Section 3.There are hereby also established in the Joint Administrative Organization the following positions of employment at the salaries indicated opposite the respective poeitions: 1 General Manager $20,000/yr. 1 Assistant General Manager $17,500/yr. 1 Director of Finance,Secretary of the Joint Administrative Organization and Secretary of County Sanitation Districts Nos.1,2,3,5,6,7 and 11 of Orange $15,000/yr. County,California 1 Administrative &Purchasing Officer Range 48 -3- Section ~.A new section is hereby added to Resolution No.63-10 to read as follows: Section 13A:If,in the judgment of the General Manager or his designee,and except as provided hereinunder,work beyond the normal work day and/or work week provided in ResolutIon No.762,is required of an employee paid on a monthly basis,such overtime ser vice will be compensated for in equivalent time off with pay,to be taken not later than 90 days following the month in which the over time service was performed;provided,however,that if the General Manager or his designee determines that the work load and schedule of an employee is such that all of such equivalent time off cannot be taken,the employee shall be paid for any overtime service at the same rate at which the employee was employed during the month the overtime service was performed.Any such overtime pay shall be separately Itemized and paid on the payroll fox’the month in which the overtime service is performed and shall not exceed ten percent (l0~) of’the regular monthly pay of the employee on any payroll.After such payment is made,no further compensation,other than equivalent time off with pay as above provided,will be allowed for overtime service for the month for which such payment is made. For overtime service by any employee,the maximum amount of equivalent time off,with pay,shall be twelve (12)working days in any calendar year,unless otherwise ordered by the Boards. F~cept as provided hereinunder,any employee separating from the Districts’service who has performed overtime service and which overtime service has not been compensated for as provided above,shall be entitled to full pay at his regular rate for such overtime service. Any such overtime pay shall be separately itemized and paid in a lump sum on the payroll following separation.When separation is caused by the death of an employee,payment shall be made to the estate of such employee,or in applicable cases,as provided by Section 630 of the Probate Code.Nothing in this section shall be interpreted as preventing the General Manager from filling a position vacated by separation immediately following the last day actually worked by the separated employee. Provided,however,that no employee who occupies a position for which a salary exceeding that of Range 4k,as hereinabove estab lished,is provided,shall be paid either before or after separation for overtime service;and further provided that the General Manager shall cause to be kept a record of the accumulated overtime service of such employees and may grant equivalent time off with full pay at any time during employment to such employees upon application and for sufficient reason. Section 5.Each employee employed before the effective date of this resolution and assigned to a full time monthly position established in Section 2 hereof,shall be assigned the salary pro vided for by the step rate to which such employee is entitled on the effective date of this resolution,under the provisions of,and the salary assignments authorized by prior resolutions,as amended. Section 6.Sections 3 and 4 of Resolution No.762,Sections 1,2,3,and the first paragraph of Section 8 of Resolution No.63-10, and all other resolutions and motions or portions thereof in conflict herewith are hereby rescinded and made of no further effect.
