HomeMy WebLinkAboutResolution 1963 - 0082, RESOLUTION NO.63-82—7 AUTHORIZING SETTLEMENT WITH THE TUSTIN COMPANY A RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.7 OF ORANGE COUNTY,CALIF ORNIA,AUTHORIZING ACQUISITION OF PROPERTY FOR SEWER LINE,AUTHORIZING PAYMENT THEREFOR;AND APPROVING AGREEMENT FOR SETTLEMENT OF LAWSUIT (107680) The Board of Directors of County Sanitation District No.7 of Orange County,California,. DOES HEREBY RESOLVE,DETERMINE AND ORDER: Section 1.That the Chairman and Secretary of’the District are hereby authorized and directed to execute an agreement for settlement of lawsuit and acquisition of property for sewer line when said agreement has been approved as to form by C.Arthur Nisson,Jr.,General Counsel for the District,which said agreement shall provide for acquisition in fee of Parcel 14—P described in that certain lawsuit entitled “County Sanitation District No.7 of Orange County,California,vs.Santa Ana Lumber Company,et al”, numbered 107680,now pending in the Superior Court of the State of California in and for the County c~f Orange,and authorize payment to The Tustin Company in the sum of $12,825.00 for said real pro perty.That said agreement shall otherwise contain a description of the rights of The Tustin Company to use the sewer line which has been constructed in said real property.That said agreement shall further provide that the payment hereinabove provided for shall include payment for all damages sustained by ~The Tustin Company arid Include payment for the use of’Parcel 4—T as des cribed in the hereinabove—mentioned lawsuit during the construc tion of the aforementioned subtrunk sewer line. Section 2.That upon execution of the agreement described in Section 1 and the receipt of a grant deed from The Tustin Company to the District,the attorneys for the District,Miller, —1— Nisson~Kogler &Wenke,are autho~izèd to dismiss said lat~isuit as against The Tustin Company with reference to Parcels 4—P and 4—P in particular6 Section 3.That upon receipt of the grant deed to the Dlstrlct in a form approved by C.Arthur Nisson,Jr.,General Counsel for the District,said General Counsel is authorized to execute a warrant made payable to The Tustin Company in the sum of $12,825.00; and that this warrant shall be delivered to the attorneys for said Tustin Company. —2— .1 STATE OF CALIFORNIA) )ss COUNTY OF ORANGE ) I,FRED A.HARPER,Secretary of the Board of Directors of County Sanitation District No.7 of Orange County,California,do hereby certify that the above and foregoing Resolution No.63—82—7 was regularly passed and adopted at an adjourned regular meeting of said Board on the 17th day of May,1963,by the following vote,to wit: AYES:Directors Doney,Meyers,Parks and Featherly NOES:None ABSENT:Directors Cook and Hubbard IN WITNESS WHEREOF,I have hereunto set my hand and affixed the official seal of County Sanitation District No.7 of Orange County,California,this 17th day of May,1963. ~~Lm,(t9.
