A RESOLUTION OF THE BOARD OF DIRECTORS OF DISTRICT
NO. 7, COUNTY SANITATION DISTRICTS OF ORANGE COUNTY,
· CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE
CONSTRUCTION OF SANITARY SEWERS AND APPURTENANCES
AND ALL APPURTENANT WORK IN "ASSESSMENT DISTRICT NO.
3-A," IN SAID SANITATION DISTRICT; DECLARING ITS INTEN-
TION TO ORDER THE ACQUISITION OF CERTAIN LANDS, RIGHTS-
OF-WAY AND EASEMENTS NECESSARY IN CONNECTION WITH
SAID WORK AND IMPROVEMENT AND WITHIN THE LIMITS
ALLOWED BY ·LAW TO ASSESS THE COSTS OF SAID ACQUISI-
.TION, INCLUDING THE INCIDENTAL COSTS AND EXPENSES
THEREOF, AS PART OF THE COST OF SAip WORK AND IM-
PROVEMENT; DECLARING THE ACQUISIT~ON OF SAID LANDS,
RIGHTS-OF-WAY AND EASEMENTS AND THE WORK AND IM-
PROVEMENT TO BE OF MORE THAN LOCAL OR ORDINARY
PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE
BENEFITED BY SAID ACQUISITION AND WORK AND IMPROVE-
MENT AND TO PAY THE COSTS AND EXPENSES THEREOF;
AND FIXING THE TIME AND PLACE FOR HEARING OF OBJEC-
TIONS TO SAID ACQUISITION, WORK AND IMPROVEMENT.
THE BO.ARD OF DIRECTORS OF DISTRICT NO. 7, COUNTY SANITA-
TION DISTRICTS OF ORANGE COUNTY, CALIFORNIA, pursuant to the provi-
sions of Article 4. 5,. Chapter 3, Division 5 of the Health and Safety Code of the
State of California.-and to the provisions of the "Improvement Act of 1911,"
being Division 7 of the Streets and Highways Code of the State of California,
does RESOLVE as follows;
ACQUISITION
SECTION 1: That the public interest, necessity and convenience
require and it is the intention of District No. 7, County Sanitation Districts of
Orange County, California, to order the acquisition of the following described
lands, easements and rights-of-way, all of which are hereby determined to be
necessary in connection with the work and improvement consisting of the con-
struction of sanitary sewers and all appurtenances and appurtenant work, des-
cribed in Section 2 hereof,, for the said "ASSESSMENT DISTRICT NO. 3-A,,"
and within the limits allowed by law to assess the costs of said acquisition,
inc~uding all incidental expenses thereof, as a part of the col>t of said work and
improvement, to-wit:
A perpetual easentent and right-of-way for all public sewer purposes

A strip of land 15. 00 feet in width, the southerly line of which is the

(2) Easement No. 2:
Those portions of Lots 10 and 15, Block B of the AB Chapman Tract,
as shown on a map recorded in Book 1, pages 23 and 24, Miscellan-
eous Maps, records of Orange County, California, described as fol-·
lows:
A strip of land 10 feet in width, the northerly line of which is the
southerly line of Tract 4014, as shown on a map recorded in Book
149, page 21 of Miscellaneous Maps, records of Orange County,
California,, lying between the southerly prolongation of the west line
of Loretta Drive, as shown on said map, and the southerly prolonga-
tion of the east line of said Tract 4014.
The Southerly 25 feet of Tract 2933, as shown on· a map. recorded
in Book 125, page 44, Miscellaneous Maps, records of Orange
County, California.
The Westerly 10 feet of the Easterly 340. 42 feet of tn.e Northerly
10 feet of Lot 15 of said AB Chapman Tract.
The above descriqed easement is over the Easterly 179. 53 feet of

with the. north line of that portion of Rainier Drive shown on said
map as 50 feet in width; th~nce along said southerly prolongation,

with the northeasterly line of Lot 9 of Tract 1.816, as shown on a
map thereof, recorded in Book 51, page 48 of said Miscellaneous
Maps; thence North 42° 48' 42 11 West along said northeasterly line

The east and northeast line of which shall be prolonged or shortened
so as to form a continuous strip, 15 feet in width, from said north
line of Rainier Drive to said southeasterly line of Fairmont Way.
The above described easement is over the Westerly 15 feet of
Assessor's Parcel No. 102-402-19, a portion of Assessor's Parcel
No. 102-031-34, and a portion of the Southwesterly 15 feet of
Assessor's Parcel No. 102-031-35.

That portion of Lot 16, Block C, of the AB Chapman Tract, as

SECTION 3: That all of the said work and improvement to be done as
4 described in Section 2 of this Resolution shall be constructed upon the grades,,
5 along the lines, between the points, of the dimensions, at the places and in the
6 manner shown on the plans,, profiles and drawings for the construction of the
7 said wor1:t and improvement in "ASSESSMENT DISTRICT NO. 3-A" for District
8 No. 7, County Sanitation Districts of Orange County,, Cali~ornia,, consisting of
9 4 8 sheets, numbered 1 to 48, inclusive,, and identlfied as "Construction Plans
10 for Sanitary Sewers in Assessment District No. 3-A .. County Sanitati~n District
ll of Orange County, California,, Distr~ct No. 7 .. " all of which Plans are on file in
12 the office of the Secretary of County Sanitation Districts of Orange County,, Cali-
13 fornia,, and in the office of the Engineer of Work,, and except as otherwise pro-
14 vided on· said plans,, in further accqrdance with the specifications for the con-
15 struction of said work and improvement,, said specifications being on file in the
16 office of the Secretary of County Sanitation Districts of Orange County, Califor-
17 nia (and in the office of the Engineer of Work}, and to which plans, profiles,
18 drawings and specifications,, heretofore approved by the Board of Directors of
19 District No. 7, County Sanitation Districts of Orange County,, California, refer-
20 ence is hereby made for a further,, full and more particular description of said
21 work.
22 That all of the easements and rights-of-way for public sewer purposes
23 hereinabove described are shown upon the said plans, profiles and drawings
24 hereinabove mentioned.

DESCRIPTION OF ASSESSMENT DISTRICT
SECTION 4: That the said acquisition of lands, easements and rights-
28 of-way for all public sewer purposes and the said contemplated work and im-
29 provement, as aforesaid, is of more than local or ordinary public benefit and
30 the said Board of Directors hereby makes the expenses of saia acquisition,, work
31 and improvement chargeable upon a district, which said district the Board of
32 Directors hereby declares to be the district benefited by said acquisition, work

15 in the office of the Secretary of County Sanitation District of Orange County,
16 California, and a copy of which is on file in the office of the Engineer of Work,
17 EXCEPTING FROM the area shown within and delineated upon said map or plat
18 hereinabove referred to, the area of all public streets, public avenues, public
19 lanes, public roads, public drives, public courts, public alleys and all ease-
20 ments and rights-of-way therein contained belonging to the public, and any lot
21 or parcel of land belonging to the United States,, and als·o excepting therefrom
22 any lot or parcel of land belonging to the State of California or to the County of
23 Orange, or to the <?range County Flood Control District, ~hich lot or parcel of
24 land is in use for ~e performance of any public function, and all such property
25 above mentioned and described as being excepted from the area shall be omitted

said plat so on file shall govern for all details as to the extent of the said assess
ment district.
DESCRIPTION OF BONDS
SECTION 5: That serial bonds, bearing interest at the rate of six per
' cent (6%) per annum, shall be issued to represent each' assessment of Fifty
Dollars ($50. 00) or more, remaining unpaid for thirty (30) days after the date
of recording the warrant. Said serial bonds shall extend over a period ending
nine (9) years from.the second day of January next succeeding the next Septem-
ber 1st following their date. Payments on the: principal of unpaid assessments
~d interest ~hereon shall be made by property owners to the County Treasurer,
and the same shall be disbursed by said County Treasurer, all as provided in
the ''Improvement Act of 1911 '' hereinafter ref erred to.
This Board of Directors d<,:>es hereby elect and determine to have the
redemption pr9visions of said bonds provide a premium of five per cent (5%)
of the unpaid principal in accordance with the provisions of Section 6464 of the
Streets and Highways Code of the State of California.
