RESOLUTION OF THE BOARD OF DIRECTORS OF COUNTY SANITATION
DISTRICT NO.1 OF ORANGE COUNT?;CALIFORNIA,AUTHORIZING

WHEREAS,the Board of Administration of the State Employees’
R~tirement System and the BOARD OF DIRECTORS OP COUNTY SANITATION DIS
T~JCT NO.1 OF ORANGE COUNTY,ACTING FOR ITSELF AND COUNTY SANITATICN
)~TRICTS NOS.2,3,5,6,7,8 AND 11 entered into a contract effrc

TION DISTRICTS NOS.1,2,3,5,6,7,8 AND 11 OF~ORANGE COUNTY in the
SteteEtnployees’Retirement System;and
WHEREAS,said contract was in error in not clearly stating the
proper title of the contracting public agency;,and
WHEREAS,Section 20461 of the State Employees’Retirement Law
provides that an error made in a contract may be corrected through
amendments approved by the adoption of suitable resolutions by the
contracting parties;
NOW,THEREFORE,BE IT RESOLVED,that the BOARD OF DIRECTORS
authorize,and it does hereby authorize,an ~amendmant to said Contract
a copy of said Amendment being attached hereto marked “Exhibit A”,an
by such reference made a part hereof as though herein set out in full;
and
BE IT FURTHER RESOLVED,that the Chairman of County Sanitation
District No.1 be,and he is hereby authorized,empowered and directed
to execute said Amendment for Find Ofl behalf of the COUNT~(SANITATION
DLSTRICTS NOS.1,2,3,5,6,7,8 AND 11 OF ORANGE COUNTY.

AMENDMENT TO CONTRACT BETWEEN THE
BOARD OF ADMINISTRATION
STATE EMPLOYEES’RETIREMENT SYSTEM
AND THE
BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO.1
OF ORANGE COUNTY
ACTING FOR ITSELF AND COUNTY SANITATION DISTRICTS
NOS.2,3,5,6,7,8 AND 11
The Board of Administration,State Employees’Retirement System,
hereinafter referred to as Board,and the Board of Directors of the
COUNTY SANITATION DISTRICT NO.1 OF ORANGE COUNTY,ACTING FOR ITSELF
AND COUNTY SANITATION DISTRICTS NOS.2,3,5,6,7,8 and 11,here
inafter referred to as Public Agency,having entered into a contract
under date of October 1,1954 effective October 1,1954,which pro
vides for participation of Public Agency in said System,Board and
Public Agency hereby agree as follows:
A.The following phrase is added to the sentence which con
stitutes Paragraph Number 1 of said agreement:
“except such as apply only on election of a con
tracting agency and are not provided for herein
and to all amendments to said Law hereafter enacted
except such as by express provision thereof apply
only on the election of contracting agencies.”
B.Paragraphs 3 through 14 are hereby stricken from said con
tract as executed effective October 1,1954,and are here
by replaced by the following paragraphs numbered 3 through
10 inclusive:
3.Employees of Public Agency in the following classes
and groups shall become members of said Retirement
System except such in each such class and group as
are excluded by law or this agreement:
a.Employees other than local safety members (herein
referred to as miscellaneous members).
In addition to the employeeth excluded from membership
by said Retirement Law,the following employees shall
not become members of the Retirement System:

“EXHIBIT A”
4.All words and terms used herein which are defined in
the State Employees’Retirement Law shall have the
meaning as defined therein unless otherwise specifi
cally provided.“Normal retirement age”shall mean
age 60 for miscellaneous members.
5.1/60 shall be the fraction of final compensation to
be provided for each.year of credited current service
as a miscellaneous member upon retirement at normal
retirement age.
6.Benefits on account of each year of prior service
shall be 100 percent of the fraction of final compen
sation provided under Section 21253 of the State
Employees’Retirement Law.
7.The following provisions of the State Employees’
Retirement Law which apply only upon election of a
contracting agency shall apply to the Public Agency
and its employees:
a.Section 21251.1 (providing for a guaranteed
percentage of final compensation for each year
of current service as a miscellaneous member).
b.Section 2002)4.01 (defining “final compensation”
on the basis of a period of three consecutive
years).
C.Section 21258(b)(providIng a minimum retirement
allowance of $720.00 per year).
d.Section 21367.51 (providing a $400.00 death
benefit upon death after retirement).
e.Section 20025 (provIding for inclusion of com
pensation without limit in computations in which
compensation is a factor).
8.Public Agency shall contribute to said Retirement
System as follows:
a.0.776 percent of total salaries each month for
25 years,less the years elapsed between the
effective date of the contract and the effective
date of this amendment,on account of the liability
for prior service.

b.5.181 percent of total salaries paid by Pi.~blic
Agency each month to its employees who are and
hereafter become members of said Retirement Sys
tem,provided that only salary earned members of
said System shall be included in said total salaries.
C.A reasonable amount per annum,fixed by Board to
cover the costs of administering said System as
it affects the employees of Public.Agency,not
Including the costs of special valuatlonb ~r of
the periodical investigation and valuation required
by law,provided that said amount shall be deter
mined on the basis of.the number of employees of
Public Agency who are members on July 1 of the
respective fiscal years,or with respect to the
first year of participation,on the effective date
of said participation.
d.A reasonable amount as fixed by the Board,payable
in one installment as the occasions arise,to
cover costs of special valuations on account of
employees of Public Agency,and costs of the
periodical investigation and valuation required
by law.
9.Contributions required of Public Agency and its
employees shall be subject to adjustment by Board on
accouritof amendments to the State Employees’Retire
ment Law,and on account of experience under the
Retirement System,as determined by the periodical
investigation and valuation required by said Retire
ment Law.
10.Contributions required of Public Agency and its
employees shall be paid by Public Agency to the
Retirement System within thirty days after the
end of the period to which said contributions
refer.If more or less than the correct amount of
contribution is paid for any period,proper adjust
ment shall be made in connection with subsequent
remittances,or adjustments on account of errors in
contributions required of any employee may be made
by direct cash payments between the employee and
Board.Payments by Public Agency to Board may be
made in the form of warrants,bank checks,bank
drafts,certified checks,money orders,or cash.

C.This amendment shall be attached to said contract and
shall become effective on the 1st day of July,1960.

The Board of Administration,State Employees’Retirement System,
hereinafter referred to as Board,and the Board of Directors of the
COUNTY SANITATION DISTRICT NO.1 OF ORANGE COUNTY,ACTING FOR ITSELF

vides for participation of Public Agency in said System,Board and
Public Agency hereby agree as follows:

pensation without limit In computations in which
compensation is a factor).
8.Public Agency shall contribute to said Retirement
System as follows:
a.0.776 percent of total salaries each month for
25 years,less the years elapsed between the
effective date of the contract and the effective
date of this amendment,on account of the liability
for prior service.

b.5.181 percent of total salaries paid by Public
Agency each month to its employees who are and
hereafter become members of said Retirement Sys
tem,provided that only salary earned members of

it affects the employees of Public.Agency,not
including the costs of special valuatlonb ~,r of
the periodical investigation and valuation required
by law,provided that said amount shall be deter
mined on the basis of the number of employees of
Public Agency who are members on July 1 of the
respective fiscal years,or with respect to the
fIrst year of participation,on the effective date
of said participation.
d.A reasonable amount as fixed by the Board,payable
in one installment as the occasions arise,to
cover costs of special valuations on account of
employees of Public Agency,and costs of the
periodical Investigation and valuation required

8.Public Agency shall contribute to said Retirement
System as follows:
a.0.776 percent of total salaries each month for
25 years,less the years elapsed between the
effective date of the contract and the effective
date of this amendment,on account of the liability
for prior service.

b.5.181 percent of total salaries paid by Public
Agency each month to its employees who are arid
hereafter become members of said Retirement Sys
tem,provided that only salary earned members of
said System shall be included In said total salaries.
c.A reasonable amount per annum,fixed by Board to
cover the costs of administering said System as
it affects the employees of Public.Agency,not
Including the costs of special valuatj~onb ~r of
the periodical Investigation and valuation required
by law,provided that said amount shall be deter
mined on the basis of the number of employees of
Public Agency who are members on July 1 of the
respective fiscal years,or with respect to the
fIrst year of participation,on the effective date
of said participation.
d.A reasonable amount as fixed by the Board,payable
in one installment as the occasions arise,to
cover costs of special valuations on account of
employees of Public Agency,arid costs of the
periodical investigation and valuation required
by law.
9.Contributions required of Public Agency and its
employees shall be subject to adjustment by Board on
account of amendments to the State Employees’Retire
ment Law,and on account of experience under the
Retirement System,as determined by the periodical
investigation and valuation required by said Retire
ment Law.
10.Contributions required of Public Agency and its
employees shall be paid by Public Agency to the
Retirement System within thirty days after the
end of the period to which said contributions
refer.If more or less than the correct amount of
contribution is paid for any period,proper adjust
ment shall be made in connection with subsequent
remittances,or adjustments on account of errors In
contributions required of any employee may be made
by direct cash payments between the employee and
Board.Payments by Public Agency to Board may be
made in the form of warrants,bank checks,bank
drafts,certified checks,money orders,or cash.
