HomeMy WebLinkAboutResolution 1963 - 0092RESOLUTION NO.63-92-7 A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.7 OF ORANGE COUNTY CALIFORNIA ADOPTED PURSUANT TO PROVISIONS OF SECTION 2808 OF THE “SPECIAL ASSESSNENT INVESTIGATION LIMITATION AND MAJORITY PROTEST ACT OF 1931 “BEING DIVI SION 4 OF THE STREETS AND HI~HWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS,the Board of Directors of County Sani tation District No.7 of Orange County,California,has received a communication from the Health Officer of orange County,which communication is in words and figures as follows: ‘~Board of Directors May 8,1963 Orange County Sanitation District No.7 1104 West Eighth Street Santa Ana,California Gentlemen: “As Health Officer of the County of Orange and the incorporated cities therein,I hereby recommend that proceedings relative to the installation of local col lector sewers be instituted as quickly as possible for the following two areas: “1.Proposed Improvement District No.3 —An area bounded generally by Seventeenth Street on the south,Newport Freeway on the west,the City of Orange on the north,and Newport Ave nue on the east. “2.Proposed Improvement District No.6 -An area generally bounded by the City of Orange on the west and south,Panorama Heights on the southeast,and the County Sanitation District No.7 boundary on the east and north. “This recommendation is made as a measure necessary for the protection of public health and is also made pursuant to Section 2808 of the Streets and Highways Code of the State of California. ‘~e have made an investigation of the individual sewage disposal systems in these areas and have found that residents therein have been and are experiencing difficulties with their individual sewage disposal systems. “Very truly yours, ELR:eh /s/~dw.Lee Russell cc:Board of Supervisors EDW.LEE RUSSELL,M.D. City Council—Tustin Health Officer for the County City Council-Orange of Orange and the Incorporated City Council—Santa Ana Cities Therein” and ~!HERELS,this Board of Directors has duly consid ered said communication and has received information from the Engineer for this District with reference to the pro posed sewer improvements referred to in said communication; NOv~,THEREFORE,THE BOARD OF DIRECTORS OF CO!JNTY SANITATIC~~i DISTRICT NC.7 OF ORANGE COUNTY does hereby resolve,declare,find,determine and order as follows: Section 1 That the improvements referred to in said communication above quoted are the construction of local collector sanitary sewers and all appurtenant work in streets,rights—of—way and easements in the following two areas and proposed assessment districts: (a)Proposed Assessment’.District No.3,located entirely within the boundaries of County Sanitation District No.7 of Orange County and consisting of an area bounded generall by Seventeenth Street on the south,Newpor Freeway on the west,the City of Orange on the north,and Newport Avenue on the east. (b)Proposed Assessment.District No.6,located entirely within the boundaries of County Sanitation District No.7 of Orange Count and consisting of an area bounded general y by the City of Orange on the west and south, Panorama Heights on the southeast,and the County Sanitation District No.7 boundary on the east and north. Section 2 That this Board of Directors does hereby find and determine that the acquisition of easements and rights-of-way for and the construction of said sanitary sewers and incidental work in connection therewith,and each of them,is necessary as a health measure and such necessity for such acquisition and construction is found to exist. Section~That the Secretary is hereby authorized and instructed to spread the contents of said original communication from the County Health Officer upon the minutes of this meeting of County Sanitation District No.7 at which this resolution is adopted. —2— Section 4 That this resolution is adopted under and pursuant to the provisions of Section 2808 of the “Special Assessment Investigation,Limitation and Majority Protest Act of 1931”,being Division 4 of the Streets and Highways Code of the State of California,and this Board of Directors in adopting the same intends to meet each and every condition and to make each and every finding neces sary on its part in order to permit the proceedings for said sewer improvements in orie’or more special assessment districts to go forward to completion without further reference to or application of the provisions ~f said Division 4 of the Streets and Highways Code. —3— STATE OF CALIFORNIA) )ss COUNTY OF ORANG~) I,FRED A.HARPER,Secretary of the Board of Directors of County Sanitation District No.~of Orange County,Calif— ornia,do hereby certify that the above and foregoing Resolution No.63...92..~7 was regularly passed and adopted at a regular meeting of saId Board on the 12th day of June 1963,by the following vote,to wit: AYES:Directors Cook,Hubbard,Meyers,?ari~s and Peatherly, NOES: ABSENT:D~CtOZ~Dot’iey IN WITNESS WHEREOF,I have hereunto set my hand and affixed the o~’ficia1 seal of County Sanitation District No.7 of Orange County,California,this 12th day of June 1963.
