No. 63=145-7. 2 Said Board of Directors has determined and declared that serial bonds, 3 bearing interest at the rate of six per cent (60/6) per annum and extending over a 4 period ending nine (9) years from the second day of January next succeeding the 5 next September 1st following their date, will be issued hereunder in the manner 6 provided by the "Improvement Act of 1911, " being Part 5, Division 7 of the 7 Streets and Highways Code of the State of California, to represent each assess- 8 ment of Fifty Dollars ($50. 00) or more remaining unpaid for thirty (30) days 9 after the date of recording the warrant. 10 All of the work herein ordered shall be done and carried through in 11 pursuance of an Act of the Legislature of the State of California, designated the 12 "Improvement Act of 1911, " being Division 7 of the Streets and Highways Code. 13 All of the said work shall be done under the direction and to the satis- 14 faction of the Engineer of Work and all of the materials used shall comply with 15 the specifications and be to the satisfaction of the Engineer of Work. 16 The Secretary of said District No. 7 is hereby directed to post conspi- 17 cuously for five (5) days on or near the Chamber door of the Board of Directors 18 of said county sanitation district, in the manner and form required by said Code, 19 a Notice Inviting Sealed Proposals or Bids for doing the work herein ordered, 20 and the Secretary is hereby directed to publish twice in THE TUSTIN NEWS, 21 a weekly newspaper published and circulated in said county and district and 22 hereby designated by the said Board of Directors for that purpose, a Notice 23 inviting such proposals or bids for doing the said work and referring to speci- 24 fications on file. 25 ADOPTED SIGNED AND APPROVED this day of � 26 1963. 27 28 / ATTEST: Chair 29 30 Secretary 31 32 LAW OFFICES OF RIMEL & HARVEY FOURTH FLOOR 1010 NORTH MAIN ST. Said Board of Directors, together with the Boards of Directors of other county sanitation districts of Orange County, California, and pursuant to the Labor Code of the State of California, did on the 10th day of July, 1963, adopt �0 a joint Resolution No. 63-104, ascertaining and determining the prevailing rate 11 of wages to be paid for all public works within said county sanitation districts 32 from and after the date of said resolution, and said resolution has not been 13 amended or repealed and is in full force and effect and is on file in the office 3.4 of the Secretary of said District, and for further particulars reference is 15 hereby made thereto. 16 It shall be mandatory upon the contractor to whom the contract is 17 awarded and upon any subcontractor under him to pay not less than the rates 18 specified in said Resolution No. 63-104, to all laborers, workmen and mechan- 19 ics employed by them in the execution of the contract. 20 NOTICE IS HEREBY GIVEN inviting sealed proposals or bids for doing 21 all the work hereinbefore described and ordered in said Resolution Ordering 22 Work No. 63-165-7, to be presented to the Secretary at the office of the Secre- 23 tart' of said County Sanitation District No. 7, 1104 West 8th Street, Room 239, 24 Santa Ana, -California, up to the hour of 4:00 o'clock p, m, of Wednesday, the 25 4th day of December, 1963. 26 The proposals or bids offered shall be accompanied by cash, a cashier' 27 check or a certified check payable to the order of said County Sanitation District 28 No. 7, or by a bond as required by law, for an amount which shall not be less 29 than ten per cent (1076) of the aggregate of the proposal. Each bid shall be made 30 out on a form to be obtained of the Engineer of Work of said district. AMA ANA.CALIFORNIA -2- 1 use or examination by the bidder. 2 All of the work will be done under the "Improvement Act of 1911.. " 3 When the work is completed and accepted by the Board of Directors of said Dis- 4 trict and the assessment is confirmed, a warrant, assessment and diagram 5 will be delivered to the Contractor, or his assigns, for the total cost of the 6 work, including all incidental expenses which he has advanced to the City, less 7 any cash contributions made by the City. 8 NOTICE IS FURTHER HEREBY GIVEN to the bidders that the success- 9 ful bidder shall pay to the District at the time of executing the contract a cash 10 payment for incidental expenses incurred by the District up to the date when the 11 contract is signed, estimated to be $119, 240. 00, in which said amount there is 12 included the sum of $10, 000. 00, which is the estimated cost of acquisition of 13 necessary lands, easements and rights-of-way. At the conclusion of the work 14 and at the time the contractor receives the warrant, assessment and diagram, 15 he shall pay to the District an additional cash payment for the balance of the 16 incidental expenses. 17 The contractor to whom an award may be made will be required to 18 furnish with the contract two surety bonds, one faithful performance bond in an 19 amount equal to not less than one hundred per cent (10016) of the aggregate 20 amount of the bid, and one material and labor bond in anamount equal to not 21 less than one hundred per cent (10016) of the aggregate amount of the bid. 22 The Board of Directors of said County Sanitation District No. 7 re- 23 serves the right to reject any and all bids and to waive any informality in a bid 24 not affected by law. 25 DATED this 30th day of October, 1963. 26 FRED A.
